RESOLUTION
POLICIES SUPPORTING MANAGERIAL OFFICIALS, TEACHERS, AND EMPLOYEES OF NON-PUBLIC PRESCHOOLS AND PRIMARY EDUCATION INSTITUTIONS FACING DIFFICULTIES DUE TO COVID-19
THE GOVERNMENT
Pursuant to Law on Governmental Organization dated June 19, 2015; Law on amendments to Law on Government Organization and Law on Local Governmental Organization dated November 22, 2019;
Pursuant to Decree No. 39/2022/ND-CP dated June 18, 2022 of Government on operational regulations of the Government;
Pursuant to Resolution No. 30/2021/QH15 dated July 28, 2021 of the National Assembly in the 1st Meeting of the 15th National Assembly;
Pursuant to Resolution No. 12/NQ-CP dated January 30, 2022 of the Government on periodic Government Meeting in January 2022;
At request of the Minister of Education and Training under Presentation No. 582/TTr-BGDDT dated May 31, 2022.

Given the impact of COVID-19 on education sector, especially non-public preschool and primary education levels, Government hereby resolves to implement policies to assist managerial officials, teachers, and employees of non-public preschools and primary education institutions who face difficulties due to COVID-19 as follows:
I. OBJECTIVES AND PRINCIPLES
1. Objectives
Support managerial officials, teachers, and employees of non-public preschools and primary education institutions who face difficulties due to COVID-19, stabilize workforce, prevent disruption of supply of experienced personnel for non-public preschools and primary education institutions, ensure safety for children and parents, partly allow enterprises to restore production, contribute towards socio-economic development, and ensure social life and security.
2. Principles:
a) Ensure that benefits are offered to the right beneficiaries in a public, transparent manner and without exploitation.
b) Facilitate administrative procedures to allow managerial officials, teachers, employees, and non-public preschools and primary education institutions to access the policies with ease.
c) Do not support individuals who have benefited from policies assisting employees on suspension of employment contracts or unpaid leaves in accordance with Clauses 4, 5, 6 Section II of Resolution No. 68/NQ-CP dated July 1, 2021 and Resolution No. 126/NQ-CP dated October 8, 2021 of the Government; do not support individuals who waive the benefits. If an individual is eligible for multiple support policies, only the highest benefits shall prevail.
d) Ensure feasibility and effectiveness of policies and resources for implementation.

e) State budget support is implemented as follows:
Provinces and cities that send 60% of their revenues to central government budget shall fund implementation by themselves.
Central government budget shall finance implementation of other provinces and cities based on the following rules:
- Central government budget shall finance 80% of the support under this Resolution in case of mountainous provinces and the central highlands.
- Central government budget shall finance 60% of the support under this Resolution for provinces that have not been able to balance their budget (other than mountainous provinces and the central highlands).
- Central government budget shall finance 40% of the support under this Resolution for remaining provinces and cities.
Provinces and central-affiliated cities shall utilize 50% of provision of local government budgets (provincial, district, and commune level) and 70% of local financial reserve fund to implement in accordance with principles and policies hereunder.
II. SUPPORT
1. Beneficiaries: Managerial officials, teachers, and employees of private preschools; private primary education institutions; SOS preschools, Hermann Gmeiner primary schools in Vietnamese SOS Village network licensed for establishment and operation by competent authorities and mandated to suspend operation at request of competent authorities for COVID-19 control (hereinafter referred to as “non-public education institutions”).

- They are working in non-public education institutions before the institutions are mandated to suspend by competent authorities to serve COVID-19 control from May 1, 2021 to December 31, 2021 inclusive;
- They are taking unpaid leave for at least 1 month from May 1, 2021 to December 31, 2021 inclusive;
- They have not benefited from policies supporting employees on suspension of employment contracts or unpaid leave in accordance with Clauses 4, 5, and 6 Section II of Resolution No. 68/NQ-CP since they have not participated in compulsory social insurance;
- They are confirmed to be working in non-public education institutions (including previous non-public education institutions or other non-public education institutions if previous non-public education institutions cease to operate) at least until the end of the school year of 2021 - 2022.
3. Support
- A lump-sum support of 3.700.000 VND/person is available for managerial officials, teachers, and employees who have not received support from local governments for employees who are not working under employment contracts and other specific beneficiaries according to Clause 12 Section II of Resolution No. 68/NQ-CP;
- A lump-sum support of 2.200.000 VND/person is available for managerial officials, teachers, and employees who have benefited from policies of local governments in accordance with Clause 12 Section II of Resolution No. 68/NQ-CP.
4. Implementation duration: until the end of December 31, 2022.
III. ORGANIZING IMPLEMENTATION

a) Take charge and cooperate with relevant authorities in requesting Prime Minister to promulgate Decision to implement contents under Section II hereof following simplified procedures.
b) Take charge and cooperate with relevant authorities in inspecting and mobilizing implementation of the Resolution, promptly requesting Government and Prime Minister to resolve arising difficulties.
2. Ministry of Finance shall
a) Guarantee state budget sources to implement policies under this Resolution.
b) Rely on this Resolution, relevant regulations, and expenses of provinces and cities (verified by the State Treasury) to consider and promptly provide support from central government for each province and city, conclude and report to the Prime Minister.
c) If local government budget is insufficient, based on request of provincial People’s Committees, Ministry of Finance shall allocate up to 70% of the requested support from central government budget to local government budget to facilitate timely implementation of the policy. Once local governments have produced reports on budget expenditure (expenditure of state budget confirmed by State Treasury; report figures under responsibilities of local government), Ministry of Finance shall add or revoke central government estimates on the basis of actual implementation; consolidate and report to Prime Minister.
3. People’s Committees of provinces and central-affiliated cities shall
a) Direct field-specific authorities and People’s Committees of all levels to verify and approve list of individuals eligible for support under Section II hereof; organize timely, effective, transparent, proper implementation and prevent exploitation of the policies.
b) Use finding sources of local government to support 1.500.000 VND/person in case of managerial officials, teachers, and employees who have not benefited from policies in accordance with Clause 12 Section II of Resolution No. 68/NQ-CP and implement policies under Section II hereof; produce reports on implementation results to Ministry of Finance.

4. Request Central Committee of Vietnamese Fatherland Front, Vietnam General Confederation of Labor, and socio-political organizations to publicize, cooperate in implementation, and supervise implementation hereof.
5. Ministers, heads of ministerial agencies, heads of Governmental agencies, Chairpersons of People’s Committees of provinces and central-affiliated cities are responsible to the Government and Prime Minister for implementation and implementation results hereof.
