DECISION

ON APPROVAL FOR PLANNING FOR CONSTRUCTION OF SYSTEM OF HEAD OFFICES OF MINISTRIES, MINISTERIAL-LEVEL AGENCIES, GOVERNMENTAL AGENCIES, CENTRAL AGENCIES OF UNIONS IN HANOI CAPITAL BY 2030

THE PRIME MINISTER

Pursuant to the Law on Government Organization June 19, 2015; the Law on amendments to the Law on Organization of Government and the Law on Organization of Local Governments dated November 22, 2019;

Pursuant to the Law on Urban Planning dated June 17, 2009; the Law on amendments to 37 laws related to planning dated November 20, 2018;

Pursuant to the Construction Law dated June 18, 2014; the Law on amendments to the Construction Law dated June 17, 2020;

Pursuant to the Law on Capital dated November 21, 2012;

Pursuant to Decision No. 837/QD-TTg dated June 4, 2014 of the Prime Minister on approval for the task of planning the construction of a system of head offices of ministries, ministerial-level agencies and Governmental agencies, central agency of mass organizations in Hanoi capital by 2030; Decision No. 658/QD-TTg dated May 19, 2020 of the Prime Minister on approval for the task of planning the construction of a system of head offices of ministries, ministerial-level agencies and Governmental agencies, central agency of mass organizations in Hanoi capital by 2030;

At the proposal of the Minister of Construction.

HEREBY DECIDES:

Article 1.Approve the Master plan on construction of a cluster of head offices of ministries, ministerial-level agencies, Governmental agencies, central agencies of mass organizations in Hanoi capital by 2030 (including Detailed planning of 1/500 scale of the cluster of head offices of ministries and central agencies (hereinafter referred to as the cluster of head offices) located in West Ho Tay area and Detailed planning of 1/500 scale of cluster of head offices of ministries and central agencies located in Me Tri area) with the main content is as follows:

1. Planning objectives:

- Build a system of head offices that meet regulations, standards, synchronous and modern conditions, and meet the working conditions of ministries and central agencies in Hanoi capital;

- Improve the working efficiency of the administrative apparatus, meet the requirements of socio-economic development, gradually contribute to streamlining the administrative apparatus, building a modern, synchronous e-Government;

- Contribute to urban rearrangement and reducing the overload for the urban area of Hanoi;

- Form the legal basis for execution of projects on construction of head offices and works related to the planning area.

a) The system of head offices of ministries and central agencies in Hanoi capital:

- The scope of the planning is the head offices of 18 ministries, 04 ministerial-level agencies, 08 Governmental agencies, and 06 central agencies of mass organizations located within the administrative boundaries of Hanoi capital.

- The object of direct research to forecast the size of offices of ministries, ministerial-level agencies, Governmental agencies, and central agencies of mass organizations is administrative agencies, including: ministry offices and departments; functional inspectorates, advisory agencies to the leadership of ministries.

b) Detailed planning of 1/500 scale of the cluster of head offices in West Ho Tay and Me Tri:

- The scale of Detailed planning with scale 1/500 of the cluster of head offices which is located in West Ho Tay area about 35 ha (the area in Xuan La ward, Tay Ho district is about 20.7 ha and Xuan Tao ward, Bac Tu Liem district is about 14.3 ha);

- The scale of Detailed planning with scale of 1/500 of the cluster of head offices which is located in Me Tri area about 55 ha (the area in Me Tri ward, Nam Tu Liem district is about 43.6 ha and Trung Van ward, Nam Tu Liem district is about 11.4 ha).

3. Planning on the system of head offices of ministries and central agencies:

The planned system of head offices includes head offices that are stably located (settled head offices), which are ministries and agencies with specific requirements that already have stable physical facilities and meet working conditions; and agencies that have relocated and rebuilt facilities recently; and agencies that have been newly rebuilt in clusters of agencies.

The system of head offices includes renovated head offices in the urban area, newly built head offices in Cau Giay and Tu Liem areas and 2 clusters of head offices located in West Ho Tay area and Me Tri area.  In the clusters of head offices, it is necessary to arrange reserve land for development for long-term needs.

