Căn cứ Pháp lệnh phí và lệ phí;
Căn cứ Luật Đất đai 2003 và các Nghị định của Chính phủ quy định chi tiết Luật Đất đai năm 2003;
Căn cứ Luật Quản lý thuế và các Nghị định của Chính phủ quy định chi tiết thi hành Luật Quản lý thuế;
Căn cứ Nghị định số 45/2011/NĐ-CP ngày 17/06/2011 của Chính phủ về lệ phí trước bạ;
Căn cứ Nghị định số 118/2008/NĐ-CP ngày 27/11/2008 của Chính phủ quy định chức năng, nhiệm vụ, quyền hạn và cơ cấu tổ chức của Bộ Tài chính; Bộ Tài chính hướng dẫn thực hiện về lệ phí trước bạ như sau:
Điều 1. Đối tượng chịu lệ phí trước bạ
1. Nhà, đất:
a) Nhà, gồm: nhà ở; nhà làm việc; nhà sử dụng cho các mục đích khác.
b) Đất, gồm: các loại đất nông nghiệp và đất phi nông nghiệp quy định tại Khoản 1, 2 Điều 13 Luật Đất đai năm 2003 thuộc quyền quản lý sử dụng của tổ chức, hộ gia đình, cá nhân (không phân biệt đất đã xây dựng công trình hay chưa xây dựng công trình).
3. Tàu thuỷ, kể cả sà lan, ca nô, tàu kéo, tàu đẩy.
4. Thuyền , kể cả du thuyền.
5. Tàu bay.
6. Xe mô tô hai bánh, xe mô tô ba bánh, xe gắn máy (kể cả xe máy điện), các loại xe tương tự phải đăng ký và gắn biển số do cơ quan nhà nước có thẩm quyền cấp (sau đây gọi chung là xe máy).
Trường hợp các loại máy, thiết bị thuộc diện phải đăng ký và gắn biển số do cơ quan nhà nước có thẩm quyền cấp nhưng không phải là ô tô theo quy định tại Luật Giao thông đường bộ và các văn bản hướng dẫn thi hành thì không phải chịu lệ phí trước bạ.
8. Vỏ, tổng thành khung (gọi chung là khung), tổng thành máy phải chịu lệ phí trước bạ nêu tại khoản 3, 4, 5, 6 và 7 Điều này là các khung, tổng thành máy thay thế có số khung, số máy khác với số khung, số máy đã được cơ quan nhà nước có thẩm quyền cấp giấy chứng nhận sở hữu, sử dụng.
Trường hợp cải tạo, sửa chữa khung, máy, thay thân máy (blok-lốc), hoặc sửa chữa, cải tạo, chuyển mục đích sử dụng phải đăng ký kiểm tra chất lượng an toàn kỹ thuật với cơ quan nhà nước có thẩm quyền nhưng không thay đổi số khung, số máy và không thay đổi chủ sở hữu sử dụng thì không phải chịu lệ phí trước bạ.
Điều 2. Người nộp lệ phí trước bạ
Tổ chức, cá nhân (bao gồm cả tổ chức, cá nhân người nước ngoài) có các tài sản thuộc đối tượng chịu lệ phí trước bạ nêu tại Điều 1 Thông tư này, phải nộp lệ phí trước bạ khi đăng ký quyền sở hữu, quyền sử dụng với cơ quan nhà nước có thẩm quyền.
Trường hợp không phải nộp lệ phí trước bạ nêu tại Điều 3 và được miễn lệ phí trước bạ nêu tại Điều 8 Thông tư này thì chủ tài sản phải kê khai lệ phí trước bạ với cơ quan Thuế trước khi đăng ký quyền sở hữu, quyền sử dụng với cơ quan nhà nước có thẩm quyền.
Điều 3. Các trường hợp không phải nộp lệ phí trước bạ
Các trường hợp thuộc diện không phải nộp lệ phí trước bạ theo quy định tại Điều 4 Nghị định số 45/2011/NĐ-CP ngày 17 tháng 06 năm 2011 của Chính phủ về lệ phí trước bạ được quy định cụ thể như sau:
1. Nhà, đất là trụ sở của cơ quan đại diện ngoại giao, cơ quan lãnh sự của nước ngoài, cơ quan Đại diện của tổ chức quốc tế thuộc hệ thống Liên hợp quốc và nhà ở của người đứng đầu cơ quan ngoại giao, cơ quan lãnh sự, cơ quan Đại diện của tổ chức quốc tế thuộc hệ thống Liên hợp quốc của nước ngoài tại Việt Nam.
Trụ sở của cơ quan đại diện ngoại giao, cơ quan lãnh sự là những toà nhà hoặc các bộ phận của toà nhà và phần đất trực thuộc toà nhà được sử dụng vào mục đích chính thức của cơ quan đại diện ngoại giao (bao gồm cả nhà ở và phần đất kèm theo nhà ở của người đứng đầu cơ quan), cơ quan lãnh sự theo quy định tại điểm b, Khoản 1, và điểm c, Khoản 2 Điều 4 Pháp lệnh về quyền ưu đãi, miễn trừ dành cho cơ quan đại diện ngoại giao, cơ quan lãnh sự và cơ quan đại diện của tổ chức quốc tế tại Việt Nam năm 1993.
2. Tài sản (trừ nhà, đất) của tổ chức, cá nhân nước ngoài sau đây:
a) Cơ quan đại diện ngoại giao, cơ quan lãnh sự, cơ quan đại diện của tổ chức quốc tế thuộc hệ thống Liên hợp quốc.
b) Viên chức ngoại giao, viên chức lãnh sự, nhân viên hành chính kỹ thuật của cơ quan đại diện ngoại giao và cơ quan lãnh sự nước ngoài, thành viên cơ quan các tổ chức quốc tế thuộc hệ thống Liên hợp quốc và thành viên của gia đình họ bao gồm vợ hoặc chồng và con chưa đủ 18 tuổi cùng sống chung trong gia đình không phải là công dân Việt Nam hoặc không thường trú tại Việt Nam.
c) Tổ chức, cá nhân nước ngoài khác không thuộc đối tượng nêu tại điểm a, b khoản này như cơ quan đại diện của tổ chức quốc tế liên Chính phủ ngoài hệ thống Liên hiệp quốc, cơ quan đại diện của tổ chức phi Chính phủ, các đoàn của tổ chức quốc tế, thành viên của cơ quan và các tổ chức, cá nhân khác nhưng theo điều ước quốc tế mà Việt Nam là thành viên có quy định được miễn nộp hoặc không phải nộp lệ phí trước bạ (hoặc được miễn nộp hoặc không phải nộp toàn bộ các khoản thuế, phí, lệ phí) thì thực hiện theo quy định đó.
Trường hợp điều ước quốc tế mà Việt Nam là thành viên, nếu quy định không thu hoặc miễn thu phí, lệ phí (nói chung) hoặc lệ phí trước bạ (nói riêng), áp dụng đối với cả phía Việt Nam thì đơn vị trực tiếp thực hiện dự án (hoặc Ban quản lý dự án) là phía Việt Nam cũng được miễn nộp hoặc không phải nộp lệ phí trước bạ khi đăng ký quyền sở hữu, sử dụng đối với tài sản thuộc Chương trình, Dự án đã ký kết.
3. Đất được nhà nước giao cho các tổ chức, cá nhân sử dụng vào các mục đích sau đây:
a) Sử dụng vào mục đích công cộng theo quy định của pháp luật về đất đai.
b) Sử dụng thăm dò, khai thác khoáng sản, nghiên cứu khoa học theo giấy phép hoặc xác nhận của cơ quan nhà nước có thẩm quyền.
c) Đầu tư xây dựng kết cấu hạ tầng để chuyển nhượng hoặc cho thuê, không phân biệt đất trong hay ngoài khu công nghiệp, khu chế xuất; đầu tư xây dựng nhà để kinh doanh.
Trường hợp này, các tổ chức, cá nhân không phải nộp lệ phí trước bạ khi được nhà nước giao đất; Nếu được sử dụng một phần diện tích đất để chuyển nhượng theo quy định của pháp luật thì tổ chức, cá nhân nhận chuyển nhượng phải nộp lệ phí trước bạ; nếu sử dụng một phần diện tích đất để cho thuê hoặc phục vụ cho hoạt động của đơn vị mình thì tổ chức, cá nhân được Nhà nước giao đất phải nộp lệ phí trước bạ đối với diện tích đất đó. Khi khai lệ phí trước bạ, tổ chức, cá nhân được giao đất phải xuất trình bản sao Quyết định giao đất của cơ quan nhà nước có thẩm quyền.
