CIRCULAR
PROMULGATING THE REGULATION ON THE PROCESS AND FREQUENCY OF EDUCATION QUALITY ASSESSMENT OF UNIVERSITIES, COLLEGES, AND VOCATIONAL HIGH SCHOOLS
Pursuant to the Law on Education dated June 14th 2005; the Law on amending and supplementing a number of articles of the Law on Education dated November 25th 2009;
Pursuant to the Law on Higher Education dated June 18th 2012;
Pursuant to the Government's Decree No. 36/2012/NĐ-CP dated April 18th 2012, defining the functions, tasks, powers and organizational structure of the Ministries and ministerial-level agencies;
Pursuant to the Government's Decree No. 32/2008/NĐ-CP dated March 19th 2008, defining the functions, tasks, powers and organizational structure of the Ministry of Education and Training;
Pursuant to the Government's Decree No. 75/2006/NĐ-CP dated August 02nd 2006, specifying and guiding the implementation of a number of articles of the Law on Education; the Government's Decree No. 31/2011/NĐ-CP dated May 11th 2011, amending and supplementing a number of articles of the Government's Decree No. 75/2006/NĐ-CP dated August 02nd 2006, specifying and guiding the implementation of a number of articles of the Law on Education;
At the proposal of the Director of the Department of Examination and education quality assessment;
The Minister of Education and Training issues a Circular promulgating the Regulation on the process and frequency of education quality assessment of universities, colleges, and vocational high schools.
Article 1. Promulgating together with this Circular the Regulation on the process and frequency of education quality assessment of universities, colleges, and vocational high schools
Article 2. This Circular takes effect on February 12th 2013, and supersedes the Decision No. 76/2007/QĐ-BGDĐT dated December 14th 2007 of the Minister of Education and Training, promulgating the Regulation on the process and frequency of education quality assessment of universities, colleges, and vocational high schools.
Article 3. The Chief officer, the Director of the Department of Examination and education quality assessment, heads of relevant units affiliated to the Ministry of Education and Training; Heads of governing bodies of universities, academies, colleges, and vocational high schools; the Presidents of People’s Committees of central-affiliated cities and provinces; Directors and Principals of universities, academies, colleges, and vocational high schools; Directors of higher education quality assessment organization are responsible for the implementation of this Circular./.

REGULATION
THE PROCESS AND FREQUENCY OF EDUCATION QUALITY ASSESSMENT OF UNIVERSITIES, COLLEGES, AND VOCATIONAL HIGH SCHOOLS

Chapter I
GENERAL REGULATIONS
Article 1. Scope of regulation and subjects of application
1. This document deals with the process and frequency of education quality assessment of universities, colleges, and vocational high schools, including: internal assessment, external assessment, and reassessment, verification of the education quality assessment result, certification of meeting education quality standards.
2. This document is applicable to public and private universities, academies, colleges, and vocational high schools (hereinafter referred to as educational institutions) in the national education system, including the educational institutions funded from abroad that run within the Vietnam’s territory; the relevant organizations and individuals.
Article 2. Interpretation of terms
In this document, the terms below are construed as follows:
1. “Education quality” is the achievement of targets set by an educational institution, the fulfillment of the requirements in the Law on Education, the Law on amending and supplementing a number of articles of the Law on Education, and the Law on Higher Education, the satisfaction of the demand for human resources serving the local and national socio-economic development.
2. “Educational institution quality assessment” is the assessment and certification of the extent of the conformity of the target, contents, and program of an educational institution with the education quality standards.
3. “Internal assessment” is a process in which the educational institution examines and assesses itself based on the education quality assessment standards provided by the Ministry of Education and Training in order to make a report on its education quality, the efficiency of its training, scientific researches, personnel, facilities, and other relevant issues of the purpose of adjusting the resources and the course of implementation in order to meet the education quality standards.
4. “External assessment” is the survey and assessment carried out by an education quality assessment organizations based on the education quality assessment standards provided by the Ministry of Education and Training in order to determine the extent of the conformity of the educational institution with the education quality standards.
Article 3. The education quality assessment standards
1. The education quality assessment standards provided by the Ministry of Education and Training are the requirements and conditions that the educational institution must satisfy to receive the certification of meeting education quality standards.
