DECISION

REGARDING THE ESTABLISHMENT OF NATIONAL CENTER FOR MONITORING AND WARNING OF MARINE ENVIRONMENT

MINISTER OF FISHERIES

Pursuant to Decree 43/2003/ND-CP of May 2nd 2003 of the Government regulating the mandates and organizational structure of the Ministry of Fisheries;
Pursuant to Decision 436TS/QD dated August 19th 1983 of the Minister of Fisheries regulating the mandates and organizational apparatus of the Research Institute for Marine Products;
Considering the proposal of the Director of RIMP in its submission letter 281/VHS-TTr dated April 24th 2004 relating to establishment of national center for monitoring and warning of marine environment;
Upon the proposal made by the Director of Personnel and Organization Department and Director of Science and Technology Department;

HAS DECIDED:

Article 1. The national center for monitoring and warming of marine environment shall be established on the basis of Division on marine environment research and Marine environment monitoring and analysis station (hereinafter referred to as “center”) which is under the RIMP. This center is an administrative scientific unit with its own stamp and account. The headquarter is located at 170 le Lai, Ngo Quyen district, Hai Phong city.

Article 2. The center shall have the mandate as follows:

A. Function

It shall carry out the study and research on marine environment, the relation between environment and resources, between environment and marine fishery development.

B. Duties

The center shall have the following duties:

1. It shall study and propose the parameters to monitor and warn the marine environment, fish disease, the options and solutions to contamination treatment and marine environmental protection.

2. It shall monitor and provide information on the quality norms and environmental status served the surveillance, control and protection of marine environment of the Institute and Ministry.

3. It shall formulate the program on the control, monitoring and warning network of the environment to timely serve the aquaculture, protection and sustainably development of the marine resources.

4. It shall coordinate with competent authorities and centers of fisheries sector in the protection of environment and development of marine resources.

5. It shall provide the data on marine environment of Vietnam. It shall collect and provide the data on environmental development as a basis for the fishing plan, marine aquaculture and establishment of marine protected areas.

6. It shall join and coordinate with local and external agencies and institutions in the fields of oceanographic study and marine environmental protection as assigned by the Institute and Ministry and as provided for by the law.

7. It shall provide training courses, guide and transfer the relevant technology related to environmental protection as required by the State management agencies at local and central level.

Article 3. Organization of the center

 The center shall be headed by one director, one or two vice directors and the supporting units including:

- General section (including the information, administrative, accounting, general divisions etc)

- Fishery oceanographic research division

- Aquatic resources study and warning division

- Marine environment research and warning division

- Some stations on environmental monitoring and warning

The director of the center shall be appointed by the Minister of Fisheries upon the request of Director of RIMP. The vice directors and accountants shall be appointed by the director of center upon the agreement of the Ministry. The center is allowed to employ the contracted persons in accordance with demand of the work.

The employment and salary fund of the center shall be from those of RIMP as allocated by Ministry of Fisheries annually.

The operational cost of the center shall be from the State budget, from collection of technical services within the mandate as assigned and as regulated by law.

The Director of RIMP shall, on basis of the current regulations, prepare the operational rules of the center to be presented to the Minister of Fisheries for approval.

Article 4. This Decision shall be come into force 15 days after being posted on Official Gazette.

The heads of Cabinet, RIMP, units, departments, inspection under the Ministry of Fisheries, Department of Fisheries, Department of Agriculture and Rural Development in charge of fisheries management, and the head of this center shall implement this Decision.