4. Đất được Nhà nước giao hoặc công nhận sử dụng vào mục đích sản xuất nông nghiệp, lâm nghiệp, nuôi trồng thuỷ sản và làm muối.
Trường hợp này người sử dụng đất phải xuất trình bản sao quyết định của cơ quan nhà nước có thẩm quyền về việc giao đất hoặc công nhận đất sử dụng vào mục đích sản xuất nông nghiệp, lâm nghiệp, nuôi trồng thuỷ sản và làm muối.
5. Đất nông nghiệp chuyển đổi quyền sử dụng đất giữa các hộ gia đình, cá nhân theo chủ trương chung về “dồn điền đổi thửa” theo quy định của pháp luật về đất đai.
Trường hợp này người sử dụng đất phải xuất trình xác nhận của Ủy ban nhân dân xã, phường, thị trấn nơi có đất được chuyển đổi quyền sử dụng hoặc nơi cư trú của người sử dụng đất.
6. Đất nông nghiệp do hộ gia đình, cá nhân tự khai hoang được cơ quan nhà nước có thẩm quyền cấp Giấy chứng nhận quyền sử dụng đất.
Trường hợp này người sử dụng đất phải xuất trình xác nhận của Ủy ban nhân dân xã, phường, thị trấn nơi có đất được khai hoang hoặc nơi cư trú của người sử dụng đất.
7. Đất thuê của nhà nước hoặc thuê của tổ chức, cá nhân đã có quyền sử dụng đất hợp pháp.
8. Nhà, đất sử dụng vào mục đích cộng đồng của các tổ chức tôn giáo, cơ sở tín ngưỡng được Nhà nước công nhận hoặc được phép hoạt động, bao gồm:
a) Đất có công trình là chùa, nhà thờ, thánh thất, thánh viện, tu viện, trường học, trụ sở làm việc và các cơ sở khác của tổ chức tôn giáo.
b) Đất có công trình là đình, đền, miếu, am;
9. Đất làm nghĩa trang, nghĩa địa.
Trường hợp này, nhà, đất được miễn lệ phí trước bạ là nhà, đất có nguồn gốc là tài sản thừa kế hoặc quà tặng mà người nhận tài sản lần đầu tiên được nhận thừa kế hoặc nhận quà tặng từ vợ (hoặc chồng), từ cha đẻ (hoặc mẹ đẻ), từ cha nuôi (hoặc mẹ nuôi), từ cha vợ (hoặc mẹ vợ), từ cha chồng (hoặc mẹ chồng), từ ông nội (hoặc bà nội), từ ông ngoại (hoặc bà ngoại), từ con đẻ (hoặc con nuôi), từ con dâu (hoặc con rể) từ cháu nội (hoặc cháu ngoại), từ anh, chị, em ruột.
Ví dụ: Ông A có 3 người con là M, N, O. Khi Ông A mất đi, 3 người con được thừa kế nhà, đất. Anh M tặng phần tài sản thừa kế của mình cho cô O. Như vậy, khi cô O làm thủ tục đăng ký quyền sở hữu nhà, quyền sử dụng đất thì quy định không thu lệ phí trước bạ như trên chỉ áp dụng đối với lần đầu tiên cô O được nhận thừa kế từ ông A hoặc quà tặng từ anh M; Có nghĩa là cô O không phải nộp lệ phí trước bạ đối với phần tài sản được nhận từ ông A và anh M.
Trường hợp này, khi khai lệ phí trước bạ, người nhận tài sản phải xuất trình cho cơ quan thuế các giấy tờ hợp pháp chứng minh mối quan hệ với người cho, tặng hoặc xác nhận của uỷ ban nhân dân xã, phường, thị trấn nơi người cho hoặc nhận tài sản thường trú về mối quan hệ giữa người cho và người nhận tài sản và bản tự cam kết của chủ tài sản về việc lần đầu tiên được nhận quà tặng hoặc thừa kế, nếu khai không đúng thì phải bị truy thu lệ phí trước bạ và phạt theo quy định của Luật Quản lý thuế và các văn bản hướng dẫn thi hành.
11. Nhà ở của hộ gia đình, cá nhân được tạo lập thông qua hình thức phát triển nhà ở riêng lẻ theo quy định của pháp luật.
12. Tài sản cho thuê tài chính được chuyển quyền sở hữu cho bên thuê khi kết thúc thời hạn thuê thông qua việc nhượng, bán tài sản cho thuê thì bên thuê không phải nộp lệ phí trước bạ.
Trường hợp tài sản đã được đăng ký, nộp lệ phí trước bạ sau đó chuyển nhượng cho công ty cho thuê tài chính và được chính đơn vị bán tài sản thuê lại thì công ty cho thuê tài chính không phải nộp lệ phí trước bạ khi đăng ký quyền sở hữu, sử dụng với cơ quan nhà nước có thẩm quyền.
Trường hợp trong thời hạn cho thuê tài chính, bên thuê chuyển nhượng hợp đồng thuê tài chính cho tổ chức, cá nhân khác (bên thứ ba) mà không thực hiện thủ tục thanh lý hợp đồng và công ty cho thuê tài chính không ký hợp đồng cho thuê tài chính với bên thứ ba thì bên thứ ba phải nộp lệ phí trước bạ khi kết thúc thời hạn thuê.
Trường hợp này, hoạt động cho thuê tài chính phải đảm bảo các điều kiện theo quy định về một giao dịch cho thuê tài chính và chủ tài sản phải xuất trình đầy đủ hồ sơ hợp pháp về tài sản thuê tài chính như:
- Hợp đồng cho thuê tài chính;
- Biên bản thanh lý hợp đồng;
- Giấy chứng nhận quyền sở hữu, sử dụng tài sản.
13. Nhà, đất, tài sản đặc biệt, tài sản chuyên dùng, tài sản phục vụ công tác quản lý chuyên dùng phục vụ quốc phòng, an ninh theo quy định của pháp luật như:
a) Các loại nhà, đất chuyên dùng phục vụ quốc phòng, an ninh theo quy định của pháp luật;
b) Tàu thuỷ, thuyền, ôtô, xe gắn máy thuộc danh mục tài sản đặc biệt hoặc tài sản chuyên dùng vào mục đích quốc phòng, an ninh được Bộ Quốc phòng hoặc Bộ Công an cấp giấy đăng ký phương tiện.
14. Nhà, đất thuộc tài sản nhà nước dùng làm trụ sở cơ quan của cơ quan nhà nước, đơn vị sự nghiệp công lập, đơn vị lực lượng vũ trang nhân dân, tổ chức chính trị, tổ chức chính trị - xã hội, tổ chức xã hội, tổ chức xã hội - nghề nghiệp theo quy định của pháp luật.
15. Nhà, đất được bồi thường (kể cả trường hợp mua nhà bằng tiền bồi thường, hỗ trợ) khi nhà nước thu hồi nhà, đất mà tổ chức, cá nhân bị thu hồi nhà, đất đã nộp lệ phí trước bạ (hoặc không phải nộp, hoặc được miễn lệ phí trước bạ hoặc đã khấu trừ lệ phí trước bạ phải nộp khi tính tiền bồi thường nhà đất bị thu hồi theo quy định của pháp luật) .
16. Tài sản của tổ chức, cá nhân đã được cấp giấy chứng nhận quyền sở hữu, sử dụng khi đăng ký lại quyền sở hữu, sử dụng không phải nộp lệ phí trước bạ trong những trường hợp sau đây:
a) Tài sản đã được cơ quan có thẩm quyền của nhà nước Việt Nam dân chủ cộng hoà, Chính phủ cách mạng lâm thời Cộng hoà miền Nam Việt Nam, nhà nước Cộng hoà xã hội chủ nghĩa Việt Nam hoặc cơ quan có thẩm quyền thuộc chế độ cũ cấp giấy chứng nhận sở hữu, sử dụng tài sản, nay đổi giấy chứng nhận sở hữu, sử dụng mới mà không thay đổi chủ tài sản (bao gồm cả trường hợp được nhà nước cấp Giấy chứng nhận quyền sở hữu, sử dụng nhưng còn ghi nợ lệ phí trước bạ hoặc nghĩa vụ tài chính).
Trường hợp diện tích đất tăng so với Giấy chứng nhận quyền sở hữu, sử dụng đã được cấp do trước đây đo chưa chính xác, nhưng ranh giới thửa đất không thay đổi thì chủ tài sản không phải nộp lệ phí trước bạ đối với diện tích tăng thêm.
