DECISION

ASSIGNMENT OF TASKS WITHIN MANAGEMENT BOARD OF STATE BANK OF VIETNAM

THE GOVERNOR OF THE STATE BANK OF VIETNAM

Pursuant to the Law on the State Bank of Vietnam No. 46/2010/QH12 dated June 16, 2010;

Pursuant to the Government’s Decree No. 123/2016/ND-CP dated September 01, 2016 defining the functions, tasks, powers and organizational structure of ministries and ministerial agencies, and the Government’s Decree No. 101/2020/ND-CP dated August 28, 2020 providing amendments to the Government’s Decree No. 123/2016/ND-CP;

Pursuant to the Government's Decree No. 16/2017/ND-CP dated February 17, 2017 defining functions, tasks, powers and organizational structure of the State Bank of Vietnam;

Pursuant to the Decision dated November 11, 2021 of the Prime Minister of Vietnam on appointment of Deputy Governor of the State Bank of Vietnam;

Article 1. The assignment of tasks within the Management Board of the State Bank of Vietnam (“SBV”) shall comply with the following rules:

1. Ensure the full performance of functions, tasks and powers of SBV in accordance with regulations of law in force.

2. Ensure the performance of tasks and powers of the SBV’s Governor and Deputy Governors within the scope of assigned responsibilities and tasks specified in the SBV's working regulations.

3. Apply the democratic centralism principle and ensure transparency, rationality and efficiency in performance of management tasks by the SBV’s Management Board.

4. Assign tasks according to the range and area of activities of which each official of the SBV’s Management Board is in charge, thereby ensuring the proactivity and fulfillment of their responsibility during performance of management tasks.

Article 2. Assignment of specific tasks:

1. Governor Nguyen Thi Hong

- Perform powers and responsibilities of the SBV's head, direct and manage all activities of the banking sector.

- Take charge of formulation of regulations and laws; strategies for development of banking sector; modernization of banks; organization, personnel and human resource development tasks; operational audits of SBV; activities of the banking media and communication office.

- Act as the Chairwoman of the Emulation and Reward Council of the Banking sector.

- Act as the Secretary of the Central Bank Party Committee.

- Directly direct and manage the following units: SBV Office, Organization and Personnel Department, Internal Audit Department, Communications Department, Banking Times and Banking Review .

2. Deputy Governor Dao Minh Tu

- Perform tasks of the Standing Deputy Governor who shall act on behalf of the SBV’s Governor to direct and manage activities of the SBV during her absence.

- Assist the SBV’s Governor in performing assigned tasks; take charge of credit activities; operations of the Central Bank; money issue and vault tasks; finance, accounting and infrastructural development tasks; administrative reform tasks; workplace modernization and administration; activities of international credit projects under SBV's management; trade union activities in banking sector.

- Take charge of inspection, supervision, licensing, formulation and promulgation of legislative documents governing Cooperative Bank of Vietnam, people’s credit funds and microfinance institutions; deposit insurance activities of Vietnam Association of People’s Credit Funds; technical assistance projects of international organizations and international cooperation activities in the fields of cooperative banks, people’s credit funds, microfinance and deposit insurance.

- Direct the formulation, approval and implementation of plans for dealing with financially weak people’s credit funds; continue directing the implementation of the Scheme for strengthening and development of people’s credit funds by 2020 with orientations by 2030.

- Direct the implementation of Government’s Resolutions on main tasks and solutions for improving business environment and enhancing national competitiveness; Resolutions on support and development of enterprises.

- Act as the administrative head of the Central Bank who shall assume responsibility before the SBV’s Governor for administrative tasks of SBV’s affiliated units.

- Act as the Chairman of Vietnam Banking Trade Union.

- Act as the Chairman of the Board for Advancement of Women in Banking Sector.

- Act as the SBV's spokesman.

- Directly direct and manage the following units: Credit Department of Economic Sectors; Finance and Accounting Department; Operations Center; Issue and Vault Department; Administration Department; Management Board of specialized investment projects in banking sector; Management Board of ODA international credit projects; National Banknote Printing Plant; SBV Banking Supervision Agency (in respect of tasks relating to inspection and supervision of Cooperative Bank of Vietnam, people’s credit funds and microfinance institutions); Deposit Insurance of Vietnam; Cooperative Bank of Vietnam.

3. Deputy Governor Nguyen Kim Anh

- Assist the SBV’s Governor in performing assigned tasks; take charge of restructuring and settlement of bad debts; operations of Vietnam Asset Management Company (VAMC); emulation and reward tasks; scientific research; training and operations of training institutions in banking sector; operations of associations in banking sector (except Vietnam Association of People’s Credit Funds); activities of Ho Chi Minh Communist Youth Union.

- Direct the formulation and implementation of “Restructuring of credit institutions associated with settlement of bad debts in 2021 – 2025 period” Scheme.

- Direct the implementation of the Strategy for development of banking sector by 2025 with orientations by 2030.

- Participate in the formulation, approval and implementation of the Plan for equitization of Vietnam Bank for Agriculture and Rural Development (Agribank).

- Direct the implementation of the National financial inclusion strategy.

