ON SUPPLEMENTS AND AMENDMENTS OF MANDATES AND ORGANIZATIONAL STRUCTURE OF SOME RELEVANT DEPARTMENTS/UNITS UNDER MARD

THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT,

Based on the Government Decree No. 86/2003/ND-CP dated July 18th 2003 defining functions, tasks, authorities and organizational structure of the Ministry of Agriculture and Rural Development;
Based on Article 17 and Article 19 of the Decree 86/2002/ND-CP dated 5 November 2002 on issuance of the functions, tasks, authorities and organizational structure of the Ministries and ministerial-level agencies.
In consideration of the requests from Heads of relevant Departments/units, and at the proposal of the Director General of the Organization and Personel Department,

DECISES

Article 1.

Supplement and amend duties and functions of the following departments/units:

1. Planning and Projection Department

2. Science and Technology Department

One more task is supplemented, that is: assist the Minister to manage the application and development of IT in the agriculture and rural development sector (as prescribed in Article

2 of the Decision 83/2003/QD-BNN dated 4 September 2003 by MARD stipulating functions, duties, power and organizational structure of the Science and Technology Department)

3. International Cooperation Department

Provision 5, Article 2 of the Decision 84/2003/QD-BNN dated 4 September 2003 by MARD stipulating functions, duties, power and organizational structure of the International Cooperation Department is revised as belows:

“5. Take the lead to make planning and plan for, formulate policies and operation mechanisms on, monitor, evaluate and incoperate information on international integration, management of ODA, INGOs and FDI for the agriculture and rural development sector”

4. Cooperatives Department

Article 2 of the Decision 87/2003/QD-BNN dated 4 September 2003 by by MARD stipulating functions, duties, power and organizational structure of the Cooperatives Department;

a) Item c, provision 7: the phrase “involve in providing guidance on forestry extension, cultivation and husbandry” is changed into “state management of forestry extension, cultivation and husbandry”.

5. Plant Protection Department

Another duty is supplemented: take the lead in prevention and control over harmful insects (as stipulated in Item a, provision 5, Article 2 of the Decision 88/2003/QD-BNN dated 4 September 2003 by MARD stipulating functions, duties, power and organizational structure of the Plant Protection Department).

6. Animal Health Department

3 duties are supplemented in Article 2 of the the Decision 89/2003/QD-BNN dated 4

September 2003 by MARD stipulating functions, duties, power and organizational structure of the Animal Health Department:

a. Take responsibility for checking and inspecting the safety of animal food and animal-originated materials in order to produce animal food.

b. Reach a consensus on management of veterinary meditation to be used to add to animal food.

c. Forecast occurances and animal-originated diseases and epidemic diseases caused by pets and forest animals; to recommend competent agencies and guide people to take measures in prompt prevention and protection of diseases (Item a, Article 5).

The Article 2 of the Decision 90/2003/QD-BNN dated 4 September 2003 by MARD stipulating functions, duties, power and organizational structure of the Department of Agro-forest product processing and Salt Production is revised as follows:

a. Another duty is added: Control the quality of agricultural products during the conserving and processing stages; participate in national activities related to labour safety – sanitation – fire management.

b. Item g, provision 5: the phrase “participate in providing guidedance on salt production expansion, industry extension and handicraft development in rural areas under the Minister’s job assignment is changed into “state management of salt production expansion, industry extension, development of agricultural electrical engineering, preserving and processing of agro-forest products, rural occupations under the Minister’s job assignment”

c) Adjust the item h, clause 5: the phrase “ manage control and assessment of quality of material, equipment and technology within professional management of the department” should be changed into “ manage quality of material, equipment and technology within professional management of the department”.

8. The Forestry Department (FD)

It is suggested the phrase “ participate, direct forest extension” should be adjusted into “ carry out state management over forest extension work” as regulated at the item g, clause 5, article 2 of the decision no. 91/2003/Q§-BNN dated September 4th 2003 by the Minister of MARD on regulating tasks, functions, authority and organizational structure of the Forestry Department.

9. The Forestry Protection Department (FPD):

Take in account the additional task pertaining to professional management over forest protection work in case of National Parks attached to MARD as cited at article 8, clause 2 of the decision no. 92/2003/Q§-BNN dated September 4th 2003 by the Minister of MARD on regulating tasks, functions, authority and organizational structure of the Forestry Protection Department.

10. Irrigation and water management department

a) Regularly attend in check-up and delivery team pertaining to irrigation works and running process toward basic construction projects assigned by MARD.

b) Carry out state management over clean water and rural sanitation sector.

11. Department of dykes management and storm/flood control

As cited at the article 2 of the decision no. 94/2003/Q§-BNN dated September 4th 2003 by the Minister of MARD on regulating tasks, functions, authority and organizational structure of the Department of dykes management and storm/flood control, it is recommended to add more tasks as follows:

a) Regularly involve in check-up and delivery team pertaining to irrigation works and running process toward basic construction projects assigned by MARD.

b) Manage planning, surveying and preparation driven-projects relating to dykes and storm, flood control assigned by MARD

12. Department of work construction management

Adding the task: Cooperate other relevant departments who are assigned to manage basis construction projects and organize final check-up and delivery of constructed works (as cited at the phrase 2, 3 in item c, clause 5, article 2 of the decision no. 95/2003/Q§-BNN dated September 4th 2003 by the Minister of MARD on regulating tasks, functions, authority and organizational structure of the Department of work construction management).

13. MARD’s Office

1. Additional tasks:

a) Involve in social insurance procedures for administrative staff that receive payroll via the Office.

b) Manage ODA fund and corresponding fund of ODA projects implemented by MARD- departments

c) Chair elaboration of traditional profile of MARD

2. Modified clause 12:

“ 12. Fulfill the tasks of a representative office of MARD’s office in Ho Chi Minh city and other assignments from MARD”

14. National agriculture extension center

Add the task:consult producers about directions, policies, law, market, science and technology and typical trials relating to production, management and business within agriculture and rural occupation development sector (as cited at the decision no. 118/2003/QD-BNN dated November 3rd 2003 by the Minister of MARD on regulating functions, tasks, authority and organizational structure of the National Agriculture Extension Center).

4. National Agriculture Extension Center

b) Re-arrange the following sections:

- The section of agro-forestry extension is changed into section of agriculture and cultivation extension and forestry extension section.

- The section of information – training is separated into section of information – mobilization and section of training – education. MARD gives authority to leaders of the cited entities to assign clear regulations on concrete functions and tasks of the units, who are newly established or re-arranged as cited in this article.

Article 3.

Adjust the phrase “ develop working regulation, submit to the Minister for approval and organize implementation” (re-regulated the Article 3 in accordance with Decisions of MARD’s Minister on regulating functions, tasks, authority and organizational structure of entities that are named in Decree no. 86/2003/N§-CP dated July 18th 2003 of the Government on regulating functions, tasks, authority and organizational apparatus of MARD) into “ develop and organize implementation of working regulation”.

Article 4. This decision takes effect after 15 days since the publishing day on Official Gazette. MARD’s regulations, which are contrary to this decision, shall be abrogated.

Article 5. Chairmen of MARD’s Office, Organization and Personnel Department and directors of relevant MARD’s units shall be responsible for implementing this decision./.