2. Each educational level has a separate education quality assessment standard. Each standard comprises a number of criteria. Each criterion for education quality assessment is a requirement and condition that must be satisfied from a particular aspect of each standard.
Article 4. The purposes and rules for education quality assessment
1. The education quality assessment is to contribute to the assurance and enhancement of the education quality; determine the extent of achievement of the targets set over a certain period; is the basis for educational institutions to explain the current education quality to competent State management agencies and the society; is the basis for learners to select educational institutions, and for employers to select their staff.
2. The education quality assessment must be:
a) Independent, objective, lawful;
b) Truthful, open, transparent;
c) Equitable, compulsory, periodic.
Article 5. The process and frequency of education quality assessment
1. The process of education quality assessment includes the following steps:
a) The educational institution carries out internal assessment;
b) The educational institution applies for the external assessment carried out by an education quality assessment organization, and request the certification of meeting education quality standards;
c) The education quality assessment organization carries out the external assessment;
d) The education quality assessment organization verifies, certifies, or refuses to certify that the educational institution meets the education quality standards.
2. The education quality assessment is carried out every five years.
Article 6. Announcing the education quality assessment result
1. The educational institution shall:
a) Announce the internal assessment result at least 30 days before applying for the external assessment carried out by an education quality assessment organization;
b) Post the education quality assessment certificate on its website within 30 days from the date on which the education quality assessment certificate is issued (not applicable to the educational institutions of which the information should be kept confidential as prescribed by the State).
2. The education quality assessment organization shall:
a) Post the external assessment result, the resolution and suggestions of the education quality assessment panel on its website at least 30 days before the date on which the education quality assessment certificate is issued to the educational institution (not applicable to the educational institutions of which the information should be kept confidential as prescribed by the State).
b) Post the education quality assessment certificate issued to the educational institution on its website within 5 days from the date on which the education quality assessment certificate is issued to the educational institution. This post must be retained on the website for at least 5 years.
3. The Ministry of Education and Training shall announce the list of education quality assessment organizations licensed to carry out education quality assessment on the website of the Ministry of Education and Training and on the mass media.
Chapter II
INTERNAL ASSESSMENT
Article 7. The internal assessment process
The internal assessment process includes:
1. Establishing the internal assessment panel.
2. Carrying out the internal assessment.
Article 8. Establishing the internal assessment panel.
1. The number of members of the internal assessment panel is an odd number. An internal assessment panel has at least 11 members. Its establishment is decided by the Director or Principal (hereinafter referred to as Principal).
2. The president of the internal assessment panel is the Principal, the Deputy President is a Deputy Principal. Other members are representative of the school panel or the Board of Directors, the Science and Training panel; representatives of the unit (department or center…) in charge of education quality assurance; the Chief of departments, the deans; reputable lecturers and teachers; representatives of students, and other organizations affiliated to the educational institution. The panel includes a secretary panel, leaded by the manager of the unit in charge of education quality assurance.
3. The internal assessment panel works on the principle of democratic centralism, and reaches agreements through discussions.
Article 9. Functions and tasks of the internal assessment panel.
1. The internal assessment panel shall carry out the internal assessment, and advise the Principal to enhance the quality of the activities of the educational institution.
2. The internal assessment panel shall:
a) Disseminate the policies on the internal assessment; introduce the internal assessment process, exchange experience of internal assessment, request relevant units and individual to cooperate;
b) Collect information and evidence, review the activities and compare the achievements with the set target; assess the extent of achievement, determine the pros and cons of the educational institution; suggest plans for improving and enhancing the education quality;
c) Compare the achievement with the education quality assessment standards established by the Ministry of Education and Training, and make the internal assessment report;
d) Announce the internal assessment report of the educational institution;
dd) Suggest the organization and maintenance of the database about the activities of the educational institution; carry out the education quality improvement activities.
3. The members of the internal assessment panel shall:
a) The panel president is responsible for the activities of the panel, assigns tasks to each member; convene and preside the meetings of the panel; approve the internal assessment plan; direct the data and evidence collection; analyze and make the internal assessment report; resolve the issues arising during the internal assessment.
b) The deputy president shall operate the panel upon the delegation of the panel president, and take responsibility for the assigned and delegated tasks;
c) The panel members shall perform the tasks assigned by the panel resident and take responsibility for them.
