CIRCULAR
PROMULGATING NATIONAL TECHNICAL REGULATIONS ON PRODUCTS AND GOODS OF BUILDING MATERIALS
Pursuant to the Law on Standards and Technical Regulations dated June 29, 2006;
Pursuant to the Government's Decree No. 127/2007/ND-CP dated August 01, 2007 on elaboration of some Articles of the Law on Standards and Technical Regulations;
Pursuant to the Government's Decree No. 78/2018/ND-CP on amendments to the Government's Decree No. 127/2007/ND-CP dated August 01, 2007 on elaboration of some Articles of the Law on Standards and Technical Regulations;
Pursuant to the Government's Decree No. 52/2022/ND-CP dated August 08, 2022 defining the functions, tasks, powers and organizational structure of the Ministry of Construction;
At the request of the Director General of the Department of Science Technology and Environment;
The Minister of Construction hereby promulgates a Circular promulgating National technical regulations on products and goods of building materials.

Article 2.QCVN 16:2023/BXD comes into force from January 01, 2024.
Article 3.QCVN 16:2019/BXD National technical regulations on products and goods of building materials QCVN 16:2017/BXD promulgated together with the Circular No. 19/2019/TT-BXD dated December 31, 2019 of the Minister of Construction is superseded.
Article 4.Grandfather clauses
1. Where a manufacturer or importer of goods of building materials has been issued with a certificate of conformity in compliance with QCVN 16:2019/BXD and it remains effective, they may use the certificate of conformity and respective conformity mark until the expiry of the certificate.
2. Any body which has been designated to certify conformity and test products and goods of building materials in accordance with QCVN 16:2019/BXD may continue to certify conformity and test products and goods of building materials included in the designation decision and the list of products and goods of building materials under QCVN 16:2023/BXD under QCVN 16:2023/BXD until the expiry of the designation decision.
3. If the designation decision expires after this Regulation is promulgated but before it officially takes effect, an extension may be granted provided that it does not go beyond the effective date of this Circular./.

QCVN 16:2023/BXD is developed by the Vietnam Institute for Building Material, appraised by the Ministry of Science and Technology, submitted by the Department of Science Technology and Environment - Ministry of Construction for approval and promulgated together with the Circular No. ……../2023/TT-BXD dated ……, 2023 of the Minister of Construction.

1.1.2. This document shall not apply to products, goods of building materials imported in the form of samples for advertising purpose only that have no use value; samples serving research; samples for testing; temporarily imported goods for displaying at a trade fair or exhibition; goods which are temporarily imported for re-export, and not consumed and used in Vietnam; goods exchanged between residents of bordering areas, gifts or donations within the duty-free allowance; goods in transit, merchanting trade or transshipment; goods serving emergency demands according to the Government’s directives and goods serving national defense or security purposes.
1.2. Regulated entities
1.2.1. Manufacturers, importers, traders and users of products, goods of building materials.
1.2.2. Testing bodies and certification bodies that assess and grant certificates of conformity to products, goods of building materials.
1.2.3. Relevant regulatory bodies responsible for quality of products, goods of building materials.
1.3. Definitions
For the purposes of this Regulation, the terms below shall be construed as follows:
1.3.1. “regulatory inspecting authority for quality of products, goods of building materials” refers to an authority assigned or decentralized to perform state inspection of quality of products, goods of building materials under management of the Ministry of Construction (hereinafter referred to as “inspecting authority”). The local inspecting authority is the Department of Construction.
1.3.2. “category 2 products, goods of building materials” refers to the products or goods which are transported, stored, preserved and used reasonably and for their intended purposes but still potentially cause harm to humans, animals, plants, assets and environment.

1.3.4. “batch” combines one type of products or goods of building materials having similar specifications and produced at once through one production line.
1.3.5. “lot” combines one type of products or goods of building materials, in a defined quantity, which have similar label content, are produced or imported by one manufacturer or importer at one location and are distributed and sold on the market.
1.3.6. “representative sample of products or goods of building materials” refers to a sample representing a specific type of product or good manufactured in similar design, under similar condition regarding production line and technology and with similar type of material.
1.3.7. “representative sample of batch and lot” refers to the sample that is taken in a certain ratio and randomly from the same lot in a manner that the representative nature for entire lot is ensured, and used for conformity assessment and certification.
1.3.8. “circulation of goods” involves displaying, promoting, transporting or storing goods in the process of goods sale and purchase, except the transport of goods by importers from a checkpoint to a storehouse.
1.4. General
1.4.1. Products, goods of building materials must be transported, stored and used in a manner that does not represent any safety hazard. Upon circulated on the market, domestically manufactured products and goods must have the certificate of conformity and notification of receipt of application for declaration of conformity declaration issued by the local inspecting authority; imports must have the certificate of conformity.
1.4.2. Manufacturers, importers, traders and users of products must accurately declare types of products, goods of building materials in accordance with product list in Table 1 Part 2 of this Regulation. Otherwise, it is required to cooperate with a conformity certification body or testing body to identify the products.
1.4.3. Domestically manufactured and imported products and goods of building materials specified in Table 1 Part 2 of this Regulation shall be subject to management measures according to the certification result given by the certification body registered or recognized as prescribed by law.

