CIRCULAR
PROVIDING GUIDANCE\r\nON INVESTMENT AND SUPPORTING CONTENTS FOR DEVELOPMENT OF RARE HERB PLANTING\r\nAREAS UNDER THE NATIONAL TARGET PROGRAM FOR SOCIO-ECONOMIC DEVELOPMENT OF\r\nETHNIC MINORITY AND MOUNTAINOUS REGIONS IN 2021 – 2030 PERIOD, STAGE I: FROM\r\n2021 TO 2025
Pursuant to the Government’s Decree No.\r\n75/2017/ND-CP dated June 20, 2017 defining functions, tasks, powers and\r\norganizational structure of the Ministry of Health;
Pursuant to the Government’s Decree No.\r\n27/2022/ND-CP dated April 19, 2022 introducing mechanism for management and\r\nimplementation of national target programs;
Pursuant to the Government’s Decree No.\r\n28/2022/ND-CP dated April 26, 2022 introducing preferential credit policy for implementation\r\nof the National target program for socio-economic development of ethnic\r\nminority and mountainous regions in 2021 – 2030 period, stage 1: from 2021 to\r\n2025;
For the purpose of the Decision No. 1719/QD-TTg\r\ndated October 14, 2021 of the Prime Minister of Vietnam giving approval for the\r\nNational target program for socio-economic development of ethnic minority and\r\nmountainous regions in 2021 – 2030 period, stage I: from 2021 to\r\n2025;
At the request of the Director of the\r\nTraditional Medicine Administration of Vietnam;
The Minister of Health of Vietnam promulgates a\r\nCircular providing guidance on investment and supporting contents for\r\ndevelopment of rare herb planting areas under the National target program for\r\nsocio-economic development of ethnic minority and mountainous regions in 2021 –\r\n2030 period, stage I: from 2021 to 2025.

GENERAL PROVISIONS
Article 1. Scope
This Circular provides guidance on herbal material\r\ndevelopment plans, approval of projects and list of eligible policy beneficiaries,\r\ntotal investment, investment by business establishments when participating in\r\nprojects, borrowing plan for each project and each business establishment\r\nparticipating in Content 2 Sub-project 2 of Project 3 on investment and support\r\nfor development of rare herb planting areas under the National target program\r\nfor socio-economic development of ethnic minority and mountainous regions in\r\n2021 – 2030 period, stage I: from 2021 to 2025 that is approved under the\r\nDecision No. 1719/QD-TTg dated October 14, 2021 of the Prime Minister of\r\nVietnam.
Article 2. Regulated entities
1. Ethnic minority people and households, poor\r\nhouseholds, and households near poverty line that live in areas which have\r\nnatural conditions suitable for developing rare herbs and participate in\r\nprojects.
2. Any hamlet, village, commune, district or\r\nprovince where the project is located.
3. Enterprises, cooperatives, cooperative unions,\r\nfamily households and business establishments (hereinafter referred to as\r\n“business establishments”) that implement or participate in rare herbal\r\nmaterial projects located in extremely disadvantaged ethnic minority and\r\nmountainous regions, employ ethnic minority people accounted for at least 50%\r\nof total employees (especially, a project employing female employees that are\r\naccounted for more than 50% of total employees is prioritized), and have\r\ncommitments on purchase, production and consumption of herbal materials from\r\nsuch projects.
4. Regulatory authorities, organizations and\r\nindividuals involving in management and implementation of rare herbal material\r\nprojects.
Article 3. Definitions