4. The panel members must be provided with training in internal assessment techniques, including: the education quality assurance system; the process and frequency of education quality assessment; the internal assessment guidance; the experience of internal assessment at home and overseas; the techniques of studying documents, interviewing, observing, discussing, investigating, and making report.
5. The internal assessment panel may request the Principal to hire experts to assist the panel in carrying out the internal assessment. The expert must hold a master’s degree or higher, be proficient in the education quality assessment and assurance, internal assessment, and necessary techniques to carry out the internal assessment.
Article 10. The internal assessment steps
1. Make the internal assessment plan.
2. Collect information and evidence. Process, analyze the information and evidence collected.
3. Make the internal assessment report.
4. Announce the internal assessment report of the educational institution.
5. Carrying out the activities after completing the internal assessment report.
Article 11. The internal assessment plan
1. The educational institution shall make the internal assessment plan.
2. The internal assessment plan made by the educational institution must specify:
a) The purposes and extent of the internal assessment;
b) The composition of the internal assessment panel.
c) The assignments of each panel members, the jobs to be done corresponding to each standard, the beginning and ending time, the person in charge and the cooperators;
d) The internal assessment instruments;
dd) The information and evidence that need collecting;
e) The estimate of the resources and time for mobilizing resources during the internal assessment;
g) The schedule: specifying the necessary time for deploying, and the schedule for doing specific activities during the internal assessment.
Article 12. Information and evidence
1. Information is the materials used for supporting and illustrating the opinions in the internal assessment report made by the educational institution. The information shall be collected from multiple sources to ensure the reliability and accuracy.
2. Evidence is the information attach to the criteria for determining the fulfillment of the criteria.
3. The internal assessment panel shall appoint its member to collect, process, analyze information and evidence before making the internal assessment report.
Article 23. Making the internal assessment report
1. The internal assessment report must be succinct, clear, accurate, and provide sufficient information about the activities of the educational institution, specify the pros and cons, the difficulties, and suggest the solutions for improving the quality, the plan, the time limit, and the time of the next internal assessment.
2. The internal assessment results shall be presented in succession according to the education quality assessment standards. The results shall be presented in succession according to each criterion of a standard. The report on each criterion comprises 5 parts: The description and analysis of the activities of the educational institution relevant to the criterion, attached with information and evidence; the strengths and factors that need intensifying; the weaknesses; the action plan; the internal assessment of the extent of fulfillment of the criterion.
3. The draft internal assessment report must be circulated in the educational institution for at least 2 weeks so that the managers, lecturers, teachers, employees, and students can read and comment.
4. The opinions collected after announcing the draft internal assessment report shall be collected and processed, then the internal assessment report shall be completed.
Article 14. Retaining and using internal assessment report in the educational institution
1. After being completed, the internal assessment report shall be passed by the Principal of the educational institution and retained together with the relevant documents during its compilation and completion.
2. The copies of the internal assessment report shall be kept in the library, lent and used in accordance with the regulations of the Principal.
Article 15. The activities after completing the internal assessment report
1. The plan for improving the quality specified in the internal assessment report shall be implemented in order to improve and enhance the education quality.
2. Annually, the internal assessment report shall be updated with the conditions of the educational institution (in the form of annual additional report) and retained in the library of the educational institution.
Chapter III
EXTERNAL ASSESSMETN AND REASSESSMENT
Article 16. The conditions for applying for the external assessment
1. An educational institution may apply for the external assessment carried out by an education quality assessment organization when the following conditions are satisfied:
a) The internal assessment report is complete;
b) The internal assessment report has been announced as prescribed in Point a Clause 1 Article 6 of this Regulation. If the information of the educational institution must be kept confidential as prescribed by the State, the educational institution shall send the internal assessment report to its governing body in order to apply for the external assessment.
2. Every 5 years or at the request of the State agencies in charge of education management, the educational institution shall prepare the internal assessment report and apply for the external assessment in order to obtain the certification of meeting education quality standards.
