DECISION
APPROVING INVESTMENT PROJECT FOR PHASE 1 CONSTRUCTION OF LONG THANH INTERNATIONAL AIRPORT
PRIME MINISTER
Pursuant to Law on Governmental Organization dated June 19, 2015; Law on amendments to Law on Government Organization and Law on Local Governmental Organization dated November 22, 2019;
Pursuant to Law on Public Investment dated June 13, 2019;
Pursuant to Law on Investment dated November 26, 2014;
Pursuant to Law on Construction dated June 18, 2014;
Pursuant to Law on Vietnam Civil Aviation dated June 29, 2006 and Law on amendment to Law on Vietnam Civil Aviation dated November 21, 2014;
Pursuant to Law on Environmental Protection dated June 23, 2014;
Pursuant to Law on Land dated November 29, 2013;
Pursuant to Resolution No. 94/2015/QH13 dated June 25, 2015 on Investment Guidelines of Long Thanh International Airport Project; Resolution No. 38/2017/QH14 dated June 19, 2017 on separating land appropriation, compensation, financing, and relocation affairs within Long Thanh International Airport Project into component projects; Resolution No. 53/2017/QH14 dated November 24, 2017 on Feasibility Report for Project of land appropriation, compensation, financing, and relocation affairs within Long Thanh International Airport Project; Resolution No. 95/2019/QH14 dated November 26, 2019 on Feasibility Report for Phase 1 Investment Project for Construction of Long Thanh International Airport;
Pursuant to Decree No. 102/2015/ND-CP dated October 20, 2015 on management and utilization of airports and aerodromes; Decree No. 131/2015/ND-CP dated December 25, 2015 guiding nationally important projects; Decree No. 59/2015/ND-CP dated June 18, 2015 on management of construction projects, and Decree No. 42/2017/ND-CP dated April 5, 2017 on amendment to Decree No. 59/2015/ND-CP; Decree No. 138/2016/ND-CP dated October 1, 2016 on Operating regulations of the Government; Decree No. 68/2019/ND-CP dated August 14, 2019 on management of construction investment;
Pursuant to Resolution No. 07/NQ-CP dated February 3, 2020 on Feasibility Report for Phase 1 Investment Project for Construction of Long Thanh International Airport;
Pursuant to Decision No. 909/QD-TTg dated June 14, 2021 of the Prime Minister approving Planning of Long Thanh International Airport; Decision No. 236/QD-TTg dated February 23, 2018 of Prime Minister approving amendment to Development Planning for Aviation Transport until 2020, orientation to 2030; Decision No. 1487/QD-TTg dated November 6, 2018 of Prime Minister approving Feasibility Report of Project for land appropriation, compensation, financing, and relocation affairs for Long Thanh International Airport;
Pursuant to Presentation No. 6525/TTr-BGTVT dated July 12, 2019 of Ministry of Transport on Feasibility Report for Phase 1 Investment Project for Construction of Long Thanh International Airport and relevant documents;
Pursuant to remarks of Government Appraisal Council under Report No. 6359/BC-HDTDNN dated September 25, 2020 on appraisal results of Feasibility Report of Phase 1 Investment Project for Construction of Long Thanh International Airport and propositions of Ministry of Planning and Investment under Official Dispatch No. 7066/BKHDT-GSTDDT dated October 26, 2020 on clarifying appraisal contents under Feasibility Report Phase 1 Investment Project for Construction of Long Thanh International Airport.
HEREBY DECIDES:
Article 1. Approve Investment Project for Phase 1 Construction of Long Thanh International Airport as follows:
1. Project name: Investment Project for Phase 1 Construction of Long Thanh International Airport.
2. Component projects: Phase 1 Investment Project for Construction of Long Thanh International Airport is separated into 4 components projects: (1) Component Project 1 – Head offices of regulatory agencies; (2) Component Project 2 – Structures serving flight management; (3) Component project 3 – Essential structures of an airport; (4) Component Project 4 – Other Structures.