As for settled head offices, they may be renovated or rebuilt on the premises to meet working requirements.  The system of these head offices must comply with the regulations on architectural planning of the area in terms of density, height, land use coefficient and requirements on the form of landscape architecture in the area.  Agencies with specific activities may make their own planning for head offices to suit operational requirements.

As for newly built head offices, in the process of use, maintenance and repair are taken to form the architecture of head offices of state agencies. Gradually add public utilities to serve officials and visitors coming for work. Planning indicators are kept according to the master plans that have been prepared and approved.

Newly built head offices in clusters of head offices are fully equipped with public utilities and have to conform to architectural planning strictly to create a representative image for administrative agencies of central governments. Head offices in the cluster of head offices will have uniform architecture and have common public utilities, conferences, seminars, guest houses, parking lots, etc.

4. Detailed planning of 1/500 scale of the cluster of head offices in West Ho Tay:

a) Location, boundaries and size of the cluster of head offices in West Ho Tay area:

The planning area under the project of the West Ho Tay center area that has been approved by the Hanoi People's Committee with a detailed planning of 1/500 scale (except for the cluster of head offices of the ministries and central agencies which has been implemented under a separate project), and the surrounding area that is in the initiation stage.  The planned land zone in the administrative boundaries of Xuan La ward, Tay Ho district and Xuan Tao ward, Bac Tu Liem district, Hanoi city.

The planning land plot about 35 ha (the area in Xuan La ward, Tay Ho district is about 20.7 ha and the area in Xuan Tao ward, Bac Tu Liem district is about 14.3 ha).

b) Landscape architecture spatial organization:

The cluster of head offices creates an axis that connects with Ho Tay and creates an impressive and highlight space complex for urban space.  Maintain the axis of open space to serve the officials and people in the area in accordance with the approved General Planning for Construction of Hanoi Capital.

The open space axis is in the middle of the land lot, connects the East and the West, includes a water route with gently curving paths, wide open walkways on both sides, arrange public utilities for officials, visitors and the people in the area. During office hours, limit the people to use the open space axis so as to limit the noise that affects administrative activities, and in the evening, it can be organized into a lively pedestrian street, serving the community. The open space axis is the pedestrian axis, mainly accessible by officials who regularly use public transport.

Each ministry and agency head office is arranged on each land lot, which is combined from many architectural works to create a lively, rhythmic complex, with space for trees, related to neighboring architectural works.  The connection of three-dimensional structure, facades, and general architectural styles of buildings will create a harmonious architectural complex.  The building density is about 40% of the land lot and the gross density is about 20%, the first floor is expanded open to facilitate circulation and travel.

Modern building architecture, application of science and technology, green architectural solutions create environmental efficiency and ensure sustainability in the future. The architectural form ensures the characteristics of state administrative agencies.

Maximize the use of trees and gardens in conjunction with water surface axis to create a beautiful and ecologically sustainable environment for the cluster of head offices. The landscape surrounding the cluster of head offices is a key highlight and an integral part of the future image of West Ho Tay urban area.

Develop an interconnected system of underground spaces to accommodate parking needs, and include key technical infrastructure (power supply and booster pumping stations, wastewater treatment facilities, temporary solid waste center, etc.). Apply aesthetic treatments to infrastructure works on the ground to achieve both beautiful appearance and comfort for the cluster of head offices.

Integrate architectural design solutions and application of science and technology to ensure security and safety for each building of the head offices of ministries and agencies in accordance with special requirements of the central authorities.

c) Master plan for land use:

Arrange the following types of land in the planned land zone of about 35 ha: land for agencies and offices (12 agencies, 01 back-up agency); land for public and service works; land and trees, squares, parks, walkways, overpasses, water surface and roads.  The specific land use indicators are as follows:

- Land for offices and offices:  Including land plots with symbols B1 - B5, B7, B8, B10, B12 - B16; land for office is 143,006 m2, accounting for 41.0% of the planned land zone; the building has 12 to 25 floors above ground and 2 to 5 floors below ground, maximum building density is 40 - 50%; the gross floor area is about 435,000 m2; the number of people working is about 14,500.

- Land for trees, squares, parks, walkways, overpasses, water surface:  Including land plots with symbols X1-X3 with area of 120,099 m2, accounting for 34.4% of the planned land zone; the building has 1 floor above ground, maximum building density is 10%. On the land designated for trees and water surface, public works are set up to benefit both the cluster of head offices and locals.