Trường hợp có thay đổi ranh giới thửa đất so với giấy chứng nhận sở hữu, sử dụng cũ dẫn đến phát sinh tăng diện tích đất thì phải nộp lệ phí trước bạ đối với phần chênh lệch tăng.
b) Tài sản của doanh nghiệp nhà nước được chuyển thành sở hữu của công ty cổ phần theo hình thức cổ phần hoá hoặc các hình thức sắp xếp lại doanh nghiệp nhà nước khác theo quy định của pháp luật thì doanh nghiệp mới không phải nộp lệ phí trước bạ.
Trường hợp này, khi kê khai lệ phí trước bạ, chủ tài sản phải xuất trình giấy tờ hợp pháp chứng minh mối quan hệ với người đứng tên trên Giấy chứng nhận hoặc xác nhận của UBND xã, phường, thị trấn nơi hộ gia đình đăng ký hộ khẩu thường trú.
d) Tài sản của tổ chức, cá nhân đã được cấp giấy chứng nhận quyền sở hữu, sử dụng phải đăng ký lại quyền sở hữu, sử dụng do giấy chứng nhận bị mất, rách nát, hư hỏng;
đ) Nhà, đất đã có Quyết định thu hồi theo quy hoạch của nhà nước nay do thay đổi quy hoạch, chủ tài sản đăng ký lại quyền sở hữu, sử dụng.
17. Tài sản của tổ chức, cá nhân đã nộp lệ phí trước bạ (trừ trường hợp không phải nộp hoặc được miễn nộp theo chính sách hoặc theo quyết định của cơ quan có thẩm quyền) sau đó chuyển cho tổ chức, cá nhân khác đăng ký quyền sở hữu, sử dụng thì không phải nộp lệ phí trước bạ trong những trường hợp sau đây:
a) Tổ chức, cá nhân, xã viên hợp tác xã góp vốn bằng tài sản vào doanh nghiệp, tổ chức tín dụng, hợp tác xã; Doanh nghiệp, tổ chức tín dụng, hợp tác xã giải thể hoặc phân chia hoặc rút vốn trả lại cho tổ chức, cá nhân bằng chính tài sản do tổ chức, cá nhân đã góp vốn trước đây.
b) Doanh nghiệp điều động tài sản cho các đơn vị thành viên hoặc doanh nghiệp điều động tài sản giữa các đơn vị thành viên thuộc doanh nghiệp theo hình thức ghi tăng, ghi giảm vốn.
Trường hợp điều chuyển tài sản giữa doanh nghiệp với các đơn vị thành viên hạch toán kinh tế độc lập hoặc điều chuyển tài sản giữa các đơn vị thành viên hạch toán kinh tế độc lập với nhau không theo hình thức ghi tăng, ghi giảm vốn mà theo phương thức mua bán, chuyển nhượng, trao đổi hoặc điều động tài sản giữa cơ quan, đơn vị dự toán này với cơ quan, đơn vị dự toán khác (đối với hành chính sự nghiệp) thì phải nộp lệ phí trước bạ.
Trường hợp đổi tên đồng thời đổi chủ sở hữu tài sản, tài sản phải đăng ký lại với cơ quan nhà nước có thẩm quyền, phương tiện phải đổi biển kiểm soát thì chủ tài sản phải nộp lệ phí trước bạ.
19. Tài sản của tổ chức, cá nhân đã nộp lệ phí trước bạ, phải đăng ký lại quyền sở hữu sử dụng do chuyển đến địa phương khác mà không thay đổi chủ sở hữu, sử dụng tài sản.
20. Nhà tình nghĩa, nhà đại đoàn kết, nhà được hỗ trợ mang tính chất nhân đạo tương tự theo các chủ trương quyết định của nhà nước từ cấp huyện trở lên, bao gồm cả đất kèm theo nhà được đăng ký quyền sở hữu, sử dụng mang tên người được tặng.
Trường hợp này, người nhận tài sản khi đăng ký quyền sở hữu, quyền sử dụng phải xuất trình với cơ quan thuế xác nhận của UBND cấp xã.
21. Xe chuyên dùng vào các mục đích sau đây:
a) Xe cứu hoả;
b) Xe cứu thương (kể cả xe được trang bị các thiết bị y tế chuyên dùng để khám, chữa bệnh lưu động), xe chiếu, chụp X-quang, xe cứu hộ;
c) Xe chở rác (kể cả xe chở các tạp chất khác trong xử lý vệ sinh, môi trường), xe phun tưới, xe quét đường, xe hút hầm cầu, hút bụi;
d) Xe chuyên dùng cho thương binh, bệnh binh, người tàn tật đăng ký quyền sở hữu tên thương binh, bệnh binh, người tàn tật.
Xe chuyên dùng nêu tại khoản này (20) là xe có lắp đặt các thiết bị đồng bộ chuyên dùng, như: bồn chuyên dùng chứa nước hoặc hoá chất và vòi phun (đối với xe cứu hoả, xe phun tưới), băng ca, còi ủ (đối với xe cứu thương), gắn các thiết bị chụp X-quang (đối với xe chiếu, chụp X-quang), thùng ép rác hoặc các bộ phận cần cẩu, máy cẩu, xúc rác (đối với xe chở rác), xe 3 bánh gắn máy (đối với xe chuyên dùng cho thương binh, bệnh binh, người tàn tật).
Trường hợp các xe chuyên dùng này được cải tạo theo đúng quy định của pháp luật thành các loại xe: xe vận tải hàng hoá, xe vận tải hành khách, xe ô tô con, xe mô tô 2 bánh các loại, thì không phân biệt đối tượng và mục đích sử dụng, đều phải chịu lệ phí trước bạ.
22. Tàu bay sử dụng cho mục đích kinh doanh vận chuyển hàng hoá, hành khách công cộng được cơ quan nhà nước có thẩm quyền cấp giấy phép.
Trường hợp sử dụng làm phương tiện giao thông cá nhân thì thuộc diện phải chịu lệ phí trước bạ.
23. Tàu thuyền đánh bắt thuỷ, hải sản.
Trường hợp này, khi khai lệ phí trước bạ, chủ tài sản phải xuất trình giấy đăng ký kiểm tra chất lượng an toàn kỹ thuật của cơ quan nhà nước có thẩm quyền.
24. Vỏ, tổng thành khung, tổng thành máy của tài sản nêu tại khoản 8, Điều 1 Thông tư này phải đăng ký lại do được thay thế trong thời hạn bảo hành.
25. Nhà xưởng của cơ sở sản xuất, kinh doanh, kể cả nhà kho, nhà ăn, nhà để xe của đơn vị.
26. Tài sản là hàng hóa kinh doanh của các tổ chức, cá nhân đăng ký hoạt động kinh doanh theo quy định của pháp luật mà không đăng ký quyền sở hữu, quyền sử dụng với cơ quan nhà nước có thẩm quyền.
CĂN CỨ TÍNH, CÁCH TÍNH LỆ PHÍ TRƯỚC BẠ
Điều 4. Căn cứ tính lệ phí trước bạ, mức thu lệ phí trước bạ
1- Căn cứ tính lệ phí trước bạ là giá tính lệ phí trước bạ và tỷ lệ (%) lệ phí trước bạ.
2- Mức thu lệ phí trước bạ: số tiền lệ phí trước bạ phải nộp được xác định như sau:

Mức thu lệ phí trước bạ đối với các tài sản quy định tại Điều 1 Thông tư này tối đa là 500 triệu đồng/1 tài sản/lần trước bạ, trừ ô tô chở người dưới 10 chỗ ngồi (kể cả lái xe), tàu bay, du thuyền.
Điều 5. Giá tính lệ phí trước bạ
Giá tính lệ phí trước bạ là giá do Ủy ban nhân dân tỉnh, thành phố trực thuộc Trung ương ban hành để làm căn cứ tính lệ phí trước bạ.
1- Nguyên tắc ban hành giá tính lệ phí trước bạ:
1.1- Uỷ ban nhân dân cấp tỉnh căn cứ tình hình thực tế của địa phương, chỉ đạo các cơ quan chức năng xây dựng giá tính lệ phí trước bạ đối với từng loại tài sản để UBND cấp tỉnh có cơ sở xem xét, ban hành Bảng giá tính lệ phí trước bạ tài sản áp dụng tại địa phương trong từng thời kỳ, cụ thể:
- Đối với đất: giá tính thu lệ phí trước bạ là giá đất do UBND cấp tỉnh quy định theo quy định của pháp luật về đất đai .
- Đối với nhà: Sở Tài chính chủ trì, phối hợp với Sở Xây dựng, xây dựng giá tính lệ phí trước bạ nhà, căn cứ giá thực tế xây dựng "mới" một (01) m2 sàn nhà đối với từng cấp nhà, hạng nhà và tỷ lệ chất lượng còn lại của nhà cho phù hợp với tình hình thực tế.
