ON THE ESTABLISHMENT OF THE VIET NAM ADMINISTRATION OF HIV/AIDS CONTROL UNDER THE MINISTRY OF HEALTH AND ON THE RENAMING OF THE PREVENTIVE MEDICINE AND HIV/AIDS CONTROL DEPARTMENT AS THE PREVENTIVE MEDICINE DEPARTMENT

THE PRIME MINISTER

Pursuant to the December 25, 2001 Law on the Organization of the Government
Pursuant to the 5 November, 2002 Government’s Decree No 86/2002/ND-CP on the functions, tasks, powers, and structures of Ministries and ministerial-level agencies;
Pursuant to the 15 May 2003 Government’s Decree No 49/2003/ND-CP on the functions, tasks, powers, and structures of the Ministry of Health;
Pursuant to the Prime Minister’s Decision No 36/2004/QD-TTG on 17 March 2004 on the approval of the National Strategy on HIV/AIDS Prevention and Control in Vietnam

till 2010 with a Vision to 2020
At the proposals of the Minister of Health and the Minister of Home Affairs

DECIDES

Article 1. To establish the Viet Nam Administration of HIV/AIDS Control under the

Ministry of Health following the separation of the functions, tasks, powers, and structures on HIV/AIDS prevention and control from the General Department of Preventive Medicine and HIV/AIDS Control.

To rename the Preventive Medicine and HIV/AIDS Control Department as the Preventive Medicine Department.

The Viet Nam Administration of HIV/AIDS Control has its own legal status, seal and bank account; is entitled to receive funding from the Government’s budget and other sources in compliance with Vietnamese legislation; is entitled to open an account at the State’s  Treasure; and has its office in Hanoi.

The official English name of the Viet Nam Administration of HIV/AIDS Control is VietNam Administration of HIV/AIDS Control (VAAC).

Article 2. The Viet Nam Administration of HIV/AIDS Control has the functions of assisting the Minister of Health in governance and in organizing activities on HIV/AIDS prevention and control nationwide.

Article 3. The Viet Nam Administration of HIV/AIDS Control has 01 Director and no more than 03 Deputy Directors; is entitled to have division-based structure, the number of divisions is no more than 07.

The Minister of Health decides the functions, tasks, powers, and structures of the General Department of Preventive Medicine and the Viet Nam Administration of HIV/AIDS Control.

Article 4. This Decision takes effect from the day of signature.

Article 5. Ministers, Heads of ministerial-level agencies, Heads of Government-attached agencies, and Presidents of provincial/municipal People’s Committees have the responsibility of implementing this Decision.