- Land for roads: The land area is 37,072 m2, accounting for 10.6% of the planned land zone.

d) Technical infrastructure system planning:

- Traffic planning:

The internal traffic network within the designated land zone is connected to the shared infrastructure roads of center West Ho Tay, including: Xuan Tao street, Vo Chi Cong street, Hoang Minh Thao street and a road with a width of 40 m.

Strictly control connection points to ensure smooth operation of means of transport, avoiding conflicts and traffic jams that may affect the functioning of the cluster of head offices .  The width of the internal roads in the planned land zone is from 15 - 24 m.

Promote the use of urban public transport, including the railway and bus network, to create a convenient mode of transportation for commuting to and from the city. This will help reduce the reliance on personal vehicles.

Provide underground parking with 2-5 floors and at-grade parking in the head offices to cater to the parking needs of officials and visitors.

- Ground leveling planning:

The ground level of the plots has been designed to facilitate natural drainage in line with the land use planning and drainage distribution of the plots.

- Rainwater drainage planning:

Choose a drainage system that operates in self-flow mode. The surface water drainage system in this zone is connected to the sewer system that runs along four surrounding roads. The water is then drained to the Co Nhue ditch to the west.

Plan to install a box culvert system along the land plots that are expected to be allocated to ministries and agencies. The dimensions of the culvert should vary from 0.6x0.6m to 1.0x1.0m, and it should be connected to the sewers located on the four surrounding roads. Design a rainwater harvesting system that incorporates wells and manholes with dimensions of 30-50 meters each.

- Water supply:

The total demand for water supply is about 2,200 m3/day.  The water supply will come from two expected pipelines, one with a diameter of 150 mm located in the West and another with the same diameter located in the South. Both pipelines will be connected to a larger transmission pipeline with a diameter of 400 mm.

The local water supply network in the head office zone has a pipe diameter of 100mm, which connects to the expected water pipelines of 150mm in the West and South directions.

The head offices receive water through connection points with a diameter of 100 mm, which are directly connected to the local pipeline of 150 mm in diameter.

Place the fire hydrant on the water supply pipe that has a diameter of D100 mm or more. The distance between fire hydrants is 150 m. When designing a building, it is essential to include a separate firewater supply system to ensure the sufficient water supply for the building's fire-fighting needs.

The power supply demand is about 21MW. The main power supply from the Nhat Tan 110KV station in the Northeast has a capacity of 3x63MVA.

Build a new 22KV underground cable line from Nhat Tan 110KV substation to supply power to low voltage substations in the area.  The underground cable route within the boundary for research and design runs through the utility trench, on the sidewalk.  The distance between the top of the trench cover and the pavement surface must be at least 0.3 m, and at least 0.7 m between the top of the trench cover and the road surface. A manhole must be installed at intersections, diversions, and straight lines, with a maximum distance of 100 meters between them.  

Construct new substations for buildings of ministries and agencies in the research and design zone, as well as one public lighting substation to provide electricity to the area.  The substation is either located in the green space of the building or in the basement.

0.4KV low voltage network and lighting:  To be installed underground in utility trenches located on sidewalks of planned roads, as well as in internal roads and yards of construction works and clusters of construction works.

- Communication planning:

The planned land zone has a total subscriber demand of approximately 15,000 lines. Trunk cable lines will be built from the remote subscriber switch (RSS) to connect the subscriber cable cabinets. Trunk cable lines are placed in utility trenches.

Each building of the ministry or branch will have 1 cabinet.  Telephone cable cabinets can be placed alongside substations and low voltage power supply cabinets.

Fiber optic lines will be installed from the cable cabinets to each subscriber's location. Fiber optic lines are placed in the same utility trenches as low voltage power and lighting cables.

- Waste water collection and treatment:

Build 4 modular wastewater treatment facilities, each with a capacity of 300-400 m3. The exact location and capacity of each facility will be determined during the planning phase of the ministry/agency's head offices construction project. The wastewater treatment facilities apply biotechnology in artificial conditions.  In public areas, buildings that discharge wastewater must have on-site treatment facilities.  Post-treatment wastewater must meet standard B according to QCVN 14:2008-BTNMT.