Article 17. Verifying the internal assessment result and signing the contract for external assessment between the education quality assessment organization and the educational institution
1. At the request from the educational institution, the education quality assessment organization licensed by the Ministry of Education and Training shall sign a contract with the educational institution to verify the internal assessment report. The educational institution shall send the internal assessment report and relevant documents to the education quality assessment organization for verification.
2. Within 30 days from the date on which the contract is signed, the education quality assessment organization shall verify the internal assessment report and send the verification result to the educational institution.
a) If the internal assessment report does or satisfy the requirements of format and content, the educational institution must complete it;
b) If the internal assessment report satisfies the requirements, the external assessment may be carried out.
3. If the internal assessment report satisfies the requirements, the education quality assessment organization shall sign the contract for external assessment with the educational institution.
4. The contract to verify the internal assessment report and the external assessment contract signed between the education quality assessment organization and the educational institution must comply with the law on economic contracts.
Article 18. The external assessment process
The external assessment process includes:
1. Establishing the external assessment commission.
2. Taking the steps in external assessment.
Article 19. Establishing the external assessment commission
1. A external assessment commission, comprising 5 – 7 members, established under the decision of the Director of the education quality assessment organization, includes:
a) The chief commissioner being a director (or former director) of a university, academy, college, or vocational high school corresponding to the assessed educational institution, or a director (of former director) of a Department, who is experienced in carrying out external assessment, has an education quality assessor’s card. The chief commissioner shall manage the activities of the commission;
b) A secretary and a standing member of the external assessment commission who are acquainted with education quality assessment and have the education quality assessor’s cards. The secretary shall assist the chief commissioner in carrying out the activities and preparing the report. The standing member shall and the secretary shall assist the chief commissioner in preparing and carrying out the external assessment;
c) The remaining members include 2 – 4 experts from other educational institutions, State agencies in charge of education and training, socio-professional organizations, or employers corresponding to the disciplines of the assessed educational institution, who have education quality assessor’s cards or certificate of completion of assessor training courses as prescribed by the Ministry of Education and Training. The members shall perform the tasks assigned by the chief commissioner.
2. Members of the external assessment commission must:
a) Be qualified, ethical, honest, and objective; have good health to perform the assigned tasks;
b) Teach or participate in managerial activities at higher education institutions or vocational schools for at least 10 years; the members being employers do not have to teach or engage in managerial activities, but must have at least 05 years of experience of enterprise management;
c) Have labor contracts signed with the education quality assessment organization;
d) Make a written commitment with the education quality assessment organization that the have never worked for the assessed educational institution; have never contributed capital, purchased stocks and bonds; and no family members (parents, spouses, children, siblings) are members in the board of directors of the educational institution.
3. Before establishing the external assessment commission the education quality assessment organization must send the tentative list of the composition of the external assessment commission to the educational institution. The educational institution may request the education quality assessment organization to replace one or some members of the commission if there is evidence that such members have been in a conflict of interest with the educational institution, but may not suggest or propose any particular individual for the external assessment commission.
The educational institution is considered to concur with the tentative list made by the education quality assessment organization if the educational institution does not give any opinion within 10 working days from the date on which the tentative list is received
Article 20. The external assessment steps
1. The external assessment shall be carried out after the education quality assessment organization and the educational institution has signed the external assessment contract, and the external assessment commission is established as prescribed in Article 19 of this Regulation.
2. The external assessment includes the following steps:
a) Examine the internal assessment documents:
The external assessment commission shall examine the internal assessment report and relevant documents of the educational institution; collect, process the information and evidence related to the education quality assessment standard;
b) Carry out the preliminary survey at the educational institution;
c) Carry out the official survey at the educational institution;
d) Draft the external assessment report and send it to the educational institution for seeking opinions:
- The draft external assessment report must be passed by at least 2/3 of the commission members;
- The external assessment commission shall send the draft external assessment report to the educational institution for seeking opinions via the education quality assessment organization within 15 working days from the date on which the educational institution receives the draft report.
dd) Complete the external assessment report:
- Within 15 working days from the date on which the feedbacks from the educational institution is received, or from the deadline for the educational institution to give opinions, the external assessment commission shall send a notice about the accepted and rejected opinions via the education quality assessment organization. The reasons for rejecting opinions must be explained;
- The external assessment commission shall complete the external assessment report, then send it together with the relevant documents (if any) to the Director of the education quality assessment organization. Then the education quality assessment organization shall officially send the external assessment report to the educational institution and request the contract liquidation.