- Đối với các loại tài sản khác: Sở Tài chính chủ trì, phối hợp với Cục Thuế xây dựng giá tính lệ phí trước bạ áp dụng đối với các tài sản thuộc diện chịu lệ phí trước bạ theo nguyên tắc sau:
+ Đối với tài sản mua bán: giá tính lệ phí trước bạ không được thấp hơn giá ghi trên hoá đơn bán hàng hợp pháp của người bán;
+ Đối với tài sản tự sản xuất, chế tạo: giá tính lệ phí trước bạ không được thấp hơn giá thành sản phẩm của đơn vị sản xuất.
1.2- Trong quá trình thực hiện, cơ quan thuế có trách nhiệm phát hiện kịp thời tài sản đăng ký nộp lệ phí trước bạ nhưng chưa được quy định trong bảng giá tính lệ phí trước bạ của địa phương hoặc giá quy định trong bảng giá chưa phù hợp với quy định thì phải có ý kiến đề xuất kịp thời gửi Sở Tài chính để báo cáo Uỷ ban nhân dân tỉnh hoặc cơ quan được uỷ quyền ban hành bảng giá để bổ sung, sửa đổi bảng giá tính lệ phí trước bạ cho phù hợp.
Chậm nhất sau 15 ngày kể từ ngày ban hành Bảng giá tính lệ phí trước bạ, cơ quan ban hành gửi Bộ Tài chính (Tổng cục Thuế) để theo dõi thực hiện.
2- Căn cứ xác định giá tính lệ phí trước bạ:
2.1- Đối với đất: Căn cứ xác định giá tính lệ phí trước bạ đất là diện tích đất chịu lệ phí trước bạ và giá đất tính lệ phí trước bạ.
Trong đó:
b- Giá đất tính lệ phí trước bạ: là giá đất do UBND cấp tỉnh quy định .
2.2- Đối với nhà: Căn cứ xác định giá tính lệ phí trước bạ nhà là diện tích nhà chịu lệ phí trước bạ và giá nhà tính lệ phí trước bạ.
Trong đó:
a- Diện tích nhà chịu lệ phí trước bạ là toàn bộ diện tích sàn nhà (kể cả diện tích công trình phụ kèm theo) thuộc quyền sở hữu hợp pháp của tổ chức, cá nhân.
b- Giá nhà tính lệ phí trước bạ: là giá do Uỷ ban nhân dân cấp tỉnh quy định.
2.3. Đối với các tài sản khác như tàu bay, tàu thuỷ, thuyền, xe ôtô, rơ moóc, xe gắn máy, súng săn, súng thể thao… : là giá tính lệ phí trước bạ quy định tại Bảng giá tính lệ phí trước bạ do UBND cấp tỉnh ban hành.
Điều 6. Tỷ lệ (%) lệ phí trước bạ
1. Nhà, đất là 0,5%.
2. Súng săn, súng thể thao là 2%.
3. Tàu thuỷ, sà lan, ca nô, tàu kéo, tàu đẩy, thuyền, du thuyền, tàu bay là 1%.
4. Xe máy mức thu là 2%. Riêng:
b) Đối với xe máy nộp lệ phí trước bạ lần thứ 2 trở đi được áp dụng mức thu là 1%. Trường hợp chủ tài sản đã kê khai, nộp lệ phí trước bạ đối với xe máy thấp hơn 5%, sau đó chuyển giao cho tổ chức, cá nhân ở địa bàn quy định tại điểm a khoản này thì nộp lệ phí trước bạ theo mức là 5%.
Đối với xe máy được kê khai nộp lệ phí trước bạ từ lần thứ 2 trở đi, chủ tài sản kê khai lệ phí trước bạ phải xuất trình cho cơ quan Thuế giấy đăng ký mô tô, xe máy hoặc hồ sơ đăng ký xe do Công an cấp đăng ký trả. Địa bàn đã kê khai nộp lệ phí lần trước được xác định theo “Nơi thường trú”, “Nơi Đăng ký nhân khẩu thường trú” hoặc “Địa chỉ” ghi trong giấy đăng ký mô tô, xe máy hoặc giấy khai đăng ký xe, giấy khai sang tên, di chuyển trong hồ sơ đăng ký xe và được xác định theo địa giới hành chính nhà nước tại thời điểm kê khai lệ phí trước bạ.
5. Ôtô, rơ moóc hoặc sơ mi rơ moóc được kéo bởi ô tô là 2%.
Riêng: Ô tô chở người dưới 10 chỗ ngồi (kể cả lái xe), bao gồm cả trường hợp ôtô bán tải vừa chở người, vừa chở hàng thì nộp lệ phí trước bạ theo tỷ lệ từ 10% đến 20%. Căn cứ quy định về tỷ lệ thu lệ phí trước bạ tại điểm này, Hội đồng nhân dân tỉnh, thành phố trực thuộc Trung ương quyết định cụ thể tỷ lệ thu lệ phí trước bạ đối với ô tô chở người dưới 10 chỗ ngồi (kể cả lái xe) cho phù hợp với điều kiện thực tế của địa phương.
Thành phố trực thuộc Trung ương, thành phố thuộc tỉnh; thị xã nơi Uỷ ban nhân dân tỉnh, thành phố trực thuộc Trung ương đóng trụ sở được xác định theo địa giới hành chính nhà nước tại thời điểm kê khai lệ phí trước bạ, trong đó: Thành phố trực thuộc Trung ương bao gồm tất cả các quận, huyện trực thuộc thành phố, không phân biệt các quận nội thành hay các huyện ngoại thành, đô thị hay nông thôn; Thành phố thuộc tỉnh và thị xã nơi Uỷ ban nhân dân tỉnh đóng trụ sở bao gồm tất cả các phường, xã thuộc thành phố, thị xã, không phân biệt là nội thành, nội thị hay xã ngoại thành, ngoại thị.
6. Vỏ, tổng thành khung, tổng thành máy của tài sản quy định tại khoản 3, 4 và 5 Điều này mà phải đăng ký với cơ quan nhà nước có thẩm quyền thì áp dụng tỷ lệ thu lệ phí trước bạ tương ứng với tài sản quy định tại khoản 3, 4 và 5 Điều này.
Ví dụ về việc xác định tỷ lệ nộp lệ phí trước bạ của các trường hợp kê khai nộp lệ phí trước bạ từ lần thứ 2 trở đi (trong đó địa bàn A là địa bàn trong nhóm các tỉnh, thành phố trực thuộc Trung ương, thành phố thuộc tỉnh và thị xã nơi Uỷ ban nhân dân tỉnh đóng trụ sở; địa bàn B là các địa bàn khác) như sau:
+ Trường hợp 1: Xe máy đã được kê khai nộp lệ phí trước bạ tại địa bàn A, lần tiếp theo kê khai nộp lệ phí trước bạ tại địa bàn A nộp lệ phí trước bạ theo tỷ lệ 1%.
+ Trường hợp 2: Xe máy đã được kê khai nộp lệ phí trước bạ tại địa bàn A, lần tiếp theo kê khai nộp lệ phí trước bạ tại địa bàn B nộp lệ phí trước bạ theo tỷ lệ 1%.
+ Trường hợp 3: Xe máy đã được kê khai nộp lệ phí trước bạ tại địa bàn B, lần tiếp theo kê khai nộp lệ phí trước bạ tại địa bàn A nộp lệ phí trước bạ theo tỷ lệ 5%.
+ Trường hợp 4: Xe máy đã được kê khai nộp lệ phí trước bạ tại địa bàn B, lần tiếp theo kê khai nộp lệ phí trước bạ tại địa bàn B nộp lệ phí trước bạ theo tỷ lệ 1%.
+ Trường hợp 5: Xe máy kê khai nộp lệ phí trước bạ lần đầu tại địa bàn A hoặc địa bàn B, sau đó đã được kê khai nộp lệ phí trước bạ tại địa bàn B, lần tiếp theo kê khai nộp lệ phí trước bạ tại địa bàn A nộp lệ phí trước bạ theo tỷ lệ 5%.
+ Trường hợp 6: Xe máy kê khai nộp lệ phí trước bạ lần đầu tại địa bàn A hoặc địa bàn B, sau đó đã được kê khai nộp lệ phí trước bạ tại địa bàn A, lần tiếp theo kê khai nộp lệ phí trước bạ tại địa bàn A nộp lệ phí trước bạ theo tỷ lệ 1%.
+ Trường hợp 7: Xe máy kê khai nộp lệ phí trước bạ lần đầu tại địa bàn A hoặc địa bàn B, sau đó đã được kê khai nộp lệ phí trước bạ tại địa bàn A hoặc địa bàn B, lần tiếp theo kê khai nộp lệ phí trước bạ tại địa bàn B nộp lệ phí trước bạ theo tỷ lệ 1%.