PART 3. REGULATORY REQUIREMENTS
3.1. Conformity certification
3.1.1.Conformity of products and goods of building materials in Table 1 Part 2 of this Regulation shall be certified using the assessment methods mentioned in 3.1.2.
3.1.2.Conformity assessment methods are set out in the Circular No. 28/2012/TT-BKHCN dated December 12, 2012 of the Minister of Science and Technology on declaration of standard conformity and technical-regulation conformity and methods for conformity assessment (hereinafter referred to as “the Circular No. 28/2012/TT-BKHCN”) and the Circular No. 02/2017/TT-BKHCN dated March 31, 2017 of the Minister of Science and Technology on amendments to some Articles of the Circular No. 28/2012/TT-BKHCN (hereinafter referred to as “the Circular No. 02/2017/TT-BKHCN”). To be specific:
- Method 1: Representative sample testing
The certificate of conformity shall be valid for no more than 01 year. It shall be only valid for the types of product and goods whose samples are taken for tests.
This method shall apply to imported products and goods of building materials when:
+ The foreign manufacturer has been issued with the certificate of quality management quality in conformity with ISO 9001 which covers the manufacturing of products of building materials and that certificate remains effective.
+ The supervision is carried out by testing samples upon each import.

The certificate of conformity shall be valid for no more than 03 years and annual supervision shall be carried out testing samples at the manufacturing location or on the market in association with assessment of the manufacturing process.
This method shall apply to the products manufactured by domestic or foreign manufacturers which have established and maintained a quality management system in order to stably maintain quality of products and goods.
- Method 7: Testing and assessing batches and lots.
The certificate of conformity shall be only valid for shipments of manufactured and imported products and goods of building materials.
3.2. Conformity declaration
3.2.1.Conformity of domestically manufactured and imported products and goods of building materials shall be declared at the inspecting authority of the local area where business is registered according to the certification result given by the certification body registered or recognized as prescribed by law;
3.2.2.Applications and procedures for conformity declaration are specified in Articles 14 and 15 of the Circular No. 28/2012/TT-BKHCN amended by the Circular No. 02/2017/TT-BKHCN and Circular No. 06/2020/TT-BKHCN (the newest version shall prevail when replaced or amended)
3.3. Regulations applicable to imported products and goods of building materials
3.3.1.Regarding imported goods of building materials specified in Part 2 of this Regulation, the importer shall:

b) When applying for state inspection, it is required to specify names of the conformity certification body and testing body carrying out testing and assessment of quality of imported goods in the Application form according to the Form No. 01 of the Government's Decree No. 74/2018/ND-CP dated May 15, 2018 amended by clause 9 Article 4 of the Government's Decree No. 154/2018/ND-CP dated November 9, 2018. The inspecting authority shall confirm in the application form that the importer has applied for inspection of quality of imported goods.
c) The importer shall submit the application form having the inspecting authority’s confirmation to the customs authority to be granted customs clearance;
d) Within 15 working days (35 working days for cement, cement, concrete and mortar admixtures) from the date of customs clearance, the importer shall submit a copy of the original application form (bearing the importer’s name and seal), certificate of conformity and result of inspection of goods quality (carried out by the conformity certification body and testing body specified in the application form previously submitted to the inspecting authority) in conformity with Table 1 of this Regulation to the inspecting authority.
dd) If the goods have been assessed by the certification body in the exporting country, within 03 working days from the date of customs clearance, the importer shall submit a copy of the original application form (bearing the importer’s name and seal) and certificate of conformity to the inspecting authority.
e) If the importer applies for quality inspection through the National Single Window Portal, apply for quality inspection and return inspection result through the National Single Window Portal.
g) The importer shall be totally responsible to the law for the quality of goods they import.
3.3.2.Reduction or exemption of inspection of quality of imported goods of building materials shall be applied according to clause 3 Article 1 of the Government's Decree No. 74/2018/ND-CP and clause 3 Article 4 of the Government’s Decree No. 154/2018/ND-CP dated November 09, 2018 amending, supplementing and repealing certain regulations on investment and business conditions in sectors under the management of the Ministry of Science and Technology and certain regulations on specialized inspections.
Any importer that has the need for reduction or exemption of inspection shall prepare an application as prescribed in clause 3 Article 4 of the Decree No. 154/2018/ND-CP and submit it to the local inspection authority for consideration and confirmation.
Throughout the duration of such reduction or exemption, the importer shall comply with the regulations enshrined in Article 7 of the Circular No. 06/2020/TT-BKHCN dated December 10, 2020.