- Act as the Chairman of Banking Science and Technology Council.

- Directly direct and manage the following units: Banking Strategy Institute; Emulation and Reward Department; Banking Training School; Banking Academy; Ho Chi Minh City University of Banking; SBV Banking Supervision Agency (in respect of tasks relating to the “Restructuring of credit institutions associated with settlement of bad debts in 2021 – 2025 period” Scheme); VAMC.

4. Deputy Governor Doan Thai Son

- Assist the SBV’s Governor in performing assigned tasks; take charge of legal affairs; banking inspection and supervision, administrative inspection, licensing management, mechanisms and policies for ensuring safety of banking operations, settlement of complaints and denunciations, anti-corruption, technical assistance projects of international organizations and international cooperation activities in the fields of banking inspection and supervision (except those in the fields of anti-money laundering, cooperative banks, people’s credit funds, microfinance and deposit insurance).

- Direct the formulation, approval and implementation of plans for settlement of financially weak banks.

- Participate in the direction of formulation and implementation of the “Restructuring of credit institutions associated with settlement of bad debts in 2021 – 2025 period” Scheme; the Law on State Bank of Vietnam of which the compilation he is assigned to take charge.

- Direct the formulation, approval and implementation of the Plan for equitization of Vietnam Bank for Agriculture and Rural Development (Agribank).

5. Deputy Governor Pham Tien Dung

- Assist the SBV’s Governor in performing assigned tasks; take charge of payment, information technology and digital transformation in banking sector; credit information activities; anti-money laundering; countering the financing of terrorism; technical assistance projects of international organizations and international cooperation activities in the field of anti-money laundering.

- Act as the Chairman of the Payment and Technology Council affiliated to the SBV.

- Act as the Head of the Management Board of the Interbank Electronic Payment System.

- Participate in direction of formulation and implementation of the Law on anti-money laundering.

- Directly direct and manage the following units: Payment Department; Information Technology Department; National Credit Information Center of Vietnam; SBV Banking Supervision Agency (in respect of tasks relating to anti-money laundering and countering the financing of terrorism).

- Direct operations of the National Payment Corporation of Vietnam (NAPAS).

- Directly direct operations of SBV - Ho Chi Minh City Branch, including:

a. Frequently monitor and grasp economic and financial developments and banking activities in Ho Chi Minh City; direct or request the Governor to direct the timely resolution of big problems and difficulties arising in Ho Chi Minh City in respect of monetary policies, credit, inspection, supervision and assurance of liquidity of credit institutions.

6. Deputy Governor Pham Thanh Ha

- Assist the SBV’s Governor in performing assigned tasks; take charge of monetary policies; monitoring developments of domestic and foreign money markets; foreign exchange management; international cooperation; finance and currency stabilization; forecasting, statistics; balance of international payments.

- Act as Vietnam’s Alternate Governor in international financial - monetary institutions, including: World bank (WB), International Monetary Fund (IMF), Asian Development Bank (ADB), Asian Infrastructure Investment Bank (AIIB), and Bank for International Settlements (BIS).

- Act as the Chairman of the Open Market Operations Executive Board.

- Act as the Chairman of the State Foreign Exchange Reserves Management Board.

- Directly direct and manage the following units: Monetary Policy Department, Foreign Exchange Management Department, International Cooperation Department, Forecasting and Statistics Department, Monetary and Financial Stabilization Department.

- Directly direct operations of SBV - Hanoi City Branch, including:

a. Frequently monitor and grasp economic and financial developments and banking activities in Hanoi City; direct or request the Governor to direct the timely resolution of big problems and difficulties arising in Hanoi City in respect of monetary policies, credit, inspection, supervision and assurance of liquidity of credit institutions.

b. Act as a representative of the SBV’s Management Board to cooperate with the People's Committee of Hanoi City in conducting periodical or ad hoc briefings to review and give guidelines for dealing with issues concerning monetary policies, credit and banking activities in Hanoi City.

Depending on actual tasks and activities, the SBV’s Governor shall assign Deputy Governors to perform certain tasks in addition to their assigned tasks; consider modifying the assignment of tasks between the Governor and Deputy Governors in order to ensure the fulfillment of all tasks and powers of the SBV.

Article 4. When the SBV’s Governor is absent from the SBV’s headquarters, Deputy Governor Dao Minh Tu shall act on behalf of the SBV’s Governor to direct all activities of SBV and perform some other tasks of the SBV's Governor.

Article 5. Any urgent issues within the scope of assigned tasks of a Deputy Governor arising during his absence or when he is going on a business trip shall be reported by the SBV Office to the SBV’s Governor or Deputy Governor Dao Minh Tu for consideration. The SBV Office shall submit report on performance of such tasks to the relevant Deputy Governor when he returns to work.

Article 6. This Decision comes into force from the day on which it is signed and replaces the Decision No. 1950/QD-NHNN dated November 18, 2020 of the SBV’s Governor.

Article 7. Officials of the SBV’s Management Board, heads of SBV’s affiliated units, Chairpersons of Boards of Directors (or Boards of Members) and General Directors (or Directors) of credit institutions are responsible for the implementation of this Decision./.
