DECISION
APPROVING THE SCHEME\r\nON PILOT INNOVATION OF OPERATIONAL MECHANISM OF THE UNIVERSITY OF ECONOMICS HO\r\nCHI MINH CITY DURING 2014 - 2017
THE PRIME MINISTER
Pursuant to the Law on the Organization of the\r\nGovernment dated December 25, 2001;
Pursuant to the Law on Education dated June 14,\r\n2005 and the Law on amendments to the Law on Education dated November 25, 2009;
Pursuant to the Law on Higher Education dated\r\nJune 18, 2012;
Pursuant to the Government’s Decree No.\r\n49/2010/ND-CP dated May 14, 2010; the Government’s Decree No. 74/2013/ND-CP\r\ndated July 15, 2013 amending certain articles of the Government’s Decree No.\r\n49/2010/ND-CP dated May 14, 2010 on reduction and exemption of tuition fees,\r\nsupport for learning cost, collection and use of tuition applicable to educational\r\ninstitutions belonging to the national education system from the 2010 – 2011\r\nacademic year to the 2014 – 2015 academic year;
Pursuant to the Government’s Resolution No.\r\n77/NQ-CP dated October 24, 2014 on pilot renovation of the operational mechanism\r\nof public tertiary education institutions during 2014-2017;

DECIDES:
Article 1. To approve the Scheme on the\r\npilot innovation of the operational mechanism of the University of Economics Ho\r\nChi Minh City during 2014 – 2017 (referred to as the Scheme) with the following\r\nprincipal contents:
I. Objectives
1. General objectives
The University of Economics Ho Chi Minh City\r\n(referred to as “UEH”) shall actively, reasonably and effectively utilize its\r\nresources to innovate and improve its operational quality in terms of training,\r\nscientific research, organizational apparatus and personnel, and reduction of\r\nfunding from state budget; and provide opportunity to approach UEH’s training\r\nprograms for poor students and social policy beneficiaries.
2. Specific objectives
a) Improve training quality, ensuring that learners\r\nare trained to meet standards of graduate quality as committed by UEH; are\r\nprovided with the opportunity of approaching scientific and technological\r\napplications; and are provided with skill training and improvement of\r\nprofessional ethics.
b) Develop training programs by referring training\r\nprograms provided by the world’s modern tertiary education institutions for\r\nmeeting social needs.
c) Develop training scale in a reasonable way in\r\nconformity with UEH’s sources; attach special importance to high-quality\r\ntraining programs and ordered programs.

dd) Strengthen the international cooperation for\r\nsupporting and stepping up UEH's training activities and scientific research.
e) Evolve UEH’s organizational structure and\r\npersonnel under the model of the world’s modern tertiary education institution;\r\nrevise procedures and apply information technology to the quality management\r\nsystem for improving UEH’s managerial capacity; create environment and\r\nconditions for developing UEH’s potentials and strengths in the best way.
g) Fulfill the social responsibility of the\r\nnational’s key public tertiary education institution with scholarship and study\r\nencouragement policies and student credit policies; facilitate poor students,\r\nsocial policy beneficiaries and student with difficult circumstance in getting\r\nopportunity to study at this university.
II. Innovation\r\ncontents
1. Performance of scientific research and training\r\nduties
a) Establish and perform training programs,\r\nensuring qualifications and skills of graduates; ensure that its lecturers,\r\nmanagers, textbooks, learning materials and facilities shall satisfy\r\nrequirements as regulated.
b) Actively open bachelor's programs, master's\r\nprograms and doctoral programs in conformity with the UEH’s lecturers, managers\r\nand facilities to meet the needs of the society.
c) Carry out the educational quality accreditation\r\nin accordance with regulations on quality accreditation of tertiary education\r\ninstitutions for the purpose of ensuring training quality.
d) Make plans on enrolment in accordance with\r\nrequirements and schedules of the Ministry of Education and Training and in\r\nconformity with the social needs.