Điều 7. Ghi nợ lệ phí trước bạ
1. Đối tượng được ghi nợ lệ phí trước bạ:
Nhà ở, đất ở của các hộ gia đình, cá nhân thuộc đối tượng được ghi nợ tiền sử dụng đất theo quy định tại khoản 8 Điều 2 Nghị định số 120/2010/NĐ-CP ngày 30/12/2010 của Chính phủ về sửa đổi, bổ sung một số điều của Nghị định số 198/2004/NĐ-CP ngày 3/12/2004 của Chính phủ về thu tiền sử dụng đất.
2. Thanh toán nợ lệ phí trước bạ:
Giá đất làm căn cứ tính số tiền lệ phí trước bạ là giá đất do Ủy ban nhân dân tỉnh, thành phố trực thuộc Trung ương quy định tại thời điểm xác định nghĩa vụ tiền sử dụng đất.
Trường hợp hộ gia đình, cá nhân thuộc diện được nợ lệ phí trước bạ khi chuyển nhượng, chuyển đổi nhà, đất đó cho tổ chức, cá nhân khác thì phải nộp đủ số lệ phí trước bạ còn nợ trước khi chuyển nhượng, chuyển đổi.
3. Thủ tục ghi nợ lệ phí trước bạ:
a) Hộ gia đình, cá nhân thuộc đối tượng được ghi nợ lệ phí trước bạ nhà ở, đất ở nêu tại khoản 1 điều này thực hiện nộp hồ sơ (trong đó có giấy tờ chứng minh thuộc đối tượng được ghi nợ lệ phí trước bạ nêu tại khoản 1 điều này) tại cơ quan nhà nước có thẩm quyền theo quy định.
b) Cơ quan có thẩm quyền cấp giấy chứng nhận quyền sở hữu nhà ở, quyền sử dụng đất ở kiểm tra hồ sơ, nếu xác định đúng đối tượng được ghi nợ lệ phí trước bạ nhà ở, đất ở nêu tại khoản 1 điều này thì ghi vào giấy chứng nhận quyền sở hữu nhà ở, quyền sử dụng đất ở: "Nợ lệ phí trước bạ" trước khi cấp cho chủ sở hữu, sử dụng nhà đất.
Trường hợp nhận được hồ sơ làm thủ tục chuyển nhượng, chuyển đổi quyền sở hữu nhà ở, quyền sử dụng đất ở của hộ gia đình, cá nhân còn ghi nợ lệ phí trước bạ, cơ quan có thẩm quyền cấp giấy chứng nhận quyền sở hữu nhà ở, quyền sử dụng đất ở có trách nhiệm chuyển hồ sơ, kèm theo "Phiếu chuyển thông tin địa chính để thực hiện nghĩa vụ tài chính" sang cho cơ quan Thuế để tính và thông báo để hộ gia đình, cá nhân có nhà, đất nộp đủ số tiền lệ phí trước bạ còn nợ trước khi làm thủ tục chuyển nhượng, chuyển đổi.
Quy định miễn lệ phí trước bạ tại Điều 9 Nghị định số 45/2011/NĐ-CP được hướng dẫn như sau:
1. Nhà ở, đất ở của hộ nghèo; nhà ở, đất ở của người dân tộc thiểu số ở các xã, phường, thị trấn thuộc vùng khó khăn; nhà ở, đất ở của hộ gia đình, cá nhân ở các xã thuộc Chương trình phát triển kinh tế - xã hội các xã đặc biệt khó khăn, miền núi, vùng sâu, vùng xa; nhà ở, đất ở của hộ gia đình, cá nhân đồng bào dân tộc thiểu số ở Tây Nguyên. Trong đó:
- Hộ nghèo là hộ gia đình mà tại thời điểm kê khai, nộp lệ phí trước bạ có giấy chứng nhận là hộ nghèo do cơ quan có thẩm quyền cấp hoặc được Ủy ban nhân dân xã, phường, thị trấn (cấp xã) nơi cư trú xác nhận là hộ nghèo theo quy định về chuẩn nghèo của Thủ tướng Chính phủ và các văn bản hướng dẫn thi hành.
- Hộ gia đình, cá nhân đồng bào dân tộc thiểu số thuộc diện được miễn lệ phí trước bạ là các cá nhân và hộ gia đình trong đó vợ hoặc chồng là người dân tộc thiểu số.
- Vùng khó khăn được xác định theo Quyết định số 30/2007/QĐ-TTg ngày 05/3/2007 của Thủ tướng Chính phủ ban hành Danh mục các đơn vị hành chính thuộc vùng khó khăn và các văn bản sửa đổi, bổ sung (nếu có).
Trường hợp này, các hộ gia đình, cá nhân khi kê khai lệ phí trước bạ phải xuất trình cho cơ quan Thuế các giấy tờ chứng minh là người dân tộc thiểu số như: Xác nhận của UBND xã phường nơi đăng ký hộ khẩu thường trú hoặc bản sao hộ khẩu thường trú hoặc giấy tờ khác chứng minh cá nhân đăng ký quyền sở hữu nhà, quyền sử dụng đất là người dân tộc thiểu số.
2. Phương tiện thuỷ nội địa không có động cơ, trọng tải toàn phần đến 15 tấn; Phương tiện thuỷ nội địa có động cơ tổng công suất máy chính đến 15 mã lực (CV); Phương tiện thuỷ nội địa có sức chở người đến 12 người; Vỏ và tổng thành máy tương ứng lắp thay thế vào các loại phương tiện này.
Các phương tiện nêu trên được xác định theo quy định của Luật giao thông đường thuỷ nội địa và các văn bản hướng dẫn thi hành (kể cả vỏ và tổng thành máy tương ứng lắp thay thế vào các loại phương tiện này).
3. Nhà, đất do cơ sở thực hiện xã hội hoá đối với các hoạt động trong lĩnh vực giáo dục - đào tạo, dạy nghề, y tế, văn hoá, thể dục thể thao, môi trường đăng ký quyền sở hữu sử dụng với cơ quan nhà nước có thẩm quyền .
Các cơ sở thực hiện xã hội hóa trong lĩnh vực giáo dục, dạy nghề, y tế, văn hóa, thể thao, môi trường phải đáp ứng quy định về tiêu chí quy mô, tiêu chuẩn theo quy định của Thủ tướng Chính phủ và các văn bản hướng dẫn thi hành.
4. Nhà, đất do các cơ sở ngoài công lập đăng ký quyền sở hữu nhà, quyền sử dụng đất vào các hoạt động trong lĩnh vực giáo dục - đào tạo; y tế; văn hoá; thể dục thể thao; khoa học và công nghệ; môi trường; xã hội; dân số, gia đình, bảo vệ chăm sóc trẻ em.
Các cơ sở ngoài công lập hoạt động trong lĩnh vực giáo dục - đào tạo; y tế; văn hoá; thể dục thể thao; khoa học và công nghệ; môi trường; xã hội; dân số, gia đình, bảo vệ chăm sóc trẻ em phải đáp ứng quy định về tiêu chí quy mô, tiêu chuẩn theo quy định của Thủ tướng Chính phủ và các văn bản hướng dẫn thi hành.
5. Nhà, đất do doanh nghiệp khoa học và công nghệ đăng ký quyền sử dụng đất, quyền sở hữu nhà phục vụ cho mục đích nghiên cứu khoa học, công nghệ theo quy định của pháp luật.
6. Các trường hợp khác do Thủ tướng Chính phủ quyết định.
Thông tư này có hiệu lực thi hành kể từ ngày 15/10/2011 và thay thế Thông tư số 68/2010/TT-BTC ngày 26/10/2010 của Bộ Tài chính hướng dẫn về lệ phí trước bạ.
Các tổ chức, cá nhân có tài sản thuộc đối tượng chịu lệ phí trước bạ, các cơ quan có liên quan chịu trách nhiệm thi hành các quy định của Nghị định số 45/2011/NĐ-CP của Chính phủ và hướng dẫn tại Thông tư này.
Trong quá trình thực hiện nếu có vướng mắc, đề nghị các tổ chức, cá nhân phản ảnh kịp thời về Bộ Tài chính để nghiên cứu, hướng dẫn bổ sung./.