1. “owner” of a rare herbal material component\r\nproject means the Ministry of Health of Vietnam.
2. “host entity” of a rare herbal material program\r\nmeans the People's Committee of province where the rare herbal material project\r\nis located.
3. “managing body” of a rare herbal material\r\nproject means an authority that is provided with funding from the provincial\r\nPeople’s Committee to support the implementation of rare herbal material\r\nprojects.
4. “rare herbal material project” means a herbal\r\nmaterial value chain linkage project, including the rare herb planting area\r\nproject and project on hi-tech herb propagation, conservation and development\r\ncenters (hereinafter referred to as “herb propagation center project”).
5. “herbal material value chain linkage” means a\r\nlinkage existing under a written agreement between a leading entity and its\r\nmembers on implementation of one, some or all stages from supply of input\r\nmaterials/services, conversation of genetic resources, seed/seedling selection\r\nand production, cultivation, harvesting, preparation, processing, production,\r\nstorage associated with consumption/sale of herbal materials.
6. “leading entity” of a linkage means an\r\nenterprise, cooperative or cooperative union that proposes a linkage project or\r\nplan for cooperating with individuals, residential communities and/or artels to\r\nimplement a rare herbal material project which is located in an extremely\r\ndisadvantaged ethnic minority and mountainous region, and uses ethnic minority\r\npeople accounted for at least 50% of its total employees.
7. “member” of a linkage means an enterprise, cooperative,\r\ncooperative union, family household or another business establishment that is\r\noperating in an extremely disadvantaged ethnic minority and mountainous region\r\nand employs ethnic minority people accounted for at least 50% of their total\r\nemployees for participating in a project.
Article 4. Rules for management and\r\nimplementation of rare herbal material projects
1. Rules for management and implementation of\r\nnational target programs laid down in Article 4 of the Government’s Decree No.\r\n27/2022/ND-CP dated April 19, 2022 introducing mechanism for management and\r\nimplementation of national target programs (hereinafter referred to as “Decree\r\nNo. 27/2022/ND-CP”) and relevant laws on planting, management and harvesting of\r\nherbs must be strictly observed.

3. Rare herbal material projects in forest land\r\nmust be combined with sustainable forest protection and development in\r\naccordance with regulations of law.
4. Projects employing female employees that are\r\naccounted for more than 50% of their total employees, hi-tech projects and\r\nprojects to which capital may be contributed with land use rights of family\r\nhouseholds and individuals living in the project areas for establishing raw\r\nmaterial areas are prioritized.
Article 5. Disclosure of information and\r\nretention of implementation results of rare herbal material projects
1. Information on rare herbal material projects\r\nshall be disclosed in accordance with the provisions of Article 29 of the\r\nDecree No. 27/2022/ND-CP and relevant law provisions.
2. Information to be disclosed includes:
a) Information about the rare herbal material\r\nproject, including: name, objectives, contents, products, list of eligible\r\npolicy beneficiaries, leading entity and members of the linkage, implementation\r\nperiod, total investment, investment by each business establishment\r\nparticipating in the project, summarized implementation results of the project,\r\nshall be posted on the websites of the managing body of the rare herbal\r\nmaterial project, the host entity of the rare herbal material program, and the\r\nowner of rare herbal material component project or other means of mass media as\r\nprescribed in prevailing laws.
b) The dissemination of implementation results of\r\nthe rare herbal material project shall comply with the provisions of the Law on\r\nJournalism and Clause 2 Article 4 of the Circular No. 15/2022/TT-BTC dated\r\nMarch 04, 2022 of the Minister of Finance of Vietnam prescribing management and\r\nuse of funding for non-profit activities for implementing the National target\r\nprogram for socio-economic development of ethnic minority and mountainous\r\nregions in 2021 – 2030 period, stage I: from 2021 to 2025 (hereinafter referred\r\nto as “Circular No. 15/2022/TT-BTC”).
c) Government of the local area where the project\r\nis located, leading entity of the linkage and organizations giving assistance\r\nin application of technologies shall disseminate information on and\r\nimplementation results of the project.
3. Implementation results of rare herbal material\r\nprojects shall be retained in accordance with regulations of law on retention.