- Collection and treatment of solid waste:

The amount of solid waste is expected to be 7 tonnes per 24 hours. Solid waste should be sorted into at least two categories: inorganic and organic, at the source. Organic solid waste is collected daily.  Inorganic solid waste is collected periodically.

Solid waste storage areas should be placed in the basement of buildings.  Install a comprehensive solid waste collection system connecting the top of the building to every floor and leading to the solid waste tank. At the source, solid waste is sorted and then transported to the centralized municipal treatment facility under a contract with a specialized unit.

Public trash cans are strategically placed in traffic areas and common spaces for the convenience of visitors.

5. Detailed planning of 1/500 scale of the cluster of head offices in Me Tri:

a) Location, boundaries, and size of the cluster of head offices in Me Tri:

The planned land zone is located in the southwest of the expanded city center, belonging to the administrative boundaries of Me Tri and Trung Van wards, Nam Tu Liem district, Hanoi city.

The detailed planning scale is about 55 ha (the area in Me Tri ward is about 43.6 ha, Trung Van ward is about 11.4 ha).

The overall space of the planned land zone consists of a cluster of architectural works with a relatively uniform height of 17-25 floors. These buildings will house the head offices of various ministries and agencies. They will be arranged around the perimeter of the land, while the middle core will be dedicated to green spaces, water surfaces, and public works for common use.

Head offices of central agencies are located adjacent to Thang Long Boulevard and Cuong Kien Street to facilitate quick access from main roads and clear observation of the offices' architectural features from urban axes. Construct frontage roads parallel to Thang Long Boulevard and Cuong Kien Street for convenient access to the head offices and better communication between agencies. Each agency will have a main gate directly connected to the frontage road.

The focal point of the planned land zone is a beautifully designed lake park that will be linked to public works and convention centers. This will create an eco-friendly open space for the cluster of head offices. The lake is part of a common network that regulates surface water drainage for the area.

The height of buildings:  To create a sense of uniformity within the cluster of head offices, the buildings have a standard height of 17-25 floors, while the public service works have a standard height of 3-5 floors. Use 2 - 5 floors underground for parking, infrastructural works, and storage purposes.  Open up the first and second floors to create a reception hall and a pedestrian walkway.

Regarding building density: Head office buildings have a building density of up to 40% of the land area they occupy, leaving the remaining area for surface parking, yards, and gardens to enhance the overall landscape. The building density is concentrated on the exterior, while the interior spaces are designed to be open and seamlessly with the surrounding greenery and water surface.

The building's architecture features a uniform design, with the number of architectural blocks used varying depending on the size and needs of each agency. The architecture of the building is designed to be simple, using geometric shapes to create diverse and visually appealing spaces while still maintaining a sense of solemnity and strength that is fitting for a central administrative agency's building.

Utilize public transportation to separate traffic flows for visitors and officials coming to work, as well as internal traffic in the cluster of head offices to prevent overlapping traffic and make it easier to manage the operation of the cluster.

The at-grade parking lots are located in a scattered manner and are connected to the head office to cater to the parking needs of incoming visitors’ and state-owned vehicles.  Utilize the underground parking lots to cater to the parking needs of staff working in the office area. Encourage the connection between basements to enhance circulation and reduce the number of vehicles within the internal cluster of head offices.

Enhance trees and gardens around the central lake to create eco-friendly landscapes for the nearby cluster of head offices. A system of public utilities has been set up around the lake park to cater to the needs of the staff working at the cluster of head offices. Choose large, tall trees that provide year-round shade and avoid trees that require frequent pruning. The cluster of trees is combined with the building architecture to create a formal atmosphere for the cluster of head offices.

Build a separate system to manage and maintain landscape works, public utilities, and security in the cluster of head offices. This will ensure the sustainable maintenance of the landscape environment’s quality.  Promote the use of trams and overhead pedestrian bridges to improve pedestrian mobility. This helps facilitate movement between agencies and from head offices to public works.