3. Project developer:
Component Project 1 – Head offices of regulatory agencies: Assign relevant regulatory agencies (customs authority, police authority, border police authority, port authority, medical (animal/plant) quarantine authority) to allocate funding sources to guarantee progress. In case authorities are incapable of allocating funding sources, regulatory agencies shall select investors in form of public-private partnership (Build – Transfer – Lease (BTL) Contract or Build – Lease – Transfer (BLT) Contract);
Component Project 2 – Structures serving flight management: Vietnam Air Traffic Management Corporation (VATM) shall act as project developer;
Component Project 3 – Essential structures of an airport implemented by project developer who operate the airport: Airports Corporation of Vietnam (ACV) shall act as project developer;
Component Project 4 – Other structures: Ministry of Transport shall take charge organizing and selecting investors
4. Investment and construction goal:
Construct Long Thanh International Airport satisfactory to class 4F according to classification of the International Civil Aviation Organization (ICAO) and be a nationally important International Airport in order to become one of international aviation transport centers of the region.
Invest in phase 1 construction of Long Thanh International Airport with 1 runway; 1 passenger terminal with auxiliary work items suitable for 25 million passengers/year; 1.2 million tonne of commodities/year.
5. Detail and scope of investment for phase 1 construction:
Air operation area infrastructure: Construct runway with 4,000 m in length and 75 m in width (Bm= 45 m, blề= 2x15 m) and systems of taxiway, aircraft stand to allow aircrafts to operate and serve 25 million passengers/year and 1.2 million tonne of commodities/year.
Passenger terminal: Construct a passenger terminal with design capacity of 25 million passengers/year with total floor area of 373,000 m2.
Structures serving flight management: Construct Air traffic control tower with 123 m in height and auxiliary work items.
Work items: Construct parking spaces; commodity stations with a total of 1.2 million tonne of commodities/year; airline meal supply areas; facilities for equipment maintenance, aircraft sanitation, refueling stations, wastewater drainage and processing stations, etc.
Structures of regulatory agencies and entities operating within the Airport: customs authority; border police authority; local police authority; medical (animal/plant) quarantine authority; airport authority; port management and operation entities; flight control entities; airlines; aviation service providers, etc.
Traffic connecting directly with the Airport: Route No. 1 connecting the Airport with National Highway No. 51 with 6 traffic lanes, route No. 2 connecting the Airport with Ho Chi Minh City – Long Thanh Expressway with 4 traffic lanes and junctions.
6. Organizations consulting for production of Feasibility Report:
Japan – France – Vietnam Joint Venture (JFV JV) consists of: Japan Airport Consultants, Inc. (JAC), ADP Ingeniere (ADPi), Nippon Koei Co., Ltd (NK), Oriental Consultants Global., Ltd (OCG), Airport Design and Construction Consultancy (ADCC), Transport Engineering Design Inc. (TEDI).
7. Individual in charge of producing Feasibility Report: Mr. Ryohei Yamada.
8. Organizations consulting for appraisal:
Consultant and Inspection Joint Stock Company of Construction Technology and Equipment (Coninco); Netherlands Airport Consultants (NACO); ARUP International Limited (ARUP); Airport Engineering Consultancy and Services Joint Stock Company (AEC).
9. Construction location: Long Thanh District, Dong Nai Province.
10. Land use area:
Land use demand in phase 1: Land use area and demand in phase 1 is estimated to be approximately 2,668 ha consisting of: 1,810 ha for construction of Phase 1 Long Thanh International Airport; approximately 136 ha for traffic systems connecting route No. 1 and route No. 2 (beyond 5,000 ha); 772 ha of land left from phase 1 construction for subsequent phases (within 5,000 ha).
11. Construction method: Construct work items of Phase 1 Long Thanh International Airport consistently to guarantee technical, aesthetics, and quality according to international technical regulations and relevant technical standards, ensure objectives, scale, capacity, economic-technical quotas, investment effectiveness, not exceed total investment approved and direction of the National Assembly, the Government, and Prime Minister.
12. Technology equipment:
Apply modern technology and remain open to update advance technology with ease in investment, construction, management, and operation of the Airport according to international standards and similar to other advance international airports around the world, ensure effective, Accurate, and high credibility with all proper back up functionality and energy efficiency.
