DECISION
APPROVING THE SCHEME\r\nON PILOT INNOVATION OF OPERATIONAL MECHANISM OF THE FOREIGN TRADE UNIVERSITY\r\nDURING 2015 - 2017
THE PRIME MINISTER
Pursuant to the Law on Organization of the\r\nGovernment dated December 25, 2001;
Pursuant to the Law on Education dated June 14,\r\n2005 and the Law on amendments to the Law on Education dated November 25, 2009;
Pursuant to the Law on Higher Education dated\r\nJune 18, 2012;
Pursuant to the Government’s Decree No.\r\n49/2010/ND-CP dated May 14, 2010; the Government’s Decree No. 74/2013/ND-CP\r\ndated July 15, 2013 amending certain articles of the Government’s Decree No. 49/2010/ND-CP\r\ndated May 14, 2010 on reduction and exemption of tuition, support for learning\r\ncost, collection and use of tuition applicable to educational institutions\r\nbelonging to the national education system from the 2010 – 2011 academic year\r\nto the 2014 – 2015 academic year;
Pursuant to the Government’s Decree No.\r\n16/2015/ND-CP dated February 14, 2015 stipulating the\r\nmechanism for exercising the autonomy of public administrative units;

Pursuant to the Decision No. 70/2014/QD-TTg\r\ndated December 10, 2015 promulgating the University Charter by the Prime\r\nMinister;
Considering the request of the President of the\r\nForeign Trade University,
DECIDES
Article 1. To approve the Scheme on the\r\npilot innovation of the operational mechanism of the Foreign Trade University\r\nduring 2015 – 2017 (referred to as the Scheme) with the following principal\r\ncontents:
I. OBJECTIVES
1. General objectives
The Foreign Trade University (referred to as “FTU”)\r\nshall actively, reasonably and effectively utilize its resources, innovate its\r\nmanagerial system towards modernity, and facilitate the improvement of its\r\nscientific research and training quality; aim to become a prestigious and\r\nhigh-quality research and training center in the region and on the world\r\naccording to the FTU's development objectives and strategies by 2030; provide\r\nopportunity to study in FTU for social policy beneficiaries and poor students.
2. Specific objectives
a) Improve the scientific research and training\r\nquality according to regional and international standards.

c) Step up the international cooperation in\r\ntraining and scientific research fields, perform the internationalization of\r\ntraining programs and promote the cooperation in the field of scientific\r\nresearch on a large scale.
d) Implement social policies in higher education\r\nthrough the establishment of funds for social policy beneficiaries, talents,\r\nstudents with difficult circumstances, scholarship funds and credit funds for\r\nstudents;
dd) Improve the effectiveness and efficiency in the\r\nmanagement of tertiary education institution.
e) Ensure the balance between revenues and\r\nexpenditures, stabilize and improve income of its managers, lecturers, public\r\nemployees and workers.
II. INNOVATION CONTENTS
The FTU is entitled to exercise the autonomy from\r\nthe following aspects:
1. Performance of scientific research and training\r\nduties
a) Make decisions on opening training disciplines\r\nand specialties in college level, undergraduate level, master’s level and\r\ndoctoral level to meet the needs of the society in conformity with the FTU’s\r\ndevelopment orientations when fully satisfying conditions prescribed by law.\r\nWith regard to new training disciplines that are not in the List of training\r\nand educational disciplines promulgated by the Ministry of Education and\r\nTraining, FTU is entitled to open such new training disciplines provided that\r\nFTU must report to the Ministry of Education and Training on pilot organization\r\nof new training disciplines.
b) Determine enrollment quotas and organize the enrollment\r\nunder FTU's enrollment plan in a transparent manner, and implement the\r\nenrollment priority policy as regulated.

d) Carry out the educational quality accreditation\r\nas regulated; conduct international quality accreditation step by step.
dd) Make decisions on the training cooperation with\r\ndomestic and foreign educational facilities which are regional and\r\ninternational reputable tertiary education institutions and educational\r\norganizations. FTU is responsible for publicly announcing and sufficiently\r\nproviding learners with the information about international cooperation\r\nprograms, ensuring legitimate rights and benefits of learners.
e) Make decisions on scientific research\r\nactivities; encourage the application and transfer of scientific research\r\nresults while taking into account the market demands and social needs; make\r\ndecisions on participation in scientific and technological tasks, scientific\r\nand technological services, and organization of seminars in coordination with\r\ndomestic and foreign entities.
g) Provide public non-business services in the\r\nfields of education and training, and science and technology, including those\r\nunder orders placed by the State.
2. Organizational apparatus
a) Decide and assume responsibility for the\r\nestablishment, re-structuring, merger, division, separation and dissolution of\r\nits affiliated units; define functions, tasks and operational regulations of\r\nits affiliated units for ensuring the apparatus’s operational effectiveness.
b) Make decisions on the structure and number of\r\nits employees, job positions; recruit, manage, use and develop public employees\r\nand contract employees on the basis of regulations and policies approved by The\r\nuniversity council in conformity with FTU’s development requirements; sign\r\nemployment contracts and labor contracts, manage, use and terminate such\r\ncontracts in accordance with law.
c) Sign labor contracts with domestic and foreign\r\nlecturers, scientists and managers to perform FTU’s teaching activities and\r\nscientific research, and satisfy requirements on training quality assurance.