The technical infrastructure system operates underground and is organized within tunnels to enhance maintenance and operation efficiency. The equipment on the ground, such as light poles, hydrants, fire hydrants, and trash cans, are specifically designed to create own features and blend in with the surrounding trees and buildings. This contributes to the overall beauty of the cluster of head offices.

c) Master plan for land use;

Land for offices and offices:  Including land plots with symbols CQ1 – CQ2; land for office is 81,278 m2, accounting for 14.8 % of the planned land zone; the building has 17 to 25 floors above ground and 2 to 5 floors below ground, maximum building density is 40 %; the gross floor area is about 137,000 m2; the number of people working is about 4,200.

Land for public and service works: Including land plots with symbol CC with area of 11,387 m2, accounting for 2.1% of the planned land zone; the building has 3 to 5 floors above ground, maximum building density is 40%; the gross floor area is about 17,000 m2.

Land for trees and water surface: Including land plots with symbols X1-X7 with area of 124,386 m2, accounting for 22.6% of the planned land zone; the building has 1 floor above ground, maximum building density is 10%. On the land designated for trees and water surface, public works are set up to benefit both the head offices and locals.

Land reserved for development: Including land plots with symbols DT1 – DT5 with area of 220,075 m2, accounting for 40% of the planned land zone; the building has 20 - 25 floors above ground, 2 – 5 floors underground, maximum building density is 40%.

Land for roads: The land area is 112.654 m2, accounting for 20.5% of the planned land zone.

d) Technical infrastructure planning:

Connect internal traffic in the planned land zone with regional roads including Thang Long Boulevard, Cuong Kien road and extended Le Quang Dao road.

The road system is designed in accordance with its own transport network.  The road system conforms to the chosen traffic plan in Me Tri area. The road system primarily connects Thang Long Boulevard, and also links the East and West routes. The width of the roads in the planned land zone is 25 - 31 m.

Promote the use of urban public transport, such as buses and trains on the major routes within the zone, to provide convenient means of transportation. This will help reduce the reliance on personal vehicles.

Provide underground parking with 2-5 floors and floating parking in the head offices to cater to the parking needs of officials and visitors.

- Ground leveling planning:

The construction level for the area is Hxd ≥ +6.4 in accordance with the urban zoning plan H2-2. The level of the road centerline at the intersections is determined on the basis of the limited levels, in compliance with the rainwater drainage planning and the depth of underground culverts.

The ground level of the plots has been designed to facilitate natural drainage in line with the land use planning and drainage distribution of the plots.

- Rainwater drainage planning:

Design a synchronous rainwater drainage system (culverts, collector wells, manholes, drainage gates), arranged along the roadways. This culvert system collects rainwater from buildings’ roofs and ground in the zone, and drains it to the balancing lake. From there, it flows through a 12m drainage ditch in Me Tri in the east, and ultimately empties into the Nhue river to the south.

- Water supply:

The total demand for water supply is about 1,200 m3 per 24 hours.  The water source is supplied from the existing D300 mm distribution water supply pipe, which is located to the north of the cluster.

The water supply network in the cluster of head offices has a pipe diameter of 100mm - 150mmm, which connects to the existing water pipelines with diameter of 300mm.

The head offices receive water through connection points with a diameter of 75 - 100 mm, which are directly connected to the local pipeline of 100 - 150 mm in diameter.

Place the fire hydrant on the water supply pipe that has a diameter of 100 mm or more. The distance between fire hydrants is 150 m.  When designing a building, it is essential to include a separate firewater supply system to ensure the sufficient water supply for the building's fire-fighting needs.

- Power supply planning:

The power supply demand is about 6,000 KW. Power supply is taken from 110/22KV Thanh Xuan station. Build a new 22KV underground cable line from Thanh Xuan 110KV substation to supply power to low voltage substations in the zone.

Build new substations for buildings of ministries and agencies in the research and design area to ensure stable power supply for each ministry or agency.

The 0.4KV low voltage network and lighting will be installed underground in utility trenches located on the planned roads into construction works and clusters of construction works.

The planned land zone has a total subscriber demand of approximately 4.000 lines. Trunk cable lines will be built from the remote subscriber switch (RSS) to connect the subscriber cable cabinets. Trunk cable lines are placed in utility trenches.

Each building of the ministry or branch will have 1 cabinet.  Telephone cable cabinets can be placed alongside substations, low voltage power supply cabinets.