13. Compensation, land clearance, and relocation solutions:
Comply with solutions approved by Prime Minister under Decision No. 1487/QD-TTg dated November 6, 2018 regarding Feasibility Report of land appropriation, compensation, financing, and relocation affairs of Long Thanh International Airport and assign People’s Committee of Dong Nai Province to take charge and cooperate with ACV and relevant agencies in performing compensation, land clearance and relocate 2 traffic routes as per applicable law.
14. Total investment:
Total investment is VND 109,111.742 billion, equivalent to USD 4,664.89 million (exchange rate of USD 1 = VND 23,390 as publicized in Vietcombank dated May 25, 2020). (Details are under attached Annex).
15. Funding sources:
- Component project 1: Utilize state budget of presiding agencies of structures or mobilize investment in form of public-private partnerships (BTL or BLT) in case presiding agencies of structure are incapable of allocating capital.
- Component projects (2), (3), and (4): Utilize capital of investors; do not utilize Governmental security.
16. Form of investment:
- Component project 1: Public investment or PPP (BLT or BTL) investment in case presiding agencies of structures are incapable of allocating capital.
- Component projects (2), (3), and (4): Direct investment as per the law.
17. Project management method:
Project developers shall organize project management according to applicable laws, satisfactory to project quality and progress.
18. project implementation period: 2020 - 2025.
19. Other contents:
a) Selected technical standards and regulations: Apply advance international and national standards satisfactory to nature and scale of structures. Comply with regulations and law on construction and relevant law provisions to guarantee structure quality and project objectives, investment scope.
b) On land transfer mechanisms: Assign People’s Committee of Dong Nai Province to take charge and cooperate with Ministry of Transport, ACV and relevant agencies in implementing according to applicable laws and guaranteeing Project progress.
c) Personnel requirements: Train highly-skilled personnel to manage and operate phase 1 Long Thanh International Airport, prioritize development of young personnel in local areas. Project developers shall cooperate with aviation authority in training personnel for subsequent investment and operation affairs.
d) Environmental protection measures and fire prevention measures: Comply with applicable regulations and law satisfactory to international standards.
Article 2. Implementation
1. Implementation of component projects:
Once the Prime Minister approves general Project investment, project developers shall implement subsequent steps in implementing decisions on investment to component projects as per the law, and guarantee implementation quality, progress and effectiveness.
Assign presiding entities of regulatory agencies to decide on investment for component project (1), assign VATM to decide on investment for component project (2), assign ACV to decide on investment for component project (3), assign project developers selected by Ministry of Transport to decide on investment for component project (4) and assume responsibilities as per applicable law.
2. Responsibilities of project developers of component projects:
- Receiving remarks of Governmental Appraisal Council under Report on project appraisal results during implementation.
- Fully complying with construction investment regulations and procedures, regulations on technical standards, regulations, and economic-technical norms. Closely managing Project investment, guaranteeing efficiency, effectiveness, compliance with regulations and law, and adherence to total approved Project investment in use of investment capital.
- Assuming total responsibilities to the National Assembly, the Government, Prime Minister, and inspecting, accounting agencies as per the law, ensuring compliance with regulations and law of the Project, and avoiding negativity, loss, corruption, and waste. Organizing Project execution according to Resolutions of the National Assembly and directions of Prime Minister.
- Supervising and assessing Project investment as per the law.
- Developing personnel training and development solutions to effectively operating and utilizing the Project.
- Implementing obligations and responsibilities in environmental protection and fire prevention affairs as per applicable laws.
3. Responsibilities of Ministry of Transport:
- Assuming responsibilities with ACV regarding quality and accuracy of Feasibility Report of the Project, requesting appraisal according to regulations and directions of Prime Minister.
- Directing project developers of component projects to produce fundamental design of work items that lack fundamental design, finalize Feasibility Report, approve component projects, and organize implementation according to regulations and law.