RARE HERBAL MATERIAL DEVELOPMENT PLANS
Article 6. Location of rare herbal material\r\nprojects
A rare herbal material project must be implemented\r\nat a location that meets the following criteria:
1. It is a district that contains an extremely\r\ndisadvantaged commune as prescribed in the Decision No. 861/QD-TTg dated June\r\n04, 2021 of the Prime Minister of Vietnam giving approval of the list of\r\nregion-III, region-II and region-I ethnic minority and mountainous communes in\r\n2021 – 2025 period.
2. It is a district in the ethnic minority and\r\nmountainous region at least 50% of population of which is ethnic minority\r\npeople.
3. It has potential for development of rare herbs\r\nwith high medicinal and economic value.
4. A project on cultivation and development of\r\nVietnamese ginseng must be located at 1.000 meters, or more, above the sea\r\nlevel.
Article 7. Area of a rare herbal material\r\nproject
1. A rare herbal material project must have a\r\nminimum area of 210 ha, including rare herb planting area, workshop, storage\r\nfacility, and waste treatment, transport, electricity and water infrastructure\r\nfacilities in the project corridor. A project on development of rare herbal\r\nmaterial regions that has an area of 30 ha and applies high technologies is\r\nprioritized.

Article 8. Types of\r\nrare herbs
Rare herbs to be selected for implementing rare\r\nherbal material projects must meet the following requirements:
1. They are included in the list of herbal\r\nmaterials with high medicinal and economic value enclosed with the Decision No.\r\n3657/QD-BYT dated August 20, 2019.
2. They must adapt to local growth conditions, and\r\nhave high productivity and quality.
3. Conservation and development of local types of\r\nherbs which are included in the Ministry of Health's list of rare and precious\r\nherbs are prioritized.
Article 9. Technical standards
1. The cultivation of herbs must comply with the\r\ngood agricultural and collection practices of herbal materials and collection\r\nof natural herbal materials laid down in the Circular No. 19/2019/TT-BYT dated\r\nJuly 30, 2019 of the Minister of Health of Vietnam.
2. Herbal material processing/manufacturing\r\nfacilities must satisfy the requirements of good manufacturing practices for\r\nmedicinal products and medicinal materials laid down in the Circular No.\r\n35/2018/TT-BYT dated November 22, 2018 of the Minister of Health of Vietnam.
3. Herbal material storage facilities must satisfy\r\nthe requirements of good storage practices for herbal materials and traditional\r\nmedicinal materials laid down in the Circular No. 36/2018/TT-BYT dated November\r\n22, 2018 of the Minister of Health of Vietnam.

Chapter III
GUIDANCE ON APPROVAL OF PROJECTS, TOTAL INVESTMENT,\r\nBORROWING PLANS OF BUSINESS ESTABLISHMENTS PARTICIPATING IN RARE HERBAL\r\nMATERIAL PROJECTS
Article 10. Document forms, selection procedures\r\nand contents of decisions on approval of rare herbal material projects
1. Forms of documents required in project proposals\r\nare enclosed herewith. Host entities of rare herbal material programs may\r\nuse the document forms provided in the Appendix enclosed herewith as references\r\nwhen requesting Provincial People’s Councils to decide document forms and\r\nprocedures for selection of rare herbal material projects as prescribed.
2. Procedures for selection of rare herbal material\r\nprojects shall comply with the provisions of Points a, b and c Clause 3 Article\r\n21 of the Decree No. 27/2022/ND-CP.
3. A decision on approval of a rare herbal material\r\nproject shall, inter alia, include the contents specified in Point d Clause 3\r\nArticle 21 of the Decree No. 27/2022/ND-CP, and the list of eligible policy\r\nbeneficiaries as prescribed in Clause 2 Article 38 of the Government’s Decree\r\nNo. 28/2022/ND-CP dated April 26, 2022 introducing preferential credit policy\r\nfor implementation of the National target program for socio-economic\r\ndevelopment of ethnic minority and mountainous regions in 2021 – 2030 period,\r\nstage 1: from 2021 to 2025 (hereinafter referred to as “Decree No.\r\n28/2022/ND-CP”) which shall be then used as the basis for grant of loans by the\r\nbank for social policies within their competence.
Article 11. Total investment and investment by\r\nbusiness establishments participating in rare herbal material projects
1. Total investment of a rare herbal material\r\nproject means total amount of funds mobilized for performing the project tasks,\r\nincluding funding derived from state budget, funds contributed by business\r\nestablishments (including the leading entity and members of the linkage),\r\npreferential loans and other lawful funding sources.
2. Investment made by a business establishment\r\nparticipating in a rare herbal material project means total amount of funds\r\nmobilized by the business establishment for performing the project tasks as\r\ncommitted.