CIRCULAR
GUIDING REGISTRATION FEE
Pursuant to the Ordinance on Charges and tees;
Pursuant to the 2003 Land Law and government decrees detailing the 2003 Land;
Pursuant to the Law on Tax Administration and government decrees detailing the Law on Tax Administration;
Pursuant to the Government's Decree No. 45/2011/ND-CP of June 17, 2011, on registration fee;
Pursuant to the Government's Decree No. 118/2008/ND-CP of November 27, 2008, defining the functions, tasks, Powers and organizational structure of the Ministry of Finance;
The Ministry of Finance guides registration fee as follows:
Chapter I
SCOPE OF APPLICATION
Article 1. Objects subject to registration fee
1. Houses, land:
a/ Houses, including dwelling houses, working offices and houses used for other purposes.
b/ Land, including agricultural and non-agricultural land specified in Clauses 1 and 2. Article 13 of the 2003 Land Law. which is managed and used by organizations, households or individuals (with or without works built thereon).
2. Hunting rifles, sports guns
3. Ships, including barges, motor boats, tug ships and push ships.
4. Boats, including yachts.
5. Aircraft.
6. Two-wheeled motorcycles, three-wheeled motorcycles, mopeds (including electric motorcycles), and the like which are subject to registration and require number plates granted by competent state agencies (below referred collectively as motorcycles).
7. Automobiles (including electric automobiles), trailers or semi-trailers drawn by automobiles which are subject to registration and require number plates granted by competent state agencies.
Machinery and equipment which are subject to registration and require number plates granted by competent state agencies but are not automobiles as defined in the Law on Road Traffic and its guiding documents are not subject to registration fee.
8. Shells, complete frames (referred collectively as frames) and complete engines subject to registration fee specified in Clauses 3. 4. 5. 6 and 7 of this Article are substitute frames or complete engines with frame or engine numbers different from those of properties for which competent state agencies have issued ownership or use right certificates.
Cases of transforming or repairing frames or engines or replacing engine blocks or repairing, transforming or changing then use purposes without changing frame or engine numbers or owners or users are subject to registration for technical safety and quality inspection with competent state agencies but not subject to registration fee.
Article 2. Registration fee payers
Organizations and individuals (including foreign ones) having properties subject to registration fee specified in Article 1 of this Circular shall pay registration fee when registering ownership or use rights with competent state agencies.
For cases not subject to registration fee specified in Article 3 or exempt from registration fee specified in Article 8 of this Circular, properly owners shall make registration fee declaration with tax agencies before registering ownership or use rights with competent state agencies.
Article 3. Cases not subject to registration fee
Cases not subject to registration fee under Article 4 of the Government's Decree No. 45/2011/ND-CP of June 17, 2011, are specified as follows:
1. Houses and land being offices of foreign diplomatic missions, consulates, representative offices of international organizations within the United Nations system and houses of heads of foreign diplomatic missions, consulates, representative offices of international organizations within the United Nations system in Vietnam
Offices of foreign diplomatic missions or consulates are buildings or their parts and attached land which are used for official purposes of these diplomatic missions or consulates (including houses of heads of these missions of consulates and attached land) as prescribed at Point b. Clause 1 and Point c. Clause 2. Article 4 of the 1993 Ordinance on Privileges and Immunities for Vietnam-based Diplomatic Missions. Consulates and Representative Offices of International Organizations
2. Properties (excluding houses and land) of the following foreign organizations and individuals
a/ Diplomatic missions, consulates, representative offices of inter national organizations within the United Nations system.
b/ Diplomats, consuls, administrative and technical staffs of foreign diplomatic missions and consulates, members of representative offices of international organizations within the United Nations system and their family members, including their spouses and under-18 children, who are not Vietnamese citizens or do not permanently reside in Vietnam
c/ Foreign organizations and individuals other than those specified at Points a and b of this Clause such as representative offices of inter-governmental organizations outside the United Nations system, representative offices of non-governmental organizations, delegations of international organizations, members of these offices and other organizations and individuals., that are exempt from or not liable to pay registration fee ( or exempt from or not liable to taxes, charges and lees of all kinds) under treaties to which Vietnam is a contracting party.
In case treaties to which Vietnam is a contracting party provide for non-collection of exemption from charges and fees (in general) or registration fee (in particular)applicable also lo Vietnamese partners. Vietnamese units directly implementing projects (or project management units) are also exempt from or not liable lo pay registration fee when registering ownership or use rights for properties under their signed programs or projects.
3. Land allocated by the State to organizations and individuals for use for the following purposes:
a/ Public purposes as defined by the land law.
b/ Mineral exploration and exploitation or scientific research under licenses or certificates granted by competent state agencies.
c/ Construction of infrastructure facilities for transfer or lease, regardless of whether land is within or outside industrial parks or export processing zones; construction of houses for trading for these cases, organizations and individuals are not liable to pay registration fee for land areas allocated by the State If they are permitted to transfer part of land areas under law, transferees shall pay registration fee; if they lease or use part of land areas for their own operations, they shall pay registration fee for the leased or used land area. When making registration fee declaration, organizations or individuals with land areas allocated by the Stale shall produce a copy of the land allocation decision issued by a competent stale agency.
4. Land allocated or recognized by the State for agricultural or forestry production, aquaculture or salt making.
For these cases, land users shall produce a copy of the decision on allocation or recognition of land used for agricultural or forestry production, aquaculture or salt making issued by a competent stale agency.
5. Agricultural land to which the use rights are swapped among households and individuals according to the policy on swapping and consolidation of small land plots under the land law
For these cases, land users shall produce a written certification of the People's Committee of the commune, ward or township where exist the land plots to which the use rights are swapped or where they reside.
6. Agricultural land reclaimed by households or individuals for which land use rights certificates are grained by competent stale agencies.
For these cases, land users shall produce a written certification of the People's Committee of the commune, ward or township where exist the reclaimed land plots or where they reside.
7. Land rented from the Stale or organizations or individuals that have lawful land use rights.
8. Houses and land used for community purposes by religious organizations or belief institutions recognized or licensed by the State, including:
a/ Land of pagodas, churches, sanctuaries, abbeys, schools, working offices or other facilities used by religious institutions.
b/ Land of communal houses, temples, shrines or small pagodas.
9. Land of cemeteries or graveyards.
10. Houses and land inherited or donated between spouses; between natural parent and natural child, adoptive parent and adopted child; parent-in-law and daughter-in-law- or son-in law; paternal grandparent and grandchild, maternal grandparent and grandchild or between siblings, for which land Use right certificates or certificates of ownership of houses and other assets attached to land are granted for the first time by competent state agencies.
for these cases, houses and land exempt from registration fee are houses and land which are received for the first lime as the inheritance or gift by the recipient from his/her spouse, natural father (natural mother), adoptive father (adoptive mother), father-in-law (mother-in-law), paternal grandfather (paternal grandmother), maternal grandfather, (maternal grandmother), natural child (adopted child), daughter in-law (son-in-law), grandchild or sibling.
For example: Mr. A has 3 children, namely M, N and O. When he dies, his three children are entitled to inherit houses and land. M gives as a gift his inherited assets to O. So that, when O carries out procedures for registration of house ownership rights or land use rights, the above-mentioned provision on non-collection of registration fee will apply only to the properties she receives for the first time as inheritance from Mr. A or as a gift from M. This means that O is not liable to pay registration fee for the properties received from Mr. A and M.
For these cases, when making registration fee registration, property recipients shall produce to tax agencies lawful papers proving their relationships with property givers or a written certification of the relationship between property givers and recipients, made by the People's Committee of the commune, ward or township in which the property givers or recipients permanently reside, and the property, owners' written commitment that it is the first time they receive the inheritance or gift II making false declarations, they will he subject to collection of registration fee arrears and fines according to the Law on Tax Administration and its guiding documents.
11. Houses created by households or individuals in the form of development of individual houses according to law
12. Assets under financial lease over which ownership is transferred to the lessees upon expiration of the lease term through transfer or sale, for which the lessees are not required to pay registration tee.
In case an asset which has been registered and for which registration fee has been paid is transferred to a financial leasing company, and then leased back to the asset seller, when registering ownership or use rights with a competent state agency, the financial leasing company is not required to pay registration fee.
Within the lease term, if the lessee transfers the financial leasing contract to another organization or individual (a third party) without earning out contract liquidation procedures and the financial leasing company signs no financial leasing contract with the third party, the third part) shall pay registration fee upon the expiration of the lease term.
In this case, financial leasing activities must meet the conditions prescribed for a financial leasing transaction and the asset owner shall produce the following lawful documents on assets under financial lease financial leasing contract.
- Contract liquidation record.
- Asset ownership right 01 use right certificate
13. Houses, land, special properties, special-use properties and properties used for defense and security purposes according to law, including:
a/ Special use houses and land for defense and security according to law;
b/ Ships, boats, automobiles and motorcycles on the list of special properties or special-use properties for defense or security purposes for which registration certificates are granted by the Ministry of National Defense or the Ministry of Public Security.