- Assuming responsibilities with Commission for the Management of State Capital at Enterprises regarding propositions made to the Governmental Appraisal Council regarding assigning ACV, VATM to act as project developers and implement the Project using funding sources of the enterprises; selecting project developers for other work items, guaranteeing consistency, quality, and progress of the Project according to direction of National Assembly, Government, and regulations and law. Exercising rights and responsibilities of representative bodies when VATM invest in construction of work items of the Project.
- Cooperating with relevant regulatory agencies in selecting investors or assigning ACV to execute component project (1) in form of PPP according to regulations and law and Resolution No. 95/2019/QH14 of National Assembly.
- Cooperating and guiding ACV in reviewing, completing Project documents and implementing subsequent steps, and ensuring conditions for implementing the Project and effectiveness of Project investment.
- Organizing implementation of specialized state management functions of the Project during investment, operation, and use of Long Thanh International Airport as per the law.
- Taking charge and cooperating with Ministry of National Defense in directing identification of border of areas for civil activities and areas for both civil and military activities as per the law.
- Conducting research, developing tasks, and proposing establishment of Interdisciplinary group of Long Thanh International Airport to assist the Government in performing state management functions during Project implementation to ensure adherence to technical details, aesthetics, progress, effectiveness of Project investment.
4. Responsibilities of Ministry of Natural Resources and Environment:
- Assisting and guiding People’s Committee of Dong Nai Province, Ministry of National Defense, Ministry of Transport, and relevant agencies to transfer land, lease land, and permit land repurposing for Project execution according to land use planning approved by competent authority as per land law.
- Assisting and guiding ACV in adopting procedures for assessing environmental impact of the Project according to regulations and law on environmental protection; complying with regulations and law on protecting water resources as per water resource laws during Project execution.
5. Responsibilities of Ministry of National Defense:
- Cooperating with Ministry of Transport, People’s Committee of Dong Nai Province, ACV, and relevant agencies in adopting procedures for transferring land for Project execution as per the law.
- Taking charge and cooperating with Ministry of Public Security, Ministry of Transport, and ACV in guaranteeing flight safety and aviation security as per aviation laws.
6. Responsibilities of Ministry of Public Security: Performing state management functions, cooperating with Ministry of National Defense, ACV, and relevant agencies in guaranteeing security and safety in aviation activities as per the law.
7. Responsibilities of Ministry of Construction:
Performing state management functions, cooperating with Ministry of Transport and Commission for the Management of State Capital at Enterprises in guiding, assisting ACV and relevant project developers in subsequent Project execution as per construction laws.
8. Responsibilities of People’s Committee of Dong Nai Province:
- Performing compensation and land clearance regarding area for construction of 2 traffic routes (approximately 136 ha) according to regulations and law in order to guarantee implementation progress of work items at request of project developers.
- Taking charge, cooperating with Ministry of Transport, Ministry of National Defense, Ministry of Natural Resources and Environment, and relevant agencies in transferring land for Project execution as per land laws and applicable laws depending on Project progress, and guaranteeing land use effectiveness once land clearance has been implemented in order to avoid waste of natural resources during Project execution.
- Cooperating with Ministry of Natural Resources and Environment in directing ACV and relevant agencies in adopting procedures for assessing environmental impact of the Project as per environmental protection laws. Guaranteeing compliance with regulations and law on environmental protection during Project execution.
- Cooperating with Ministry of Finance, directing relevant entities, and guiding ACV to exercise tax preferential treatment and relevant policies as per applicable laws; cooperating in promptly dealing with difficulties in Project execution.
- Developing consistent planning measures, cooperating with Ministry of Transport, People’s Committees of Ho Chi Minh City and relevant administrative divisions in organizing investment in traffic structures connecting Ho Chi Minh City and Long Thanh International Airport.
- Cooperating with ACV in researching fuel pipeline planning from headwater port to border of Long Thanh International Airport.
9. Responsibilities of People’s Committee of Ho Chi Minh City:
- Developing consistent planning measures, cooperating with Ministry of Transport, People’s Committees of Dong Nai Province and relevant administrative divisions in organizing investment in traffic structures connecting Ho Chi Minh City and Long Thanh International Airport.