3. The external assessment commission must keep the information related to the works and assessment result confidential until the education quality assessment organization officially sends the external assessment report to the educational institution.
Article 21. Reassessing the assessment result given by the external assessment commission
Within 10 working days from the day on which the external assessment report and the request for the contract liquidation of the education quality assessment organization are received, the educational institution may request the education quality assessment organization to reassess the external assessment result upon the occurrence of the following issues:
a) The external assessment result makes the educational institution fail to satisfy the requirements as prescribed in Clause 4 Article 27 of this Regulation against the expectations of the educational institution;
b) The educational institution does not concur with part or the whole assessment report made by the external assessment commission.
2. The commission that reassesses the assessment result given by the external assessment commission shall be established by the education quality assessment organization. The composition of this commission is similar to that of the external assessment commission. The members that participated in the external assessment commission at the educational institution may not join the reassessment commission.
3. The reassessment commission shall examine the documents of the external assessment commission, consult with the members of the external assessment commission; carry out the survey at the educational institution, consult with the heads of the educational institution, the internal assessment panel, and make a report on the reassessment of the assessment result given by the external assessment commission.
4. The reassessment result is considered the final conclusion of the education quality assessment organization about the educational institution. The educational institution must pay the cost of the reassessment of the assessment result given by the external assessment commission under the economic contract signed with the education quality assessment organization.
Article 22. Using the reassessment and external assessment results
The reassessment and external assessment results (if any) are the basis for the educational institution to implement the plan for improving and enhancing the education quality, and for the education quality assessment panel of the education quality assessment organization to verify and approve or disapprove the certification that the educational institution meets the educational institution standards.
Article 23. Responsibility of the educational institution for the external assessment and reassessment (if any)
1. Prepare the documents and data related to the activities of the educational institution, and other conditions for the external assessment and reassessment (if any).
2. Appoint a leader of the educational institution and a specialized manager to work with the external assessment commission and the reassessment commission (if any).
3. Cooperate and consult with the external assessment commission about the internal assessment report examination result, and the result of the survey carried out at the educational institution.
4. Within 15 working days from the date on which the draft external assessment report is received, the educational institution shall send a notification to the education quality assessment organization, specifying the agreement of disagreement on the draft external assessment report.
If the external assessment report is disapproved, the reasons and evidence must be provided. If the educational institution does not send any feedback after this deadline, it is considered to concur with the draft external assessment report.
After the external assessment result is concurred with, or after the reassessment, the educational institution shall send the education quality assessment organization a written request for the certification of meeting education quality standards.
Chapter IV
VERIFYING THE EDUCATION QUALITY ASSESSMENT RESULT
Article 24. The education quality assessment panel of the education quality assessment organization
The functions, tasks, entitlements, composition, and the methodology of the education quality assessment panel of the education quality assessment organization must comply with the regulations on the establishment, dissolution, tasks, and entitlements of education quality assessment organizations promulgated by the Minister of Education and Training.
Article 25. The dossier on the verification of education quality assessment result
1. The dossier on the verification of the education quality assessment result includes: the internal assessment report, the external assessment report, the written request made by the educational institution for the announcement of the external assessment result, for the certification of meeting education quality standards; the written feedbacks from the educational institution on the external assessment report, the notification made sent by the external assessment commission to the educational institution of the acceptance or rejection of opinions; the reassessment report (if any); the report on the summary of the results of the internal assessment, external assessment, and reassessment (if any), the summary of the issues that need discussing.
2. The secretary team shall assist the panel in making the plan for verifying the education quality assessment result, preparing the verification dossier, and sending the verification dossier to the panel members at least 15 working days before the panel meeting.