Fiber optic lines will be installed from the cable cabinets to each subscriber's location. Fiber optic lines are placed in the same utility trenches as low voltage power and lighting cables.

- Waste water collection and treatment:

Expected wastewater volume: 1,000 m3 per 24 hours. Wastewater is collected through the building's drainage system and is initially treated in the septic tank. It is then directed to a separate wastewater drainage system which leads to the centralized wastewater treatment station, which will be Phu Do wastewater treatment plant as determined in the H2- 2 zoning planning.

Until the Phu Do wastewater treatment plant is constructed, the cluster of head offices in Me Tri area requires an on-site facility for treating wastewater. It is expected to install 01 wastewater treatment station located in the parking lot area, with a wastewater treatment station capacity of about 1,000 m3 per 24 hours.  Post-treatment wastewater must meet standard B according to QCVN 14:2008-BTNMT. The wastewater treatment tank is designed in a modular type, utilizing biological treatment in artificial conditions. It can be installed underground to conserve space and minimize its impact on the environment and landscape.

- Collection and treatment of solid waste:

The amount of solid waste is expected to be around 4 tonnes per 24 hours. Solid waste should be sorted into at least two categories: inorganic and organic, at the source. Organic solid waste is collected daily.  Inorganic solid waste is collected periodically.

- Cemetery management

Graves have been discovered scattered throughout the planned zone. It will require a plan to clear and relocate these graves to the centralized cemetery of the city when executing the project.

In the northwest of the planned land zone lies the Me Tri cemetery, which must be closed to new burials. Plant trees around this cemetery to create a barrier between the cemetery and its surroundings and renovate the surrounding landscape. In the future, if there is a need to repurpose the land of this cemetery, it can be cleared and relocated to the city's centralized cemetery based on the existing planning.

Article 2.Implementation

1. Planning phases:

a) In the West Ho Tay:

- From 2023 to 2025 (amendments to the medium-term public investment capital plan for 2021 - 2025): Prepare for phase-1 investment. Specific preparations should be made to build infrastructure and head offices for agencies that urgently need to relocate in phase 1 (to determine medium-term public investment capital plan and construction investment in the period of 2025 - 2030).

- From 2026 to 2030: Implement phase-1 investment and prepare for phase-2 investment. In specific:

+ Build infrastructure and head offices for agencies that urgently need to relocate in phase 1 (completely build the new head office, relocate, and hand over the old one by 2030);

- From 2031 to 2035: Build the head offices of remaining agencies and public works (phase 2).

b) In Me Tri area:

- From 2023 to 2025: Specific preparations should be made to build the head office of the Ministry of Agriculture and Rural Development; finish construction and begin using the head office of Vietnam Social Security.

- From 2026 to 2030: Build the head office of the Ministry of Agriculture and Rural Development, and make specific preparations to build infrastructure for other agencies that need relocating.

- From 2030 onwards: Build infrastructure for other agencies that need relocating.

2. Resources for planning implementation:

Based on the situation and results of the implementation of the socio-economic development plan; the ability to balance public investment capital and attract investment capital from other economic sectors and the plan to implement the planning in Clause 1 of this Article, the following resources should be prioritized for the implementation of the planning in each respective phase:

- Source of public investment capital:  The financial source for compensation and site clearance, construction of technical infrastructure, and construction of head offices of ministries and agencies.

- Sources of funds from private sector involvement or other lawful sources of funds: Mobilize sources of funds from private sector involvement or other lawful sources of funds to invest in public works and services for communal use (shopping malls, conventional centers, hotels, etc.).

Comply with Decision No. 130/QD-TTg dated January 23th, 2015, on the solution and schedule for relocation of industrial factories, hospitals, tertiary and vocational education institutions and other facilities out of urban areas of Ha Noi and use of unoccupied land areas thereof.

After relocation, the old property will be subject to centralized management measures. In the short term, assess the value of the old property within the urban area context, as well as preserve and protect buildings with heritage value.

The Ministry of Finance shall take charge and cooperate with relevant ministries and agencies, and the People’s Committee of Hanoi city in developing a specific plan for utilization of each property to support the activities of both central agencies and Hanoi city. If the property is not used as an administrative agency's office, the State will hold a public auction to generate revenue.

