Pursuant to Law on Education dated June 6, 2019;
Pursuant to Decree No. 86/2022/ND-CP dated October 24, 2022 of the Government defining the function, tasks, powers and organizational structure of the Ministry of Education and Training;
Pursuant to the Government’s Decree No. 101/2017/ND-CP dated September 01, 2017 on training and refresher training of officials and public employees; Decree No. 89/2021/ND-CP dated October 18, 2021 of the Government on amendments to the Government’s Decree No. 101/2017/ND-CP dated September 1, 2017 on training and refresher training of officials and public employees;
At the request of the Director General of Teachers and Educational Administrator Department;
The Minister of Education and Training promulgates a Circular on amendments to the Regulation on refresher training for teachers, administrators of preschool education institutions, compulsory education institutions and teachers of continuing education centers issued together with Circular No. 19/2019/TT-BGDDT dated November 12, 2019 of the Minister of Education and Training.

“1. Teachers who are taking care of, nurturing and educating children at preschools, kindergartens, nursery schools, daycare groups, independent kindergarten classes, independent preschool classes (hereinafter referred to as “preschool education institutions”); teachers who are working at primary schools, middle schools, high schools, combined schools, selective schools, boarding schools for ethnic minority students and day schools for ethnic minority students, schools for people with disabilities (hereinafter referred to as “compulsory education institutions”) and teachers who are working at continuing education centers, teachers who are teaching educational programs to grant degrees, diplomas of the national education system at vocational education and continuing education centers (hereinafter referred to as continuing education centers).
Teachers of preschool education institutions, compulsory education institutions and continuing education centers are collectively referred to as teachers.
2. Principals and deputy principals of preschool education institutions and compulsory education institutions; directors, deputy directors of continuing education centers (hereinafter referred to as “administrators”).”.
2. Clause 1 Article 3 shall be amended as follows:
“1. Provide refresher training in specialized knowledge and skills required for the working positions of teachers and administrators. This is the basic for management, direction and organization of refresher training and self-improvement in order to improve the qualities and capacity for professional skills of teachers and administrators; raise the level of responsiveness of teachers and administrators according to the requirements for working positions; meet requirements for the development of early childhood education, general education, continuing education and meet the professional standards.”.
3. Point b Clause 1 Article 7 shall be amended as follows:
“b) The drafted documents shall ensure a combination of theory and practice; knowledge, experience and practical skills; integrate refresher training programs with similar contents; avoid duplicate contents. Programs and documents must be regularly supplemented, updated and enhanced in accordance with the actual circumstances;”.
4. Clause 1 Article 9 shall be amended as follows:
“1. Regular refresher training speakers: are teachers of the education institutions performing tasks; key experts, educational administrators, key teachers and administrators of preschool education institutions and compulsory education institutions; teachers and administrators of continuing education centers that meet the standards specified in Clause 2 of this Article.”.

“c) Have experience of regular refresher training of teachers and administrators); have sense of responsibility, the ability to cooperate with colleagues; have the ability to guide and consult teachers and administrators for self-study; master the process of organization, contents, techniques, methods and forms of evaluation of the results of regular refresher training according to regulations;
d) Have skills in applying information technology in designing, building and developing documents and learning materials to provide refresher training for teachers and administrators.”.
6. Article 11 shall be amended as follows:
“1. Carry out evaluation of the application of the knowledge of regular refresher training to the practice of teaching and learning, education for children and students; the practice of management of preschool education institutions, compulsory education institutions and continuing education centers. Evaluation needs to combine regular assessment with periodic evaluation by various methods and forms suitably through tests, research exercises and essays in order to meet requirements for objectives and contents of the regular refresher training program, actual circumstances and regulations of this Regulation.
2. Tests, research exercises and essays shall be graded on a 10-point scale. A test is satisfactory if its score is 05 or higher.
3. Classification of the results:
a) Completion of the plans for regular refresher training: the teachers and administrators shall conform to regulations of the refresher training courses in the academic year; pass all the tests, research exercises and essays according to regulations of Clause 2 of this Article.
b) Non-completion of the plans for regular refresher training: the teachers and administrators fail to meet the requirements specified in Point a Clause 3 of this Clause.
4. The result of the evaluation shall be recorded in the documents. This is basis for implementation of the regimes and policies on the refresher training and development of careers and the use of teachers and administrators.”.

“Article 12. Recognition of completion of the plans for regular refresher training
Teachers and administrators who complete the refresher courses during the academic year as prescribed at Point a, Clause 3, Article 11 will be recognized by the Department of Education and Training for completing the plan for regular refresher training.”.
8. Point c Clause 2 Article 13 shall be amended as follows:
“c) Carry out regular refresher training and evaluate the results of regular refresher training and send them to the Department of Education and Training.”.
9. Clause 1 Article 19 shall be amended as follows:
“1. Comply with the mechanism for cooperation specified in Article 13 of this Regulation; develop refresher training programs and documents, and publicize the list of speakers before holding the training courses.”.
This Circular comes into force as of January 20, 2023.