Article 26. The process of the verification of education quality assessment result
The verification of education quality assessment result shall be carried out in the following order:
1. The panel meeting shall be convened and presided by the president or a delegated deputy president of the panel to perform the following tasks:
a) Listen to the summary of the results of the internal assessment, external assessment, reassessment (if any), and the issues that need discussing;
b) Discuss the internal assessment result, the external assessment result, and the reassessment result (if any); the draft resolution of the panel on the verification of the education quality assessment result;
c) Seeking recommendations of the panel to the educational institution about the rectification of the weaknesses, the improvement and enhancement of the education quality of;
d) The panel shall ballot for the approval of the resolution on the verification of the education quality assessment result.
2. Within 10 working days from the date on which the verification result is available, the education quality assessment organization shall send the educational institution that applied for the education quality assessment the resolution on the verification of the education quality assessment result, the recommendations of the panel to the educational institution about the rectification of the weaknesses, the improvement and enhancement of the education quality.
3. If no course has been completed, the educational institution shall use the result of the verification of the education quality assessment for the improvement and enhancement of their education quality. If at least one course is completed, within 20 working days from the date on which the documents prescribed in Clause 2 of this Article is received, the educational institution must send written feedbacks to the education quality assessment organization on:
a) The agreement with the resolution and recommendations of the panel; requesting the education quality assessment organization to consider and certify that the educational institution meets the education quality standards, and issue the education quality assessment certificate; or
b) The agreement with the resolution and recommendations of the panel; the plan made by the educational institution for overcoming the weakness, improving and enhancing the education quality for the purpose of applying for the education quality assessment in the near future;
c) The disagreement on part or the whole resolution and recommendations of the panel; calling for the reconsideration from the education quality assessment organization.
4. In the cases prescribed in Point a Clause 3 of this Article, within 10 working days from the date on which the written feedback sent by the educational institution is received, the education quality assessment organization shall post the external assessment result, the resolution, and the recommendations of the panel on the website of the education quality assessment organization. After 30 days from the announcement date, if there is no complaint is made, the education quality assessment organization shall issue the education quality assessment certificate to the educational institution; if complaints are made, the education quality assessment organization shall review the entire process and the dossier on the verification of the education quality assessment result before deciding to issue or not to issue the education quality assessment certificate to the educational institution.
5. In the cases prescribed in Point b Clause 3 of this Article, the education quality assessment organization must explain the resolution and recommendations of the panel at the request from the educational institution; provide consultancy, and assist the educational institution in improving and enhancing its education quality.
6. In the cases prescribed in Point v Clause 3 of this Article, the education quality assessment organization shall reconsider the resolution and recommendations of the panel in the next periodic meeting as prescribed in Clause 1 of this Article, and take the next steps prescribed in this Article.
Chapter V
CERTIFICATION OF MEETING EDUCATION QUALITY STANDARDS
Article 27. Conditions for the certification of meeting education quality standards
An educational institution shall be certified that it meets the education quality standards when the following conditions are satisfied:
1. At least one course is completed.
2. An external assessment is carried out, and a written request sent to the education quality assessment organization for the certification of meeting education quality standards is made. If the information of the educational institution must be kept confidential as prescribed by the State, the educational institution shall request that the external assessment result be sent to the governing body, and apply for the certification of meeting education quality standards.
3. The external assessment result, the resolution, and the recommendations of the education quality assessment panel shall be posted on the website of the education quality assessment organization as prescribed in Point a Clause 2 Article 6 of this Regulation. If the information of the educational institution must be kept confidential as prescribed by the state, the external assessment result, the resolution and recommendations of the panel shall be sent to the governing body at least 30 days before the education quality assessment organization issues the certification for seeking assenting opinions.
4. The educational institution meets at least 80% of the criteria, and meets at least 01 criterion of a standard according to the education quality assessment result of the education quality assessment panel.
Article 28. The education quality assessment certificate
1. According to the request made by the education quality assessment panel, the Director of the education quality assessment organization shall issue the education quality assessment certificate to the educational institution that satisfy the conditions in Article 27 of this Regulation.
2. The education quality assessment certificate is valid for 5 years from its date of issue, specifying the percentage of met criteria.
3. The education quality assessment certificate is designed and printed by the education quality assessment organization after its design is registered with the Ministry of Education and Training.