3.5. Sampling methods, specifications and quantity of samples for testing and assessment
3.5.1.Methods for collecting representative samples shall comply with the provisions set out in prevailing national technical regulations on sampling methods and preparation of test samples applicable to corresponding products.
3.5.2.Specifications and quantity of representative samples of each lot of products or goods shall comply with the regulations set out in Table 1 Part 2 corresponding to each type of product.
3.5.3.Where goods of building materials imported in small quantity resulting in not being adequate for collecting samples as per regulations or the testing costs determined via 03 quotations of the testing body are greater than value of imported shipments; the importer has the need to prove that goods are not used, circulated and put into any construction work, Article 1.1.2 of this Regulation shall be complied.
For imported goods of building materials failing to meet the specifications specified in Part 2, the importer shall cooperate with the certification body in working with the manufacturer and exporter in the foreign country to send samples representing the shipment of imported goods to service the quality certification as prescribed; the quantity of samples shall be sufficient for testing and sample storage.
3.6. Packaging, labeling, transport and preservation
Products and goods of building materials shall be labelled as prescribed in the Government's Decree No. 43/2017/ND-CP dated April 14, 2017 on goods labels and Government's Decree No. 111/2021/ND-CP dated December 09, 2021 on amendments to some Articles of the Government's Decree No. 43/2017/ND-CP dated April 14, 2017 on goods labels and Circular No. 18/2022/TT-BKHCN of the Ministry of Science and Technology elaborating to mandatory information of labels of several goods categories to be displayed on electronic media.
Regulations on packaging (for products bagged, packaged or boxed), transport and preservation specified in the standard applied to such products shall be complied with.

4.2. The Ministry of Construction shall consider recognizing certification bodies and testing bodies in foreign countries that certify and test products and goods of building materials in Table 1 as prescribed by law when the mutual recognition agreement is signed.
PART 5. RESPONSIBILITIES OF RELEVANT ORGANIZATIONS AND INDIVIDUALS INVOLVED IN CONFORMITY CERTIFICATION AND DECLARATION
5.1. Specialized agency of the Ministry of Construction has the responsibility to:
5.1.1.Provide guidelines for conformity certification.
5.1.2.Organize the formulation, review and amendment of National technical regulation on products, goods of building materials.
5.1.3.Inspect, supervise and review activities of registered and recognized certification bodies and testing bodies; propose the issuance, invalidation and revocation of the certificate of registration of certification bodies and testing bodies according to the Decree No. 107/2016/ND-CP and publish such on the website of the Ministry of Construction;
5.1.4.Supervise, review and inspect (on a periodic or ad hoc basis) the declaration of conformity and certification of reduction or exemption of quality inspection of products and goods of building materials by local inspecting authorities.
5.2. Local inspecting authorities have the responsibility to:
5.2.1.Receive applications for conformity declaration of organizations and individuals for products and goods of building materials; receive and processing applications for state inspection of imported goods.

5.2.3.Manage and inspect certification and declaration of conformity of products and goods of building materials in the locality. Cooperate with local inspecting authorities at border checkpoints to inspect the registration of state inspection of quality and conformity with quality requirements for imports.
5.2.4.Submit a consolidated report on certification and declaration of conformity, results of state inspection of imports, and reduction and exemption of goods inspection to the Ministry of Construction before December 25 every year or at the request of the Ministry of Construction.
5.3. Conformity certification bodies and testing bodies have the responsibility to:
5.2.4.Before December 20 or upon request, submit a written report on results of conformity certification and testing activities to the local inspecting authority and Ministry of Construction.
5.3.2.If the registered competence in conformity certification or testing is changed, the change shall be notified to the Ministry of Construction within 15 days from the date of change.
