CIRCULAR

PRESCRIBING DOCUMENT RETENTION PERIODS

Pursuant to Clause 4 Article 17 of the Law on Archives dated November 11, 2011;

Pursuant to the Government's Decree No. 01/2013/ND-CP dated January 03, 2013 providing guidelines for the implementation of the Law on Archives;

Pursuant to the Government’s Decree No. 63/2022/ND-CP dated September 12, 2022 defining Functions, Tasks, Powers and Organizational Structure of the Ministry of Home Affairs of Vietnam;

At the request of the Director of the State Record Management and Archives Department of Vietnam;

The Minister of Home Affairs of Vietnam promulgates a Circular prescribing document retention periods.

Article 1. Scope

2. The retention periods of specialized/operational documents shall comply with the provisions of Clause 2 Article 15 of the Government’s Decree No. 01/2013/ND-CP dated January 03, 2013.

Article 2. Regulated entities

Regulatory authorities, political organizations, socio-political organizations, political-social-professional organizations, social organizations, socio-professional organizations, economic organizations, administrative units, people's armed force units (hereinafter referred to as “regulatory authorities and organizations”).

Article 3. Document retention periods

1. Document retention period means the length of time running from the completion year of a task for which relevant documents and records need to be retained.

2. The retention periods of documents obtained during operation of regulatory authorities and organizations are provided for in Appendix I enclosed herewith.

3. The retention periods of documents obtained during the performance of specialized operations of People's Councils and People’s Committees are provided for in Appendix II enclosed herewith.

4. If any documents obtained during operation of regulatory authorities and organizations are yet to be specified in this Circular, their retention periods shall be determined according to the retention periods of corresponding documents.

2. The Circular No. 09/2011/TT-BNV dated June 03, 2011 of the Minister of Home Affairs of Vietnam is abrogated.

3. The Circular No. 13/2011/TT-BNV dated October 24, 2011 of the Minister of Home Affairs of Vietnam is abrogated.

Article 5. Implementation organization

1. Ministers, heads of ministerial agencies, heads of Governmental agencies, Chairpersons of People’s Committees at all levels, heads of relevant agencies and organizations, and relevant individuals are responsible for the implementation of this Circular.

2. Difficulties that arise during the implementation of this Circular should be reported to the Ministry of Home Affairs of Vietnam for guidance or consideration./.