Article 29. Responsibility of the educational institution issued with the education quality assessment certificate
1. Announce the education quality assessment certificate as prescribed in Point b Clause 1 Article 6 of this Regulation.
2. Send reports to the Ministry of Education and Training and the governing body of the results of the education quality assessment, the plan for improving and enhancing the education quality after being issued with the education quality assessment certificate.
3. Sustain and develop the conditions for education quality assurance. Implement the recommendations made by the education quality assessment panel about the rectification of the weaknesses (if any) and the improvement of the education quality.
4. Sustain and improve the certified education quality assessment result during the validity period of the education quality assessment certificate. If the quality is not sustained consistently with the certified result, depending on the nature and seriousness of the violations, the educational institution shall be warned or have the education quality assessment certificate revoked.
5. Make and send a mid-term report to the Ministry of Education and Training, the governing body, and the education quality assessment organization after 2.5 years from the date on which the education quality assessment certificate is issued.
Article 30. Revoking the education quality assessment certificate
If the education quality assessment certificate is unexpired, and the educational institution commits violation of law or no longer satisfies the requirements of the education quality assessment standard, the State agency in charge of education management shall request the Director of the education quality assessment organization to revoke the education quality assessment certificate.
Article 31. Responsibility of the education quality assessment organization
1. Post the external assessment result, the resolution, and the recommendations of the education quality assessment panel on the website of the education quality assessment organization as prescribed in Point a Clause 2 Article 6 of this Regulation.
2. Announce the education quality assessment certificate issued to the educational institution as prescribed in Point b Clause 2 Article 6 of this Regulation.
3. Make decisions on revoking the education quality assessment certificates issued to educational institutions at the request of a State agency in charge of education management as prescribed in Article 30 of this Regulation.
Chapter VI
IMPLEMENTATION ORGANIZATION
Article 32. The Department of Examination and education quality assessment shall:
1. Plan the education quality assessment according to the general plan of the education sector.
2. Instruct, supervise, inspect, and assess the implementation of the regulations on education quality assessment at the education quality assessment organizations, educational institutions, and relevant units.
3. Announce the list of education quality assessment organizations licensed to assess education quality as prescribed in Clause 3 Article 6 of this Regulation.
4. Request the Directors of education quality assessment organizations to revoke the education quality assessment certificates issued to educational institutions as prescribed in Article 30 of this Article.
Article 33. The educational institutions shall:
1. Make plans for meeting the education quality standards in each period. Established a specialized unit in charge of education quality assurance to preside and cooperate with other units in implementing such plans.
2. Follow the internal assessment process prescribed in Article 7 of this Regulation. After completing the internal assessment report, it is recommended to carry out cross-assessment among the educational institutions in order to improve the quality of internal assessment reports.
3. Take responsibility for the external assessment, reassessment, and certification of meeting education quality standards as prescribed in Article 23 and Article 29 of this Regulation.
4. Send reports to the governing bodies and the Ministry of Education and Training annually on the result of the plans for improving and enhancing the education quality; facilitate the inspection, supervision, and assessment from competent agencies.
5. Be entitled to make complaints against the acts, decisions, and conclusions made by the organizations and individuals engaged in education quality assessment when proof of the illegality of such acts, decisions, and conclusions are provided.
Article 34. The education quality assessment organizations shall:
1. Carry out the external assessment, and certify that the educational institutions meet the education quality standards as prescribed in Chapter III, IV, and V of this Regulation.
2. Send reports to the Ministry of Education and Training annually on the results of the education quality assessment; facilitate the inspection, supervision, and assessment from competent agencies.
Article 35. The budget
1. The budget of the educational institution for the education quality assessment includes the sources funded by the State budget and the sources outside the State budget. The receipts and spending must comply with the regulations issued by competent agencies (applicable to the receipts and spending belonging to the State budget) and the regulations on internal spending of the educational institution (applicable to the receipts and expenses outside the State budget).
2. Annually, the educational institutions shall make budget estimates for the education quality assessment activities.
3. Educational institutions may receive lawful sponsorships from Vietnamese and foreign organizations and individuals to serve the activities related to the education quality assessment and assurance./.