- FTU must calculate and publicly announce specific\r\ntuition rates for groups of training disciplines and specialties, and training\r\nprograms before the enrollment, ensuring that the maximum tuition rate (of\r\ngeneral programs) shall not exceed FTU’s maximum tuition rate as prescribed in\r\nthis Decision.
- FTU shall make decision on the ceiling tuition\r\nrate of doctoral programs, master’s programs and college programs which shall\r\nbe, respectively, 2.5 times, 1.5 times and 0.8 times the maximum tuition rate\r\nstated above; the tuition rate of continuing education programs shall not\r\nexceed 1.5 times the tuition rate of full-time programs of the same level and\r\ngroup of training disciplines.
- FTU shall make decision on the tuition rate of\r\nspecial programs under the project on opening special programs approved by\r\nstate competent authorities.
- As for students who enrolled before the effective\r\ndate of this Decision, FTU shall increase the tuition rate as of the effective\r\ndate of this Decision provided that the maximum increase rate of the following\r\nacademic year shall not exceed 30% of the tuition rate of the previous academic\r\nyear.
b) Non-business revenues
FTU shall perform training support activities and\r\nservices to improve training quality and serve learners. Revenues from these\r\nactivities are determined on the principle of covering expenses and making\r\nreasonable accumulations. FTU shall publicly announce non-business revenues\r\nother than tuition as regulated.
c) Salaries and incomes
Apart from rank and grade-based salaries as\r\nprescribed by the State, FTU shall decide on additional incomes for its\r\nemployees by using the positive difference between revenues and expenses after\r\nsetting up regulated funds in accordance with its internal spending\r\nregulations, ensuring the impartiality and transparency.

- Exercise the autonomy in making plans and\r\ndecisions on using FTU’s lawful revenues to improve material facilities, train\r\nits personnel and ensure the quality of training and scientific research.
- After covering recurrent expenses, FTU’s\r\nremaining positive difference between revenues and expenses may be used to set\r\naside to the following funds: the fund for the development of non-business\r\nactivities (at least 25% of such different amount), the award fund, the welfare\r\nfund, the fund for income stabilization and student assistance funds.
- Collected tuition and other non-business revenues\r\nshall be deposited at commercial banks, and entire amount of interests of such\r\ndeposits shall be used to set aside student assistance funds.
4. Policies on scholarships and tuition
a) FTU shall support for the entire different\r\namount between its tuition rate and the reduced or exempted amount as regulated\r\nby State for students who are eligible for tuition reduction and exemption policies\r\nas regulated as of the enrolment course following the effective date of this\r\nDecision.
b) Other than students who are eligible for tuition\r\nreduction and exemption under State’s policies, FTU establishes and implement\r\npolicies on scholarship and study encouragement for students with excellent\r\nachievements and policy beneficiaries.
5. Investment and purchase
a) Actively balance revenues and mobilize other\r\nlawful sources; make decisions on investment, purchase and repair projects for\r\nthe overall development of FTU’s material facilities in conformity with\r\nregional and international standards.
b) Make decisions on the use of its assets,\r\nmaterial facilities and brand value for entering into joint ventures or\r\nassociations for carrying out scientific and technological activities, organize\r\nbusiness activities and provide services compatible with its professional\r\nfields; make decisions on letting out state-owned assets and using rental of\r\nsuch assets for carrying out educational and training activities, scientific\r\nresearch, providing consultancy and support to students in the following cases:\r\ncapacity of such assets is not fully used; assets are used as investments for\r\nperforming joint venture and cooperation activities under projects approved by\r\ncompetent authorities.

a) FTU amends, supplements and perfects its\r\nregulations, ensuring the openness and transparency; strengthen the university\r\ncouncil, ensure that the university council can work effectively and\r\nefficiently, and promote the democracy in conformity with the law. The\r\nuniversity council shall make decision on operational strategies and\r\norientations of FTU; supervise the implementation of resolutions made by the\r\nuniversity council, the execution of democracy regulations on its activities\r\nand the implementation of this Decision.
b) FTU shall publicly announce its internal\r\nspending regulations. FTU's internal spending regulations are approved at its\r\nmeeting of delegates of officials, public employees.
c) The board of people’s inspectors shall\r\nperiodically supervise and assess the compliance with the State and FTU's\r\nregulations on tasks, financial management and policies for its officials and\r\nlecturers.
d) FTU shall establish and publicly announce\r\nregulations on supervision of officials, lecturers, workers and learners on its\r\noperation.
7. FTU shall exercise other rights and obligations\r\nas regulated in the Government’s Resolution No. 77/NQ-CP dated October 24, 2014\r\non the pilot renovation of the operational mechanism of public tertiary\r\neducation institutions during 2014-2017 and other relevant documents.
Article 2. Implementation
1. Relevant ministries, regulatory bodies and local\r\ngovernments shall, within the ambit of their functions, tasks regulated in the\r\nGovernment’s Resolution No. 77/NQ-CP dated October 24, 2014 on the pilot\r\nrenovation of the operational mechanism of public tertiary education\r\ninstitutions during 2014-2017 and other relevant documents, perform the\r\nsupervision and give assistance to FTU during the implementation of this\r\nDecision.
2. Relevant state authorities shall provide\r\nguidance and assistance to FTU during the execution of its investment projects.
Article 3. This decision takes effect from\r\nthe day on which it is signed.
