ON AMENDMENTS TO CIRCULAR NO. 12/2017/TT-BLDTBXH DATED APRIL 20, 2017 OF THE MINISTER OF LABOR, WAR INVALIDS AND SOCIAL AFFAIRS ON MINIMUM BODY OF KNOWLEDGE AND COMPETENCY REQUIREMENTS THAT STUDENTS SHOULD ATTAIN UPON GRADUATION FROM INTERMEDIATE AND COLLEGE LEVELS

Pursuant to the Law on Vocational Education dated November 27, 2014;

Pursuant to the Government’s Decree No. 62/2022/ND-CP dated September 12, 2022 defining the functions, tasks, powers and organizational structure of the Ministry of Labor, War Invalids and Social Affairs;

Pursuant to the Government’s Decree No. 15/2019/ND-CP dated February 1, 2019 of the Government on elaboration of certain articles and measures to implement the Law on Vocational Education; at the request of Director of General Department of Vocational Education,

The Minister of Labor, War Invalids and Social Affairs promulgates a Circular on amendments to Circular No. 12/2017/TT-BLDTBXH dated April 20, 2017 of the Minister of Labor, War Invalids and Social Affairs on minimum body of knowledge and competency requirements that students should attain upon their graduation from intermediate and college levels (hereinafter referred to as minimum body of knowledge and competency requirements for intermediate and college levels).

Article 1. Amendments to Circular No. 12/2017/TT-BLDTBXH dated April 20, 2017 of the Minister of Labor, War Invalids and Social Affairs on minimum body of knowledge and competency requirements for intermediate and college levels

1. Article 7 shall be amended as follows:

The minimum body of knowledge and competency requirements for intermediate and college levels by each training discipline or trade include:

1. Name of training disciplines or trades

2. Level of training

3. Minimum body of knowledge

4. Competency requirements

a) Knowledge requirements;

b) Skill requirements;

c) Degree of autonomy and responsibility.”.

2. Article 8 shall be amended as follows:

1. Preparation

a) The Director of General Department of Vocational Education shall establish a Steering Committee to formulate the Regulation on minimum body of knowledge and competency requirements for intermediate and college levels by each training discipline or trade (hereinafter referred to as the Regulation);

b) The Steering Committee is trained and guided by the General Department of Vocational Education on methods and procedures for formulating the Regulation.

2. The Steering Committee shall formulate the Regulation according to the following steps:

a) Research and survey on vocational standards, worker-level standards, job positions in enterprises, and national vocational skill standards;

b) Analyze professions or jobs, identify job positions, and required competencies for each job position of the profession;

c) Compile the Regulation using the form specified in the Appendix issued together with this Circular;

d) Organize workshops to gather opinions from administrators, scientists, experts, lecturers, teachers, and employers for finalizing the draft content;

dd) Seek opinions from enterprises, professional administrators, and training administrators on the draft Regulation;

3. The General Department of Vocational Education provides guidance, carries out inspections, and supervises the formulation process of the Regulation, ensuring compliance with the established procedure and quality assurance”.

3. Article 9 shall be amended as follows:

 “Article 9. Process of appraisal, acceptance, and promulgation of the Regulation

1. Preparation for appraisal

a) The Minister of Labor, War Invalids and Social Affairs shall establish the Appraisal Council of the Regulation by training disciplines and trades (hereinafter referred to as Appraisal Council);

b) The Appraisal Council is trained and guided by the General Department of Vocational Education on contents, methods, and process of appraisal;

c) The General Department of Vocational Education shall send a draft Regulation to members of the Appraisal Council to prepare comments and assessments;

d) The members of the Appraisal Council shall examine the draft Regulation and send comments thereon to the Chairperson of the Appraisal Council;

dd) After receiving all opinions of the members, the Chairperson of the Appraisal Council shall notify the Steering Committee of the plan, schedule and location of the appraisal meeting and the contents to be reported to the Appraisal Council.

a) The Steering Committee shall report the draft Regulation for the assigned discipline or trade;

b) Members of the Appraisal Council shall comment and evaluate the draft;

c) The Steering Committee shall acquire or give explanation to opinions of each member of the Appraisal Council;

d) The Chairperson of the Appraisal Council will consolidate comments, suggestions, explanations, and conclusions regarding the issues that the Steering Committee needs to address and revise in the draft;

dd) The Appraisal Council votes to evaluate the draft Regulation based on specific criteria outlined in the prescribed form by the Chairperson of the Appraisal Council. The evaluation has three levels: satisfactory, satisfactory but requiring revisions, and unsatisfactory.

3. Acceptance

a) The draft Regulations will be accepted once it receives satisfactory evaluation votes from all of the members of the Appraisal Council;

b) If the draft Regulation receives unsatisfactory evaluation votes from more than half of the members of the Appraisal Council, the Steering Committee must make revisions and seek re-appraisal. The re-appraisal follows the guidelines stated in Clause 2 of this Article;

c) Apart from the cases mentioned in Points a and b of this Clause, the Steering Committee must make revisions based on the conclusions drawn by the Chairperson of the Appraisal Council.  After the revisions are made and approved in writing by all of the members of the Appraisal Council, the draft Regulation will be accepted without requiring another appraisal meeting.

5. Replace the phrase "competency requirements that students have to attain" with the phrase "competency requirements that students should attain" in the titles of Article, Clause 3, Article 6; Point a, Clause 4, Article 10; Point b, Clause 4, Article 11; Clause 1, Clause 2, Article 12; Clause 1, Clause 2, Article 13; Article 14; and Clause 1, Article 15.

Article 2. Implementation

Ministries, ministerial-level agencies, Governmental agencies, People's Committees of provinces and centrally affiliated cities, socio-political organizations, General Department of Vocational Education and Training, Department of Labor - Invalids and Societies, colleges, intermediate schools, and other institutions that have registered for vocational education activities at intermediate and college levels shall implement this Circular.

Article 3. Entry in force

1. This Circular comes into force as of July 30, 2023.

2. The regulations of disciplines and trades that are currently under formulation or appraisal but have not yet been promulgated shall continue to follow Circular No. 12/2017/TT-BLDTBXH until they are promulgated by competent authorities.

3. Difficulties which may arise in connection with the implementation of this Circular shall be reported to the Ministry of Labor, War Invalids and Social Affairs for consolidation and amendments./.