14. Houses and land being state properties, w Inch are used as head offices of state agencies, public non-business units, units of the people's armed forces, political organizations, socio-political organizations, socio-political-professional organizations, social organizations and socio-professional organizations according to law.
15. Houses and land being compensations (including those purchased with compensation or support money) in case the Stale recovers houses and land, for which organizations or individuals with recovered houses and land have paid registration fee (or are not liable to pay or are exempt from registration fee or have registration fee subtracted when calculating compensation for recovered houses and land under law).
16. Properties of organizations and individuals for which ownership or use right certificates have been granted and which are now re-registered are not liable to registration fee in the following cases:
a/ Properties with ownership or use right certificates granted by Competent agencies of the Stale of the Democratic Republic of Vietnam, the Provisional Revolutionary Government of the Republic of South Vietnam or the State of the Socialist Republic of Vietnam or competent agencies of the former regime, which are now renewed without changing their owners (including cases in which ownership or use right certificates are granted by the State with registration fee or financial obligations allowed to be owed).
In case there is an increase in the land area stated in the ownership or use right certificates already granted due to incorrect measurement in the past, but the boundaries of the land plot remain unchanged, the property owner is not required to pay registration fee for the increased area. For cases of changing the boundaries of the land plot staled in the old ownership or use right certificates, leading to an increase in the land area, registration fee must be paid for the increased land area.
b/ Properties of state enterprises equitized into joint-stock companies or otherwise reorganized under law, for which newly established enterprises are not required to pay registration tee.
c/ Properties with ownership 01 use right certificates granted to households in the name of one household member winch are now divided among household members for re-registration.
For these cases, when making registration fee declaration, property owners shall produce lawful papers proving their relationship with the person named on the certificates or written certifications of the People's Committee of the commune, ward or township in which the household registers its permanent residence.
d/ Properties of organizations or individuals with ownership or use right certificates which must be now re-registered because such certificates are lost, torn or damaged.-
e/ Houses and land for which recovery decisions have been issued under master plans, which are now subject to re-registration of ownership or use rights because such master plans are modified.
f/. Properties of organizations or individuals for which registration fee has been paid (except when registration fee is not required to be paid or is exempt under competent authorities' policies or decisions) and which are then transferred to other organizations or individuals are not liable to registration fee upon ownership or use right registration in the following cases:
a/ Organizations, individuals or cooperative members contribute their properties as capital to enterprises, credit institutions or cooperatives Or enterprises, credit institutions or cooperatives dissolve or divide or withdraw properties to their member organizations and individuals that have contributed such properties.
b/ Properties of enterprises which are transferred to their member units or among their member units in the form of capital-increase or decrease recording.
For properties transferred between enterprises and their independent cost-accounting; member units or among independent cost-accounting member units not in the form of capital-increase or -decrease recording but in the form of sale and purchase, assignment, exchange or transfer between one cost-estimating agency or unit and another (for the administrative and non-business sector), registration fee must be paid.
18. Properties of organizations or individuals for which registration fee has been paid and which are subject to re-registration of ownership or use rights as a result of division, splitting, equitization. consolidation, merger or renaming of organizations under decisions of competent state agencies without changing property owners or users.
In case the renaming is made simultaneously with the change of property owners and. as a result, properties must be re-registered with a competent state agency or vehicles must have their number plates changed, properly owners shall pay registration fee.
10. Properties of organizations and individuals for which registration fee has been paid and which are subject to re-registration of ownership or use rights as the) are moved to other localities without changing their owners or users.
20. Houses of gratitude, houses of great unity and houses built for similar humanitarian purposes under policies and decisions issued by administrations of district or higher level, including land associated with these houses, which are registered for ownership or use under the names of house recipients.
For these cases, when registering ownership or use rights, property recipients shall produce to tax agencies written certifications of commune-level People's Committees.
21. Special-use vehicles, including:
a/ Fire engines,
b/ Ambulances (including those equipped with special-use medical devices for mobile medical examination and treatment). X-ray automobiles and salvage cars:
c/ Garbage (including other waste matters in sanitary and environmental treatment) trucks, road cleaners and sweepers, dumpers and 'Just cleaners.
d/ Vehicles used exclusive!) for war invalids, diseased soldiers and disabled people registered for ownership under the names of such war invalids, diseased soldiers or disabled people.
Special-use vehicles mentioned in this Clause (20) are vehicles fitted with special-use equipment in complete sets, such as special-use water or chemical tanks and spray hoses (for fire engines and road cleaners), stretchers and sirens (for ambulances). X-ray equipment (for X-ray automobiles). garbage press containers or cranes, lifting devices, garbage collectors (for garbage trucks), motor three-wheelers (for vehicles used exclusively for war invalids, diseased soldiers or people with disabilities).
In case these special-use vehicles have been law fully transformed into other vehicles such as cargo or passenger transportation vehicles, cars or motor two-wheelers of all kinds, regardless of their users and use purposes, registration fee must be paid.
22. Aircraft used for commercial cargo and passenger transportation under licenses of competent stale agencies.
Those used as personal means of transport are subject to registration fee.
23. Fishing ships and boats.
For these cases, when making registration fee declaration, property owners shall produce certificates of registration for technical quality and safety inspection granted by competent state agencies.
24. Shells, complete frames and complete engines of properties specified in Clause 8. Article I of this Circular, which are replaced and must be re-registered within the warranty period.
25. Workshops of production and business establishments, including their warehouses, dining halls and garages.
26. Properties which are traded by organizations or individuals that have registered their business operations but do not register these properties' ownership or use rights with a competent stale agency.
Chapter II
BASES AND METHODS F()R REGISTRATION FEE CALCULATION
Article 4. Bases for registration fee calculation and registration fee rates
1. Bases for registration fee calculation include registration fee calculation price and registration fee rate (%).
2. Registration fee level: The payable registration fee amount is determined as follows:

The maximum registration fee level for properties specified in Article 1 of this Circular, excluding passenger cars of under 10 seats ( including the driver's), aircraft and yachts, is VND 5(K) million/property/time of registration.
Article 5. Registration fee calculation prices
Registration fee calculation prices are prices issued by provincial-level People's Committees to serve as a basis for registration fee calculation.
1. Principles of issuance of registration fee calculation prices:
1.1 Provincial-level People's Committees shall base themselves on the local practical situation to direct functional agencies to elaborate registration fee calculation prices for each type of property serving as a basis for the former to consider and issue a table of registration fee calculation prices to be applied in their respective localities in each period Specifically:
For land Registration fee calculation prices arc the prices prescribed by provincial-level People's Committees under the land law.
- For houses: Provincial-level Finance Departments shall assume the prime responsibility for. and coordinate with provincial-level Construction Departments in, elaborating registration fee calculation prices on the basis of the actual "new" construction price of one (1 ) m2 of floor area of houses of each grade and class and the remaining quality percentage of houses so as to suit local realities.
- For other properties: Provincial-level Finance Departments shall assume the prime responsibility for, and coordinate with provincial level Tax Departments in. elaborating registration fee calculation prices of properties subject to registration fee on the following principles:
+ For sold/purchased properties: Registration lee calculation prices must not be lower than the prices stated in the sellers" lawful sale invoices.
+ For produced/manufactured properties: Registration lee calculation prices must not be lower than production costs of producers.
1.2. In the course of implementation, tax agencies shall detect in time properties registered for registration tee payment which have not yet been included in the local tables of registration fee calculation prices, or properties of which the prices specified in the tables of registration fee calculation prices do not conform to regulations and propose provincial-level Finance Departments to report to provincial-level People's Committees or authorized agencies to supplement and modify the price tables to suit local realities.
Within 15 days after issuing tables of registration fee calculation prices, issuers shall send them to the Ministry of Finance (the General Department of Taxation) for supervision.
2. Bases for determining registration fee calculation prices:
2.1. For land: Bases for determining registration fee calculation prices include the whole land area subject to registration fee and land prices for registration fee calculation.
In which
a/ The land area subject to registration fee is the whole area of the land plot under the lawful use right of organizations or individuals, which is determined and supplied by land use right registration offices to tax agencies in the sheet on cadastral information for determination of financial obligations."
b/ The land price for calculation of registration is the land price prescribed by provincial-level People's Committees.
2.2. For houses: Bases for determining registration fee calculation prices include the house area subject to registration fee and house prices for calculation of registration fee.
In which:
a/ The house area subject to registration fee-is the whole floor area (including the floor area of attached auxiliary works) under the lawful ownership of organizations or individuals.
b/ The house price for calculation of registration fee is the price prescribed by the provincial-level People's Committee
2.3. For other properties such as aircraft, ships, boats, automobiles, trailers, motorcycles, hunting rifles and sports guns: The registration fee calculation prices are prescribed by provincial-level People's Committees.
