APPROVING THE SCHEME\r\nON PILOT INNOVATION OF OPERATIONAL MECHANISM OF THE NATIONAL ECONOMICS\r\nUNIVERSITY DURING 2015 - 2017

THE PRIME MINISTER

Pursuant to the Law on Organization of the\r\nGovernment dated December 25, 2001;

Pursuant to the Law on Education dated June 14,\r\n2005 and the Law on amendments to the Law on Education dated November 25, 2009;

Pursuant to the Law on Higher Education dated\r\nJune 18, 2012;

Pursuant to the Government’s Decree No.\r\n49/2010/ND-CP dated May 14, 2010; the Government’s Decree No. 74/2013/ND-CP\r\ndated July 15, 2013 amending certain articles of the Government’s Decree No.\r\n49/2010/ND-CP dated May 14, 2010 on reduction and exemption of tuition fees,\r\nsupport for learning cost, collection and use of tuition fees applicable to\r\neducational institutions belonging to the national education system from the\r\n2010 – 2011 academic year to the 2014 – 2015 academic year;

Considering the request of the President of the\r\nNational Economics University,

DECIDES:

Article 1. To approve the Scheme on pilot\r\ninnovation of the operational mechanism of the National Economics University\r\nduring 2015 – 2017 (referred to as the Scheme) with the following principal\r\ncontents:

I. OBJECTIVES

1. General objectives

The National Economics University (referred to as\r\n“NEU”) shall actively, reasonably and effectively utilize its resources to\r\ninnovate and improve its operational quality, and strive for a tertiary\r\neducation institution with academic research orientations in conformity with\r\nregional and international standards; and provide opportunity to approach NEU’s\r\ntraining programs for students with difficult circumstances and social policy\r\nbeneficiaries.

2. Specific objectives

a) Establish and develop the NEU’s organizational\r\nstructure and personnel under the model of a tertiary education institution\r\nwith modern academic research orientations; apply standards on quality\r\nmanagement system and information technology applications to manage NEU in a\r\ncomprehensive manner, ensure the managerial and leading capacity, and effective\r\nmanagement.

b) Continue to improve the scientific research and\r\ntraining quality in the way of adapting to international integration; ensure\r\nthat learners shall be equipped and provided with professional knowledge, skill\r\ntraining and improvement of professional ethics and characters as committed by\r\nthe NEU for meeting social needs.

d) Develop training scale in a reasonable way;\r\ncarry out changes of training structure by attaching special importance to\r\nhigh-quality programs, advanced programs and training programs using foreign\r\nlanguages.

dd) Fulfill the social responsibility of a key\r\npublic tertiary education institution with scholarship policies, facilitating\r\nstudents with difficult circumstance and policy beneficiaries in getting\r\nopportunity to study at NEU.

e) Use state funding in effective way and mobilize\r\nsources from the society, ensuring strong financial capacity, spacious and\r\nmodern facilities according to NEU's development plans.

II. INNOVATION CONTENTS

1. Performance of scientific research and training\r\nduties

a) Make decisions on opening training disciplines\r\nand specialties in undergraduate level, master’s level and doctoral level to\r\nmeet social needs in conformity with the NEU’s development orientations when\r\nfully satisfying conditions prescribed by law.

b) Determine enrollment quotas and organize the\r\nenrollment under NEU's enrollment plan in a transparent manner, and implement\r\nthe enrollment priority policy as regulated.

c) Make decisions on training activities (training\r\nprograms, teaching methods; languages; methods of examination and testing to\r\nassess learning results; textbooks, learning materials and management of\r\ntraining; printing, issuance and management of diplomas and certificates);\r\nensure the graduate quality as committed by NEU.

d) Carry out the educational quality accreditation\r\nas regulated; conduct quality accreditation by international organizations step\r\nby step.

e) Make decisions on scientific research\r\nactivities; encourage the application and transfer of scientific research\r\nresults while taking into account the market demands and social needs; make\r\ndecisions on participation in scientific and technological tasks, scientific\r\nand technological services, and organization of seminars in coordination with\r\ndomestic and foreign entities.

g) Provide public non-business services in the\r\nfields of education and training, and science and technology, including those under\r\norders placed by the State.

2. Organizational apparatus

a) Decide and assume responsibility for the\r\nestablishment, re-structuring, merger, division, separation and dissolution of\r\nits affiliated units; define functions, tasks and operational regulations of\r\nits affiliated units for ensuring the apparatus’s operational effectiveness.

b) Make decisions on the structure and number of\r\nits employees, job positions; recruit, manage, use and develop public employees\r\nand contract employees on the basis of regulations and policies approved by the\r\nuniversity council in conformity with NEU’s development requirements; sign\r\nemployment contracts and labor contracts, manage, use and terminate such\r\ncontracts in accordance with law.

c) Sign labor contracts with domestic and foreign\r\nlecturers, scientists and managers to perform NEU’s teaching activities and\r\nscientific research, and satisfy requirements on training quality assurance.