- Conducting research, developing public transport methods connecting Ho Chi Minh City (especially city center, Tan Son Nhat International Airport) with Long Thanh International Airport to serve travel demand as soon as Long Thanh International Airport is in operation.
10. Responsibilities of Commission for the Management of State Capital at Enterprises:
Requesting representative of state capital in ACV to:
- Organize implementation and investment of Component Project (3) and relevant contents as per the law, manage Project, and ensure Project progress and effectiveness of state capital in enterprises; thoroughly control business plans and investment plans from time to time to develop financial measures for Project execution, guarantee investment effectiveness, state capital use, preservation and development, and manage operation of Long Thanh International Airport as per the law.
- Supervise and assess Project investment as per the law, and submit reports on any violation (if any).
11. Responsibilities of ACV:
- Completing, appraising, approving, and organizing implementation of component projects according to regulations and law, ensuring investment effectiveness, and adhering to total investment of Component projects.
- Allocating funding sources for investment in essential structures in Long Thanh International Airport with adequate quality, progress, capital preservation and investment effectiveness.
- Assuming responsibilities for report information and figures in Project documents, Project investment effectiveness, state capital use, preservation, and development as per the law.
- Receiving remarks of Appraisal Council and remarks of relevant agencies under Appraisal reports. Organizing Project implementation and management as per applicable laws.
- Allocating expenditure for People’s Committee of Dong Nai Province for land clearance for traffic routes.
- Cooperating with Ministry of Public Security, and Ministry of National Defense in ensuring aviation security in airports and aerodromes; ensuring economic development, national defense, and effective operation of Long Thanh International Airport.
12. Responsibilities of VATM:
- Completing, appraising, approving, and organizing implementation of Component project (2) according to regulations and law, ensuring investment effectiveness, and adhering to total investment of Component projects.
- Allocating funding sources for investing in structures serving flight management with proper quality, progress, capital preservation and investment effectiveness.
- Cooperating with Ministry of National Defense and relevant agencies in organizing implementation of flight safety assurance measures, organizing airspace and operation measures during Project operation.
Article 3. This Decision comes into effect from the date of signing.
Article 4. Minister of Planning and Investment, Minister of Finance, Minister of Construction, Minister of Natural Resources and Environment, Minister of Transport, Minister of National Defense, Minister of Public Security; Chairperson of Commission for the Management of State Capital at Enterprises; Chairperson of People’s Committee of Dong Nai Province; Chairperson of Board of Directors, General Director of ACV; Chairperson of Board of Members, General Director of VATM, and heads of relevant agencies are responsible for implementation hereof. /.

- Component project (1) – Head offices of regulatory agencies, including: Customs authority, border police authority; local police authority; medical (plant/animal) quarantine authority; airport authority.
- Component project (2) – Structures serving flight management, including: Air traffic control tower and auxiliary works; communication, navigation, supervision, and meteorology structures; flight management offices.
- Component project (3) – Essential structures of airport implemented by investors that operate the airport, including: general infrastructure (mine sweeping, premise leveling and preparation, construction of barrier and traffic connecting route 1, route 2, junctions; automobile road and parking spaces, bridges, tunnels, power supply, water supply and drainage, lighting, telecommunication, etc.); structures in flight area (runway, taxiway, air traffic lights ILS/DME equipment, etc.); aircraft apron; aircraft fuel supply; passenger terminal; cargo hold number 1, vehicle parking spaces, administration building and other auxiliary structures.
- Component project (4) – Other structures, including:
+ 4a work items: Cargo hold number 2; cargo hold for premium delivery; cargo delivery storage number 1; aircraft sanitation area number 1; land service vehicle maintenance area number 1; airline meal supply area number 1; solar power system.
+ 4b work items (not included in total investment): Fuel pipeline systems from headwaters port to border of Long Thanh International Airport; aircraft sanitation area number 2; land service vehicle maintenance area number 2; cargo delivery storage number 2 through 8; airline meal supply area number 2; airline coordination center; hangar; aviation industrial parks; aviation logistics area.