If the property is not used as an administrative agency's office, the transformation should prioritize the principles that have guided the general construction planning of Hanoi capital, such as urban restructuring, for public use, transformed into flower gardens, and parking lots, while limiting the extra load on the zone's infrastructure.

The valuation and auction of existing property, after relocation, must comply with applicable regulations of law.

4. Assignment:

a) Ministry of Construction shall:

- Prepare and promulgate a Regulation on management of planning - architecture in accordance with the law on urban planning and architecture; manage the construction according to the approved planning and the approved Regulation on management of planning - architecture.

- Coordinate with the Ministry of Planning and Investment, the Ministry of Finance, the People's Committee of Hanoi in proposing a plan for investment in technical infrastructure system, trees, landscapes, and other public works (shopping malls, convention center, hotels, etc.) and sources of fund thereof, and then presenting it to the Prime Minister for review and decision-making.

Give priority to use the revenues from the handling of the property at old locations of ministries and agencies (sale of property on the land, transfer of land use rights (if any) under the Plan to rearrange and handle property and the approved planning) for construction of head offices of ministries and agencies at new locations in accordance with the law on state budget, laws on public investment and other relevant laws, in accordance with the plan to rearrange and handle property as prescribed in Clause 5, Article 23 of Decree No. 167/2017/ND-CP dated December 31, 2017 of Government on the rearrangement and handling of public property.

c) Ministries and agencies to be relocated shall:

- Formulate a detailed roadmap for relocation of old property, plan to build new property according to the plan for implementation of the planning approved by the Prime Minister.

- Make a plan to rearrange and handle property under their management; consult the Hanoi People's Committee; send it to the Ministry of Finance for consolidation, draw up a master plan to rearrange and handle property of the ministries and agencies that have to be relocated for presentation to the Prime Minister for approval.

- To develop specific projects for construction of the ministry's head offices, it is necessary to determine the number of people working and the organizational structure of the agencies at the head offices. This will serve as a basis for forecasting the land use demand, floor area, and ancillary infrastructure required for the projects. In addition, it is necessary to consult the Ministry of Home Affairs and the Ministry of Finance; and then send a report to the Ministry of Construction for construction management according to the approved planning, and Regulation on management of planning - architecture.

- Prepare for investments, oversee project management and construction, and finally take possession of and utilize the completed head offices.

d) The Ministry of Planning and Investment shall take charge and coordinate with the Ministry of Finance, the Ministry of Construction and other ministries and agencies to be relocated in:

- Balancing, revising and supplementing the 2021-2025 medium-term public investment capital plan, and then presenting it to the competent authorities for approval of phase 1 investment preparation.

- Propose competent authorities to provide funding from a medium-term public investment capital plan for the period 2026 - 2030 to build infrastructure systems, trees and landscapes in the cluster of head offices in West Ho Tay, to build head offices of agencies that urgently need to relocate in phase 1, and funding to prepare for building the head offices of the remaining ministries and agencies.

dd) Hanoi People's Committee shall:

- Compensate for site clearance, build technical infrastructure that connects to the cluster of head offices in West Ho Tay and Me Tri.

- Coordinate with the Ministry of Planning and Investment, the Ministry of Finance, the Ministry of Construction in proposing a plan for investment in technical infrastructure system, trees, landscapes and other public works (shopping malls, convention center, hotels, etc.) and sources of fund thereof. The plan is then presented to the Prime Minister for review and decision-making.

- Coordinate with the Ministry of Finance and the ministries and agencies to be relocated in formulating a master plan to rearrange and handle property of the ministries and agencies that have to be relocated.

- Strictly control the development of nearby urban projects to create a spatial connection with the cluster of head offices. Ensure it is suitable for the regional infrastructure without causing congestion at the location of newly built head offices.  Especially high-rise buildings are located close to the head offices of central ministries. Adjust a number of nearby projects to provide more infrastructure and services for the operation of ministries and central agencies.

Article 3.This Decision comes into force from the date it is signed for promulgation.

Ministers, heads of ministerial-level agencies, heads of Governmental agencies, heads of related agencies and the President of Hanoi People's Committee shall implement this Decision.
