Decision 126/1999/QD-BNN-TCCB1 on decentralization to certain units of decision-making power and responsibility for exit management issued by the Minister of Agriculture and Rural Development

DECISION

ASSIGNING A NUMBER OF UNITS THE RIGHT AND RESPONSIBILITY TO DECIDE AND MANAGE THE EXIT

THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT

Pursuant to Decree No. 73/CP of November 1st, 1995 of the Government on the functions, tasks, power and organizational apparatus of the Ministry of Agriculture and Rural Development;
Pursuant to Decree No. 24/CP of March 24, 1995 of the Government on the procedures for exit and entry; Decree No. 76/CP of November 6, 1995 supplementing and amending a number of articles of Decree No. 24/CP;
In order to enhance the concerned units’ managerial responsibility and to raise the efficiency of the sending of officials to study or work abroad;
At the proposal of the director of the Organization and Personnel Department,

DECIDES:

Article 1.- To assign a number of units attached to the Ministry (on the list enclosed herewith) the right to decide the exit for public missions or private business of cadres on their payrolls and laborers under long-term contracts as follows:

- The Minister shall decide the exit for the chairmen of the managing boards, the general directors, the directors of attached units and the heads of units and agencies directly under the Ministry; for post-graduate students; for recipients of academic titles such as Professor, Doctor, Academician and others; and for those who are sent to accompany high-level delegations of the Party and State.

- The chairmen of the managing boards shall decide the exit for members of the boards as well as other posts managed by the boards.

- The heads of units shall decide the exit for all other people.

Article 2.- The chairmen of the managing boards and the heads of units shall have to take full responsibility before law for their decisions on the exit and, to comply with the current regulations of the Party, the Government and the Ministry on the management of personnel and passports as well as on exit efficiency.

Article 3.- Implementation management

- The concerned units shall have to immediately send the exit decisions and biannual as well as annual reports thereon to the Organization and Personnel Department and the International Cooperation Department.

- To assign the Organization and Personnel Department and the International Cooperation Department the responsibility to provide professional guidance and to conduct inspections according to their respective functions and gather reports on exit from the assigned units.

Article 4.- This Decision takes effect 15 days after its signing.

The director of the Ministry’s Office, the head of the Organization and Personnel Department, the head of the International Cooperation Department and the heads of units stated in the list at Article 1 shall have to implement this Decision.