1. Rules for management of support for rare herbal\r\nmaterial projects shall comply with the provisions of Article 20 of the Decree\r\nNo. 27/2022/ND-CP.
2. A rare herbal material project shall be eligible\r\nfor support derived from state budget if it meets the support conditions laid\r\ndown in Clause 1 Article 21 of the Decree No. 27/2022/ND-CP.
3. Business establishments in area of the relevant\r\nproject shall, pursuant to guidelines given by their local government, apply\r\nfor the following support contents:
a) Support for construction of infrastructure\r\nfacilities of raw material areas. Projects to which capital may be contributed\r\nwith land use rights of family households and individuals living in the project\r\nareas for establishing raw material areas are prioritized.
b) Support for investment in hi-tech herb planting\r\nareas/regions for construction of infrastructure facilities, equipment purchase\r\nand environmental remediation.
c) Support for construction of transport\r\ninfrastructure facilities/systems meeting grade-V standards for mountainous\r\nregions, electrical systems, water supply and drainage systems serving the\r\ndevelopment of raw material areas.
d) Support for covering costs of investment in\r\nrepair or construction of rare herbal material processing facilities for\r\nconstruction of waste treatment, transport, electricity and water\r\ninfrastructure facilities, workshops and purchase of equipment in the project\r\ncorridor.
dd) Support for covering costs of construction of\r\nrare herbal material storage facilities, including drying, irradiation,\r\ndecontamination, bio-preservation facilities, transport, electricity, water and\r\nwaste treatment facilities, workshops and equipment purchase.
e) Support for enterprises providing on-site\r\nvocational training courses for employees.

h) Support for implementation of scientific\r\nresearch projects, acquisition of patents, technologies or scientific research\r\nand technological development findings for producing new products, facilitating\r\ntechnology innovation, minimizing environmental pollution and saving materials,\r\nfuels and energy.
i) Support for covering costs of transfer and\r\napplication of advanced techniques, and uniform chain-based application of\r\ntechnical process and quality management.
k) Support for seeds/seedlings, supplies, packing\r\nmaterials, labels of products which shall be granted for not more than 03 crops\r\nor 03 production cycles.
l) Each herb propagation center project may be\r\neligible for state support for production of original germplasm and commercial\r\nseeds/seedlings.
4. Amounts and methods of provision of state budget\r\ngrants to rare herbal material projects shall comply with the provisions of\r\nClause 5 Article 21 of the Decree No. 27/2022/ND-CP.
5. Amounts of support for rare herbal material\r\nprojects granted using state budget’s funding for non-profit activities shall\r\ncomply with the provisions of Article 13 of the Circular No. 15/2022/TT-BTC.
Article 13. Preferential credit policy
1. Preferential credit policy applicable to rare\r\nherbal material projects shall comply with the provisions of Articles 26\r\nthrough 31 of the Decree No. 28/2022/ND-CP.
2. Borrowing plan, application for loan, procedures\r\nfor getting preferential loan for each project or each business establishment\r\nparticipating in the project shall comply with specific guidelines of the bank\r\nfor social policies and other relevant regulations on credit extension.

