CIRCULAR

ANNULMENT OF SOME LEGISLATIVE DOCUMENTS PROMULGATED BY THE MINISTER OF HEALTH

Pursuant to the Law on Promulgation of Legislative Documents dated June 22, 2015 and the Law dated June 18, 2020 on Amendments to the Law on Promulgation of legislative documents;

Pursuant to the Government’s Decree No. 34/2016/ND-CP dated May 14, 2016 elaborating some Articles of the Law on Promulgation of Legislative Documents; the Government’s Decree No. 154/2020/ND-CP dated December 31, 2020 on amendments to Decree No. 34/2016/ND-CP;

Pursuant to the Government’s Decree No. 95/2022/ND-CP dated November 15, 2022 on functions, tasks, powers and organizational structure of the Ministry of Health;

At the request of the Directors of the Department of Legislation, Department of Medical Equipment and Works, Department of Maternal Health and Children, Traditional Medicine Administration of Vietnam,

The Minister of Health promulgates a Circular on annulment of some legislative documents promulgated by the Minister of Health.

Article 1. Annulment of the entirety of 03 legislative documents promulgated by the Minister of Health

2. Circular No. 31/2019/TT-BYT dated December 05, 2019 of the Minister of Health on requirements for fresh dairy products used for the School Million Program.

3. Circular No. 14/2020/TT-BYT dated July 10, 2020 of the Minister of Health on medical device bidding at public health facilities.

Article 2. Effect

This Circular comes into effect from the day on which it is signed.

Article 3. Transition clauses

The contract packages for procurement of medical devices for which the contractor selection plans have been approved before the effective date of this Circular may continue to be carried out in accordance with Circular No. 14/2020/TT-BYT dated July 10, 2020 of the Minister of Health on medical device bidding at public health facilities, or have their relevant contents revised in accordance with applicable regulations on bidding.

Article 4. Responsibility for implementation

The Chief of the Ministry Office, the Ministerial Chief Inspector, the Directors of the Department of Legislation, Department of Medical Equipment and Works, Department of Maternal Health and Children, Traditional Medicine Administration of Vietnam, heads of units of and affiliated to the Ministry of Health, Directors of Departments of Health of provinces and cities, relevant organizations and individuals are responsible for the implementation of this Circular./.