e) Exercise the autonomy in scientific research;\r\ndetermine scientific research duties and appoint entities to perform scientific\r\nresearch duties.
g) Exercise the autonomy in organizing educational\r\nassociation programs (with issuance of diplomas), research and development with\r\nforeign partners.
2. Organizational apparatus
a) Define functions and tasks of UEH's affiliated\r\nunits through its operational and operation regulations; decide and assume\r\nresponsibility for the establishment, merger, division, separation and\r\ndissolution of UEH’s affiliated units for ensuring the apparatus’s operational\r\neffectiveness.
b) Carry out the recruitment on the basis of\r\nproject on job positions approved by the university council; ensure the\r\nopenness, transparency, impartiality, objectiveness and compliance with the\r\nlaw; and ensure the competitiveness while taking into account the preference\r\nfor priority objects as regulated.
3. Finance
a) Tuition
- UEH shall collect tuition on the stable basis in\r\naccordance with the plan stated in the following scheme:

- UEH must calculate and publicly announce specific\r\ntuition rates for groups of training disciplines before the enrollment,\r\nensuring that the average tuition rate (of general programs) shall not exceed\r\nUEH’s maximum tuition rate as prescribed in this Decision.

b) Non-business revenues
UEH shall perform training support activities and\r\nservices to improve training quality and serve learners. Revenues from\r\nthese activities are publicly announced on the basis of taking revenues to\r\noffset expenses without accumulations.
c) Salaries and incomes
Apart from rank and grade-based salaries as\r\nprescribed by the State, UEH shall decide on additional incomes for its\r\nemployees by using the positive difference between revenues and expenses under\r\nits internal spending regulations on the grounds of impartiality and\r\ntransparency.
d) Use of revenues
- Exercise the autonomy in making plans and\r\ndecisions on using UEH’s lawful revenues to invest in facilities as regulated\r\nby the government.
- After covering recurrent expenses, UEH’s\r\nremaining positive difference between revenues and expenses may be used to set\r\naside to the following funds: the fund for the development of non-business activities,\r\nthe award fund, the welfare fund, the fund for income stabilization and student\r\nassistance funds.
- Collected tuition and non-business revenues shall\r\nbe deposited at commercial banks.
4. Policies on scholarships and tuition

b) Other than students who are eligible for tuition\r\nreduction and exemption under State’s policies, UEH establishes and implements\r\npolicies on scholarship and study encouragement for students with excellent\r\nachievements and policy beneficiaries.
5. Investment and purchase
a) Actively balance sources of revenues and mobilize\r\nother lawful sources for promoting the overall development of UEH’s facilities\r\nunder the model of the world’s modern tertiary education institution.
b) Continue the execution of UEH’s investment\r\nprojects under the Decision on approving investment projects with funds from\r\nstate budget and UEH’s accumulations by the Minister of Education and Training\r\n(Decision No. 3971/QD-BGDDT dated September 26, 2014).
6. Regulations on supervision
a) The university council shall make decision on\r\noperational strategies and orientations of UEH; supervise the implementation of\r\nresolutions made by the university council, the execution of democracy\r\nregulations on its activities and the implementation of this Decision.
b) UEH shall publicly announce its internal\r\nspending regulations. UEH’s internal spending regulations shall be annually\r\namended and supplemented by means of taking opinions in the whole university,\r\nand approved at the meeting of delegates of its officials and public employees.
c) UEH shall publicly announce regulations on\r\nsupervision of lecturers, officials, public employees and learners on the\r\noperation of UEH’s leading apparatus.
7. UEH shall exercise other rights and obligations\r\nas regulated in the Government’s Resolution No. 77/NQ-CP dated October 24, 2014\r\non the pilot renovation of the operational mechanism of public tertiary\r\neducation institutions during 2014-2017 and other relevant documents.

1. Relevant ministries, regulatory bodies and local\r\ngovernments shall, within the ambit of their functions and tasks regulated in\r\nthe Government’s Resolution No. 77/NQ-CP dated October 24, 2014 on the pilot\r\nrenovation of the operational mechanism of public tertiary education\r\ninstitutions during 2014-2017 and other relevant legislative documents, perform\r\nthe supervision and give assistance to UEH during the implementation of this\r\nDecision.
2. Relevant state authorities shall continue to\r\nprovide guidance and assistance to UEH on the performance and completion of\r\nUEH’s investment projects.
Article 3. This decision takes effect as of\r\nJanuary 01, 2015.
Article 4. Ministers, Heads of\r\nministerial-level agencies, Heads of Government’s agencies, Chairpersons of\r\nPeople’s Committees of provinces and central-affiliated cities, heads of\r\nrelevant organizations and relevant individuals shall implement this\r\nDecision./.