Article 6. Registration fee rates (%)
1. For houses and land: 0.5%.
2. For hunting rifles and sports guns: 2'7c.
3. For ships, badges, motor boats, tug ships, push ships, yachts, aircraft: 1%.
4. Motorcycles: 2%. Particularly:
a/ For motorcycles of organizations and individuals in centrally run cities, provincial cities or towns in which the provincial-level People's Committees are headquartered: 5% for first-time payment of registration fee;
b/ For payment of registration fee from the second time on: 1 %. In case motorcycle owners declared and paid registration fee for their motorcycles at a rate lower than 5% and then transfer their motorcycles to organizations or individuals in localities defined at Point a of this Clause, registration fee shall be paid at 5%.
When making registration fee declaration and payment for motorcycles from the second time on, motorcycle owners shall produce to tax agencies motorcycle registration certificates or motorcycle registration dossiers returned by the police offices which have issued the registration certificates. The localities of previous registration fee declarations and payments shall be identified according to the "place of permanent residence", "place of registration of permanent residence" or "address" shown in motorcycle registration certificates or motorcycle registration declarations or motorcycle transfer or movement declarations in motorcycle registration dossiers and determined by administrative boundaries at the time of registration fee declaration.
5. For automobiles, trailers or semi trailers drawn by automobiles: 2%.
Particularly for passenger cars of under 10 seats (including the driver's), including also pick-up cars for both passenger and cargo transportation, registration fee shall be paid at a rate of between10% and 20%. Based the provisions on registration fee rates at this Point, provincial-level People's Councils shall decide on specific registration fee rates for passenger cars of under 10 seats (including the driver's) lo suit local realities.
Centrally run cities, provincial cities and towns in which provincial-level People's Committees are headquartered shall be identified by administrative boundaries at the time of registration fee declaration. A centrally run city covers all urban districts and rural districts of that city; a provincial city or town in which the provincial-level People's Committee is headquartered covers all wards and communes of that city or town.
6. For shells, complete frames and complete engines of properties specified in Clauses 3, 4 and 5 of this Article, which must be registered with competent state agencies, applicable registration fee rates are those applied to corresponding properties.
Specific examples on the determination of registration fee rates for cases of registration fee declaration and payment from the second time on (in w Inch locality A means a province, centrally run city, provincial city or town where the provincial-level People's Committee is headquartered and locality B means another locality ):
+ Case 1: For a motorcycle for which registration fee has been declared and paid in locality A. it the subsequent time of registration fee declaration and payment is made in locality
A, the registration fee rate is 1%.
+ Case 2. For a motorcycle for which registration fee has been declared and paid in locality A. if the subsequent time of registration fee declaration and payment is made in locality B, registration fee is 1%.
+ Case 3: For a motorcycle for which registration fee has been declared and paid in locality B. if the subsequent time of registration fee declaration and payment is made in locality A, the registration fee rate is 5%.
+ Case 4: For a motorcycle for which registration fee has been declared and paid in locality B, it the subsequent time of registration fee declaration and payment is made in locality B, the registration fee rate is 1%.
+ Case 5: For a motorcycle for which registration fee has been declared and paid for the first time in locality A or locality B. if the subsequent times of registration fee declaration and payment are made in locality B and then locality A. the registration fee rate is 5%
+ Case 6: For a motorcycle for which registration fee has been declared and paid for the first time in locality A or locality B. if the subsequent two times of registration fee declaration and payment are made in locality A. the registration fee rate is l%.
+ Case 7: For a motorcycle for which registration fee has been declared and paid for the first time in locality A or locality B. if the subsequent time of registration fee declaration and payment is made in locality A or B and the following time in locality B. the registration fee rate is 1%.
Chapter III
OWING OF AND EXEMPTION FROM REGISTRATION FEE
Article 7. Owing of registration fee Subjects allowed to owe registration fee:
Houses and residential land of households or individuals entitled to owe land use levy under Clause S. Article 2 of the Government's Decree No. 12072010/ND-CP of December 30, 2010, amending and supplementing a number of articles of the Government's Decree No. 198/2004/ND-CP of December 31, 2004, on collection of land use levy.
2. Payment of owed registration fee:
The land price used as a basis for calculation of the payable registration fee amount is the land price prescribed by the provincial-level People's Committee at the time of determining the payable land use levy amount.
In case households or individuals entitled to owe registration fee transfer or swap such houses or land plots to others, they shall pay the owed registration fee amount before carrying out such transfer or swap.
3. Procedures for owing registration fee:
a/ Households or individuals entitled to owe registration fee for houses or residential land specified in Clause 1 of this Article shall submit dossiers (comprising documents evidencing their eligibility to owe registration fee under Clause 1 of this Article) to competent state agencies according to law.
b/ Agencies competent to grant house ownership or residential land use right certificates shall inspect the dossiers and. if ascertaining that the applicants are entitled to owe registration fee for houses or residential land under Clause 1 of this Article, write in the house ownership or residential land use rights certificates the phrase "Registration fee owed" before handing such certificates to the house owners or land users.
When receiving dossiers of application for carrying out procedures for the transfer or swap of house ownership or land use rights submitted by households or individuals that still owe registration fee, agencies competent to grant house ownership or residential land use right certificates shall transfer such dossiers together with a "sheet on cadastral information for performance of financial obligations" to tax agencies for the latter to calculate and notify the owed registration fee amount to the households or individuals for full payment before carrying out transfer or swap procedures.
Article 8. Exemption from registration fee
Provisions on registration fee exemption in Article 9 of Decree No. 45/2011/ND-CP are guided as follows:
1. Houses and residential land of poor households: houses and residential land of ethnic minority people in communes, wards and townships in difficulty-hit regions: houses and residential land of households and individuals in communes covered by the program on socioeconomic development in special difficulty-hit, mountainous, deep-lying and remote communes: houses and residential land of ethnic minority households and individuals in the Central Highlands. In which:
- Poor households are households which, at the time of registration fee declaration and payment, have poor-household certificates issued by competent authorities or are certified to be poor by commune-level People's Committees of localities in which they reside, according to the poverty line set by a Prime Minister decision and guiding documents.
- Ethnic minority households and individuals eligible for registration fee exemption are individuals and households in which either the husband or wife is or both are ethnic minority persons.
- Difficulty-hit regions shall be identified under the Prime Minister's Decision No. 30/2007/QD-TTg of March 5, 2007, promulgating the list of administrative units in difficulty-hit areas, and amending and supplementing documents (if any).
In this case, when making registration fee declaration and payment, a household or individual shall produce to the tax agency papers proving that he/she is an ethnic minority person such as the written certification of the commune-level People's Committee with which the household status is registered or a copy of the household status book or a paper evidencing that the house ownership or residential land use right-registering individual is an ethnic minority person.
2. Inland waterway craft without motors and with a gross tonnage of up to 15 tons; inland waterway craft with motor and total main engine capacity of up to 15 horse power (CV); inland waterway craft with a transportation capacity of up to 12 passengers; shells and complete engines fitted thereto.
These vessels (including also shells and complete engines fitted thereto) are defined according to the Law on Inland Waterway Transport and its guiding documents
3. Houses and land of which ownership or use rights are registered with a competent state agency by establishments carrying out socialized activities in the fields of education and training, vocational training, culture, sports and physical training and environment.
Establishments carrying out socialized activities in the fields of education and training, vocational training, culture, sports and physical training and environment must satisfy criteria and standards according to the Prime Minister's regulations and guiding documents
4. Houses and land of which house ownership rights or land use rights are registered by non public establishments operating in the fields of education and training, healthcare, culture, spoils and physical training; science and technology; environment; social; population, family and child protection and care.
Non-public establishments operating in the fields of education and training, healthcare, culture, sports and physical training; environment; social affairs; population, family and child protection and care must satisfy criteria and standards according to the Prime Minister's regulations and guiding documents.
5. Houses and land of which house ownership rights or land use rights are registered by science and technology enterprises for scientific and technological research under law.
6. Other cases as decided by the Prime Minister.
Chapter IV
ORGANIZATION OF IMPLEMENTATION
Article 9. Effect
This Circular takes effect on October 15, 2011, and replaces the Ministry of Finance's Circular No. 68/2010/TT-BTC of October 26, 2010, guiding registration fee.
Organizations and individuals having properties subject to registration fee and related agencies shall implement the Government's Decree No. 45/2011/ND-CP and this Circular.
Any problems arising in the course of implementation should be promptly reported to the Ministry of Finance for study and additional guidance.-