EFFECT AND IMPLEMENTATION
Article 14. Responsibility for implementation
1. The Ministry of Health of Vietnam (the\r\nTraditional Medicine Administration of Vietnam) shall:
a) Take charge and cooperate with relevant agencies\r\nin disseminating and organizing the implementation of this Circular.
b) Perform responsibilities of the owner of the\r\nrare herbal material component project as prescribed in Article 37 of the\r\nDecree No. 27/2022/ND-CP.
c) Carry out supervision and assessment of the\r\nimplementation of rare herbal material projects eligible for support as\r\nprescribed in the Circular No. 01/2022/TT-UBDT dated May 26, 2022 of Minister,\r\nChairperson of the Committee for Ethnic Affairs.
d) Give support for rare herbal material projects\r\nin applying information technology to development of value-chain linkages of\r\nrare herbal materials and traditional pharmaceutical products which can be\r\ntraceable and have high quality; trade promotion in service of achieving\r\nsocio-economic development objectives of ethnic minority areas.
dd) Organize professional training and drilling\r\ncourses in herbal materials, and disseminate information on rare herbal\r\nmaterials as prescribed.
2. The National Institute of Medicinal Materials\r\nshall:

3. The leading entity of a linkage shall:
a) Organize the implementation of adequate terms\r\nand conditions of the linkage contract; ensure infrastructure facilities,\r\npersonnel and funding (including funding derived from state budget and\r\noff-budget funding) for implementing projects.
b) Manage funding for implementing projects and\r\nmake funding statements as prescribed; assume responsibility to manage and use\r\nfunding, supplies, assets and products of the project in accordance with\r\nprevailing regulations.
c) Organize bidding for purchase of supplies and\r\nequipment in accordance with regulations of the Law on Bidding and relevant\r\ndocuments.
d) Submit reports on project implementation on a\r\nperiodical basis of every 06 months or on ad hoc basis as requested by relevant\r\nauthorities, and take charge of conducting acceptance testing of project\r\nmodels.
dd) Expedite, inspect and assess the implementation\r\nof projects, and submit reports on project implementation on a periodical basis\r\nof every 06 months; take charge of conducting acceptance testing of\r\nproject models.
e) Send written reports to district- and provincial\r\nPeople's Committees on issues that may influence the implementation of\r\nprojects, which must also indicate proposed solutions.
g) Send written reports to the host entities of\r\nrare herbal material programs on consolidated project implementation results\r\nthrough managing bodies of projects (hard copies and PDF files without security\r\npassword).
h) Plan and organize development of project results\r\nin a large scale.

e) Manage financial issues, assets and products of\r\nprojects in accordance with prevailing regulations.

If any legislative documents referred to in this\r\nCircular are amended or replaced, the new ones shall apply.

I. Composition of the project appraisal council
The council is comprised of a chairperson who is a\r\nhead of the provincial People's Committee or a head of relevant\r\nprovincial-level department/agency as authorized and its members who are the\r\nhead of the People's Committee of district where the project is located,\r\nrepresentatives of authorities in charge of investment, finance, ethnic\r\nminority, agriculture, health, construction, natural resources and environment\r\naffairs, the lead of the provincial bank for social policies, and independent\r\nspecialists.
Employees/officials of the linkage’s leading\r\nentity, members of the linkage, the organization giving assistance in\r\napplication of technologies and a person acting as the project manager or\r\nparticipating in the project implementation are ineligible to join the council.\r\nAdministrative secretaries shall be appointed by the provincial People’s\r\nCommittee to prepare documents and hold meetings of the council.
II. Working methods
1. A council’s meeting will be held if it is\r\nattended by at least 2/3 of its members, including the council’s chairperson.
2. The council's members shall examine documents\r\nprovided by the managing body of the rare herbal material project, and provide\r\ntheir comments/assessment according to the forms enclosed herewith.
3. The council works on the basis of democratic\r\ncentralism. A conclusion of the council will be ratified when it has been\r\napproved by more than three-fourths of attending members through a referendum\r\nor ballot.
4. Where the council’s members give different\r\nopinions, they shall be consolidated by the council’s secretary for discussion\r\nand ratification by voting. Opinions given by a council’s member which are\r\ndifferent from the council’s conclusions may be recorded upon his/her request.\r\nThe council’s members shall assume personal responsibility for their opinions\r\nand assume collective responsibility for the council’s conclusions.