3. Finance

a) Tuition

- NEU shall stably collect tuition in accordance\r\nwith the plan stated in the following scheme:

- The ceiling tuition rate of doctoral programs and\r\nmaster’s programs shall be, respectively, 2.5 times and 1.5 times the maximum\r\ntuition rate stated above; the tuition rate of continuing education programs\r\nshall not exceed 1.5 times the tuition rate of full-time programs of the same\r\nlevel and group of training disciplines.

- NEU shall make decision on the tuition rate of\r\nspecial programs under the project on opening special programs approved by\r\nstate competent authorities.

- As for students who enrolled before the effective\r\ndate of this Decision, NEU shall increase the tuition rate as of the effective\r\ndate of this Decision provided that the maximum increase rate of the following\r\nacademic year shall not exceed 30% of the tuition rate of the previous academic\r\nyear.

b) Non-business revenues

NEU shall perform training support activities and\r\nservices to improve training quality and serve learners. Revenues from these\r\nactivities are determined on the principle of covering expenses and making\r\nreasonable accumulations.

c) Salaries and incomes

 Apart from rank and grade-based salaries as\r\nprescribed by the State, NEU shall decide on additional incomes for its\r\nemployees by the positive difference between revenues and expenses after\r\nsetting up funds as regulated under its internal spending regulations, ensuring\r\nthe impartiality, openness and transparency.

d) Use of revenues

- Exercise the autonomy in making plans and\r\ndecisions on using NEU’s lawful revenues to improve material facilities, train\r\nits personnel and ensure the quality of training and scientific research.

- Collected tuition and other non-business revenues\r\nshall be deposited at commercial banks, and entire amount of interests of such\r\ndeposits shall be used to set aside student assistance funds.

4. Policies on scholarships and tuition

a) NEU shall support for the entire difference\r\nbetween its tuition rate and the reduced or exempted amount as regulated by\r\nState for students who are policy beneficiaries and poor students as of the\r\nenrolment course following the effective date of this Decision.

b) Other than students who are eligible for tuition\r\nreduction and exemption under State’s policies, NEU establishes and implements\r\npolicies on scholarship and study encouragement for students with excellent\r\nachievements and policy beneficiaries.

5. Investment and purchase

a) Actively balance sources of revenues and\r\nmobilize other lawful sources; make decisions on investment, purchase and\r\nrepair projects for the overall development of NEU’s material facilities in\r\nconformity with regional and international standards.

b) Make decisions on the use of NEU’s assets,\r\nmaterial facilities and brand value for entering into joint ventures or\r\nassociations for carrying out scientific and technological activities,\r\norganizing and providing services compatible with its professional fields.

c) Continue the execution of the investment project\r\non Central Training School of the National Economics University under the\r\nDecision approved by the Minister of Education and Training (Decision No.\r\n4422/QD-BGDDT dated October 10, 2014).

6. Regulations on supervision

b) NEU shall publicly announce its internal\r\nspending regulations. NEU’s internal spending regulations shall be annually\r\namended and supplemented by means of taking opinions in the whole university,\r\nand approved at the meeting of delegates of its officials, and public\r\nemployees.

c) NEU shall publicly announce regulations on\r\nsupervision of lecturers, officials, public employees and learners on the operation\r\nof NEU’s leading apparatus.

7. NEU shall exercise other rights and obligations\r\nas regulated in the Government’s Resolution No. 77/NQ-CP dated October 24, 2014\r\non the pilot renovation of the operational mechanism of public tertiary\r\neducation institutions during 2014-2017 and other relevant documents.

Article 2. Implementation

1. Relevant ministries, regulatory bodies and local\r\ngovernments shall, within the ambit of their functions, tasks regulated in the\r\nGovernment’s Resolution No. 77/NQ-CP dated October 24, 2014 on the pilot\r\nrenovation of the operational mechanism of public tertiary education\r\ninstitutions during 2014-2017 and other relevant legislative documents, perform\r\nthe supervision and give assistance to NEU during the implementation of this Decision.

2. Relevant state authorities shall continue to\r\nprovide guidance and assistance to NEU on the execution and completion of NEU’s\r\ninvestment projects.

Article 3. This decision takes effect from\r\nthe day on which it is signed.

Article 4. Ministers, Heads of\r\nministerial-level agencies, Chairpersons of People’s Committees of provinces\r\nand central-affiliated cities, President of NEU, heads of relevant\r\norganizations and relevant individuals shall implement this Decision./.
